Regulations of Hunan Province on the Administration of Survey and Design of Construction Projects (revised in 2003)

Chapter I General Provisions Article 1 In order to standardize the survey and design activities of construction projects (hereinafter referred to as survey and design), strengthen the management of survey and design, ensure the quality of survey and design, improve the investment benefit of construction projects, and safeguard the public interests and the safety of citizens' lives and property, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Second in the administrative area of this province to engage in survey and design and survey and design related activities, must abide by these regulations. Article 3 The term "construction project survey" as mentioned in these Regulations refers to the activities of identifying, analyzing and evaluating the geological and geographical environment characteristics and geotechnical engineering conditions of the construction site and related areas, compiling the survey documents required by the construction project and providing related services according to the construction project objectives.

The construction engineering design as mentioned in these Regulations (hereinafter referred to as design) refers to the activities of comprehensively planning and demonstrating its technology, economy, resources and environment, compiling the design documents required by the construction project and providing related services according to the objectives of the construction project. Article 4 The construction administrative departments of the people's governments at or above the county level shall exercise unified supervision and management over the survey and design activities within their respective administrative areas.

The relevant professional management departments of the people's governments at or above the county level shall, in accordance with the prescribed duties, supervise and manage the survey and design activities of their respective professions. Article 5 A project construction shall be carried out after investigation, design and construction. Sixth survey and design units should carry out technological innovation, adopt advanced technologies, processes, equipment and new materials, protect the environment, save resources and improve the social, environmental and economic benefits of construction projects. Seventh engaged in survey and design activities, must abide by laws and regulations, and shall not harm the public interests and the legitimate rights and interests of others.

Any unit or individual has the right to report and accuse illegal acts in survey and design activities to the construction administrative department or other relevant departments. Chapter II Qualification Management Article 8 The qualification management system for survey and design shall be implemented.

Survey and design units must apply to the construction administrative department for survey and design qualification certificates in accordance with state regulations, and apply to the administrative department for industry and commerce for industrial and commercial registration. Article 9 An entity applying for a survey qualification certificate or a design qualification certificate must meet the following conditions:

(1) Having registered engineers, registered architects and other professional and technical personnel who meet the requirements;

(2) Having technical equipment and a fixed workplace suitable for its survey and design activities;

(3) Having registered capital that meets the requirements of the state;

(4) Other conditions stipulated by laws and regulations. Tenth survey and design qualifications, according to the standards prescribed by the state, are divided into four grades: A, B, C and D. ..

Grade A and Grade B survey and design qualifications shall be audited by the construction administrative department of the provincial people's government and submitted to the construction administrative department of the State Council for examination and approval.

Grade C and Grade D survey and design qualifications shall be reviewed by the construction administrative department of the municipal people's government in the state where the applicant is located and the relevant professional administrative department of the provincial people's government, and submitted to the construction administrative department of the provincial people's government for approval and certification. Eleventh survey and design units in the event of division, merger or termination, it shall, within thirty days from the date of division, merger or termination, go through the cancellation procedures with the department that originally issued the qualification certificate. The survey and design unit that is divided or merged shall re-apply for the qualification certificate in accordance with the provisions of Article 10.

If the name, address, affiliation or legal representative of the survey and design unit changes, it shall be filed with the department that originally issued the qualification certificate. Twelfth units holding survey qualification certificates and design qualification certificates can undertake survey and design consulting and technical services corresponding to their qualification levels. Thirteenth countries to implement the qualification system of professional and technical personnel in survey and design, should obtain the corresponding qualifications in accordance with the provisions.

Professional and technical personnel engaged in survey and design activities can only be used as qualification certification conditions for a survey and design unit.

Without permission, survey and design personnel shall not undertake survey and design business. Fourteenth survey and design units to hire professional and technical personnel, shall sign a written contract.

Survey and design units shall not allow individuals or other units to engage in survey and design activities in the name of their own units. Fifteenth the implementation of survey and design qualification inspection system. The annual inspection shall be handled by the qualification examination and approval authority, but no annual inspection fee shall be charged. For survey and design units whose qualification conditions have changed, the qualification examination and approval authority shall adjust the qualification grade or cancel the qualification certificate according to the prescribed authority. Article 16 It is forbidden to transfer, alter or forge the qualification certificates, drawings, special seals for qualifications, professional qualification certificates and professional seals of survey and design units. Chapter III Contracting and Contracting Article 17 The contracting and contracting of survey and design projects shall follow the principles of openness, justice, fairness, honesty and credit, and shall not be restricted by regions, departments or industries.

The survey and design projects within the scope of bidding shall be subject to bidding in accordance with the relevant provisions of the state and the province. Eighteenth construction project owners must contract survey and design projects to survey and design units with corresponding qualifications. It is forbidden to contract out survey and design projects to unqualified individuals and survey and design units.

The contractor of survey and design projects must undertake survey and design projects in accordance with the level and scope approved by the survey and design qualification certificate. Individuals and units without survey and design qualifications are prohibited from contracting survey and design projects.
