Legal basis: Provisions on Procedures of Public Security Organs in Handling Administrative Cases Article 61 If a public security organ reports, accuses, reports, is exposed by the masses or a criminal suspect surrenders, it shall make the following treatments respectively, and indicate the handling situation in the registration of receiving reports: (1) The case within its jurisdiction shall be investigated and handled immediately, and a receiving registration form and a receiving receipt shall be made, and the receiving receipt shall be given to the informant, the complainant, the informant and the sender. (2) If it falls within the scope of duties of the public security organ but is not under the jurisdiction of the unit, it shall be transferred to the unit with jurisdiction for handling within 24 hours, and the informant, complainant, informant, trafficked person and voluntary surrender shall be informed; (3) For matters that do not fall within the scope of duties of public security organs, if a report can be made on the spot, it shall immediately verbally inform the informant, accuser, informant, transferred person and surrendered person to report to other competent authorities or surrender. If the informant, accuser, informant, transferred person or surrendered person has any objection to the oral notification or cannot make a judgment on the spot, they shall inform it in writing, except for objective reasons such as lack of contact information and unknown identity. The provisions of the preceding paragraph shall apply to illegal acts found in daily law enforcement duties.
