The "Regulations" apply to the commercial residential projects that newly apply for the "Construction Permit for Finished Residential Buildings" in the central city of our city, and shall be implemented 30 days after the date of promulgation, and suburban (city) counties shall refer to the "Regulations".
Development enterprises can provide upgrading and renovation programs for buyers to choose voluntarily.
According to the regulations, the development enterprise shall provide the general decoration scheme for the finished residential construction project, and the design and construction of the general decoration shall conform to the relevant requirements of the Technical Management Regulations for New Commercial Residential Buildings in Chengdu (First Edition).
Ordinary decoration prices are assessed by professional institutions (construction engineering cost consulting service agencies or real estate assessment agencies) entrusted by development enterprises, and their listed prices shall not exceed the assessed prices, and conform to the provisions of the city's real estate regulation and control policies and management; The development enterprise shall agree with the purchaser on the contents, standards and transaction price of ordinary decoration in the commercial housing sales record contract, and the transaction price of ordinary decoration shall not be higher than the listing price.
The "Regulations" pointed out that according to market demand and product positioning, development enterprises can provide upgrading and decoration schemes on the basis of ordinary decoration schemes for buyers to choose voluntarily. Before handling the pre-sale permit of finished residential buildings, the development enterprise shall entrust a professional institution to evaluate the upgrade and decoration price, and publicize the evaluation report.
The purchaser can choose the upgrading scheme voluntarily within 1 month from the date of choosing the commercial house. If the purchaser chooses to upgrade the decoration scheme voluntarily, the development enterprise shall sign another upgrade agreement with it, stipulating the content, standard, transaction price and payment method of the upgrade decoration. The upgraded decoration price is included in the pre-sale supervision.
Ordinary decoration and upgrading decoration should be integrated with the design, construction, quality supervision and completion acceptance of the main project for the record.
The delivery of model houses is the delivery standard of finished houses.
In order to better protect the buyers' right to know and choose, the Regulations require that newly-built finished houses should not only set up and publicly deliver model houses, but also set up and publicly deliver craft model houses. Development enterprises should choose the apartment with the largest number of houses in this pre-sale batch, and set up at least one set of ordinary decoration delivery model house and one set of craft model house corresponding to this apartment in the saleable houses, sales places or nearby places. The delivery of the model house should truly reflect the contents of the decoration list of the finished house to be delivered as the delivery standard of the finished house. Other contents than the decoration list shall not be set in the model room. For other units that have not set up model rooms, enterprises are required to make decoration renderings for display.
The "Regulations" require that development enterprises should open the delivery of model houses and process model houses until the centralized delivery of finished houses reaches 90% to 90 days. Development enterprises can only close all kinds of model houses after inspection and approval by the local housing construction department. Delivery model houses and process model houses shall not be dismantled, displaced, replaced or changed without authorization during the retention period. If it is really necessary to move the model house, it should be declared to the local housing construction department and notarized. Before the new model house is notarized, the original model house shall not be demolished.
If a development enterprise provides an upgrade and decoration scheme, it shall set up at least one set of upgrade and decoration delivery model houses and one set of process model houses corresponding to each upgrade and decoration scheme.
Decoration information publicity is more comprehensive and transparent.
According to the regulations, the following information should be publicized at the sales site and in official website and enterprises: the information of the development and construction unit of the finished house, the decoration scheme (including the decoration list), the price evaluation report and listing price, the tips for visiting the model house, the telephone number for consulting complaints, and the telephone number for receiving supervision and reporting from the local authorities.
The Regulations also specify the contents of the decoration list: decoration function space, decoration content, name, brand, place of origin, specification, model, material, color, quality grade, environmental protection grade of main decoration materials and spare parts and equipment, searchable links of manufacturers in official website, etc. In addition, the rules for the use of substitute brands are also stipulated. Only when the main selected brand stops production or cannot supply due to force majeure can the substitute brand be selected.
The "Regulations" do not force the construction and display of model houses in finished residential projects, but require development enterprises to publicize relevant decoration information at the sales site and in official website. Before signing a contract with the purchaser, it shall ensure that the purchaser inspects the house to be purchased on the spot, and confirm whether the actual decoration content of the house to be purchased and the decoration list publicized at the sales site are consistent with the sales contract when signing the contract.
Further strengthen the supervision and management of finished housing.
The "Regulations" require that when an enterprise organizes five responsible parties to carry out household acceptance of finished houses, it shall conduct comparative acceptance according to relevant specifications and decoration list. The "Regulations" list in detail the information that development enterprises should provide when delivering finished houses, so that buyers can fully understand the information that enterprises should provide when closing houses.
Relevant departments such as housing construction, market supervision, and urban comprehensive law enforcement will strengthen cooperation and linkage, and severely investigate and deal with regulatory violations such as design, construction, sales, advertising, and contract signing of finished housing. In particular, illegal opening of model houses, inadequate publicity of decoration information, forced or disguised forced buyers to choose to upgrade and decorate, etc., carried out key supervision and inspection, found violations, and resolutely investigated and dealt with them.
