What procedures and materials are needed for marriage registration?
The marriage registration procedure is mainly composed of application, examination and registration.
(1) application
Those who meet the requirements for applying for marriage registration shall apply for marriage registration in person with their own registration photos, relevant certificates and supporting materials, and both parties shall fill in the application documents for marriage registration on the spot.
The preparation materials for marriage registration application depend on the specific circumstances. Mainland residents who apply for marriage registration need to hold their ID card, household registration book, marriage examination certificate, single certificate and statement of no blood relationship (lineal blood relatives and collateral blood relatives within three generations). Those who apply for remarriage after divorce should also carry divorce certificates.
Foreigners (including foreigners residing or temporarily staying in China, overseas Chinese, and foreigners residing in China) applying for marriage in China must hold their valid passports or nationality certificates, foreigners' residence permits or temporary entry and residence certificates, and documents that can effectively prove their marital status.
(2) Review
The marriage registration authority shall verify and examine the parties applying for marriage registration to find out whether the application for marriage is correct. If there is any ambiguity, the marriage registration authority will ask the parties concerned, and if necessary, the parties concerned will be required to provide corresponding supporting materials.
(3) Registration (Licensing)
To meet the conditions for marriage, the marriage registration authority shall register and issue a marriage certificate; For divorced people who want to remarry, the marriage registration office will generally cancel the divorce certificate; If necessary, a written statement will be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not registering.
What procedures and documents do you need for divorce?
The divorce registration process is as follows:
(1) application
If the husband and wife divorce voluntarily, they shall sign a written divorce agreement and jointly apply to the relevant marriage registration authority, and provide the following documents and supporting materials as required:
1, marriage certificate of both men and women;
2. Identity documents required for divorce registration, such as my ID card, household registration book, pass, passport or other valid international travel documents;
3. An application for divorce registration filled in at the marriage registration office.
(2) Accept
The marriage registrar shall, in accordance with the relevant provisions, conduct a preliminary examination of the above-mentioned materials submitted by the parties. The marriage registrar shall send a receipt for accepting the application for divorce registration to the parties after the documents and supporting materials submitted by the parties are verified in the first instance. If the application conditions for divorce registration are not met, the marriage registration authority will not accept it, and the parties may request to issue a notice rejecting the application for divorce registration.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, if either party disagrees with the divorce, it can withdraw the application for divorce registration from the marriage registration office that accepts the application for divorce registration with its valid identity certificate and the Receipt for Accepting the Application for Divorce Registration (if it is lost, a written explanation is required), and fill out the Application for Withdrawal of Divorce Registration in person. After verification, the marriage registration authority shall issue the Confirmation Letter for Withdrawing the Application for Divorce Registration. Within 30 days after the expiration of the cooling-off period for divorce, if both husband and wife who request divorce fail to apply for divorce certificates at the marriage registration office, the application for divorce registration shall be deemed to have been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday will be the date of expiration of the period), divorced couples should carry valid certificates and materials according to relevant regulations, such as recent bareheaded photos of both parties, divorce agreement, marriage certificate, ID card, passport or pass, etc. And * * * go to the marriage registration office to apply for a divorce certificate.
