Regulations of Shandong Province on the Promotion of Informatization (revised on 20 16)

Chapter I General Provisions Article 1 In order to speed up the informatization process, standardize the informatization management and promote economic development and social progress, these Regulations are formulated in accordance with the provisions of relevant laws and administrative regulations and combined with the actual situation of this province. Article 2 These Regulations shall be observed in the preparation of information development plans, the promotion of information industry development, the construction of information projects, the popularization and application of information technology, the development and utilization of information resources and the guarantee of information security within the administrative region of this province. Article 3 The promotion of informatization shall follow the principles of overall planning, unified standards, technological innovation, resource sharing, safety and reliability. Article 4 The people's governments at or above the county level shall strengthen their leadership over informatization, incorporate informatization development into the national economic and social development plan, establish and improve the leadership coordination mechanism for informatization, take corresponding measures to promote the development of modern information technology and technological innovation, encourage the cultivation and introduction of informatization talents, and carry out information knowledge publicity, popularization and education to promote informatization development.

The people's governments at or above the county level shall arrange special funds for informatization, and increase them appropriately according to the financial situation. Fifth people's governments at or above the county level shall be responsible for the guidance, coordination, management and supervision of informatization within their respective administrative areas.

Other departments of the people's governments at or above the county level shall do a good job in promoting informatization within their respective responsibilities. Chapter II Informatization Development Planning Article 6 The competent department of informatization of the provincial people's government shall, jointly with relevant departments, formulate the informatization development plan of the whole province according to the national informatization development plan and the provincial national economic and social development plan, and implement it after being submitted to the provincial people's government for approval.

The competent department of informatization of the people's government of a city or county (city, district) divided into districts shall, jointly with relevant departments, formulate the informatization development plan of this administrative region according to the province's informatization development plan and the national economic and social development plan of this administrative region, and report it to the people's government at the same level for approval before implementation. Seventh provincial communication management agencies responsible for the preparation of the province's communication network construction planning, into the province's information development planning.

The administrative department of radio and television shall be responsible for compiling the construction plan of radio and television transmission network within its administrative area, and incorporate it into the information development plan at the corresponding level.

Other relevant departments shall be responsible for the preparation of their own informatization development plans, which shall be implemented after being audited by the competent informatization department of the people's government at the corresponding level. Article 8 If it is really necessary to change the informatization development plan due to economic and social development, it shall be approved by the original approving authority. Article 9 The people's governments at or above the county level shall timely announce the information development plan and its implementation, and accept social supervision. Chapter III Promotion of Information Industry Article 10 The people's governments at or above the county level shall, according to the needs of information development, formulate relevant policies and measures, regularly publish the key technologies and product guides of the information industry to the society, and guide the development of the information industry. Eleventh people's governments at or above the county level shall gradually establish and improve the information industry investment mechanism, cultivate and develop the information technology transfer and intellectual property trading market, and encourage domestic and foreign enterprises, other economic organizations and individuals to invest in the information industry. Twelfth people's governments at or above the county level shall encourage and guide enterprises to increase investment in information technology development, and give key support to information technology and information products with independent intellectual property rights. Thirteenth engaged in the design, manufacture and software development of electronic information products, should be organized in accordance with the relevant provisions of the "People's Republic of China (PRC) Standardization Law" production and development.

In designing and manufacturing electronic information products, materials, technologies and processes with high resource utilization rate, easy recycling and environmental friendliness should be adopted, and the use of toxic and harmful substances or elements in electronic information products should be strictly controlled. Article 14 Those who are engaged in electronic information product manufacturing, software development and information services shall enjoy relevant preferential policies in terms of discount on loans, land use and government procurement in accordance with relevant national and provincial regulations.

By the provincial people's government department in charge of information technology that, in line with the information industry development planning of software development enterprises and information service enterprises and their products can enjoy the prescribed tax relief. Chapter IV Construction of Information Engineering Article 15 The information engineering mentioned in these Regulations refers to the general term of information network construction, information application system construction, information resource development, electronic information technology application, information infrastructure construction and other projects. Sixteenth government investment in information engineering projects, the investment department in charge of examination and approval in accordance with the procedures, should seek the opinions of the competent department of information technology. The competent department of informatization shall review the requirements and benefits, planning and layout, technical standards, network and information security, information resources and other related contents of information engineering projects, and issue review opinions. Seventeenth units engaged in the design, development, construction and supervision of information engineering shall obtain corresponding qualification certificates in accordance with the provisions of the state, and undertake information engineering within the scope permitted by their qualification grades.

It is forbidden to undertake information engineering without obtaining the qualification certificate and beyond the scope permitted by the qualification certificate level. Eighteenth information engineering projects to implement the project legal person responsibility system, bidding system and supervision system. Nineteenth provincial information departments shall regularly publish to the public the catalogue of electronic information products and software products with independent intellectual property rights.

People's governments at or above the county level shall give priority to the procurement of electronic information products and software products with independent intellectual property rights in the procurement activities of information engineering construction.

Encourage the public to give priority to electronic information products and software products with independent intellectual property rights in information engineering construction procurement activities.
