In addition to providing intermediary services according to law, other administrative examination and approval items may not require pre-intermediary services and provide relevant intermediary service materials in any form.
Existing or cancelled administrative examination and approval items shall not be turned into intermediary services. Sixth provincial price departments are responsible for formulating the charging standards for intermediary services set by the provincial government, establishing the catalogue of intermediary services set by the government, and supervising and inspecting the intermediary services. The list shall specify intermediary services, examination and approval departments, charging items, charging standards and charging basis, etc. Article 7 The competent department of intermediary service industry shall formulate and improve the norms and standards of intermediary service, guide and supervise the intermediary service institutions in this industry to establish service commitments, time-limited completion, practice publicity, one-time notification, practice records and other systems, refine service items, optimize service processes, improve service quality, and standardize the practice behavior of intermediary service institutions and practitioners.
The competent department of intermediary service industry shall, jointly with relevant departments, regularly organize random checks on the implementation of intermediary service norms and standards by intermediary service institutions when providing intermediary services. Article 8 The provincial administrative department for industry and commerce is responsible for organizing relevant departments to establish the credit information database of intermediary service institutions in the province, collecting and publishing the credit information of intermediary service institutions in various industries in a timely manner, and publishing to the public the credit information that should be publicized according to law, such as registration, licensing, filing and administrative punishment of intermediary institutions.
The administrative department for industry and commerce shall, according to the credit information database of intermediary service institutions, establish and improve the management system such as annual report, random inspection of enterprise publicity information, abnormal business list and list of serious illegal and untrustworthy enterprises in accordance with relevant regulations.
The competent department of intermediary service industry and relevant departments shall establish a disciplinary elimination mechanism for intermediary service institutions, improve the credit system and evaluation mechanism, and provide intermediary services not in accordance with the norms and standards of intermediary services. The competent department of intermediary service industry shall, depending on the circumstances, include them in the management list of untrustworthy intermediary service institutions, and the relevant credit status and evaluation results shall be regularly publicized to the public. Article 9 The administrative examination and approval department shall publish the name, establishment basis and basic requirements of administrative examination and approval intermediary services in the administrative examination and approval acceptance office and the government website of the department. Article 10 Applicants have the right to choose intermediary service institutions independently. No organization or individual may abuse his power to restrict the applicant from accepting or accepting the services provided by the intermediary service institutions designated by him in disguise, and may not set exclusive conditions that cause the applicant to lose the legal choice of intermediary service institutions with similar service fields and the same qualifications. Eleventh technical services entrusted by the administrative examination and approval department in the process of administrative examination and approval shall be carried out through competition, and the service fee shall be paid by the examination and approval department.
Unless otherwise provided by laws and regulations, the applicant shall not bear the expenses of the expert review activities organized by the administrative examination and approval department according to law. If it is really necessary to issue an assessment report separately for the project submitted to the state for examination and approval, the relevant departments and the management agencies that organize the assessment shall coordinate the intermediary service agencies that undertake the regional assessment to issue the assessment report and issue relevant examination and approval documents. Fourteenth administrative examination and approval departments shall directly accept the opinions of intermediary services provided by intermediary service institutions according to law.
Where laws and administrative regulations stipulate that the administrative examination and approval department shall review the opinions of intermediary services, the administrative examination and approval department shall review them according to law. The expenses required for the audit shall be borne by the administrative examination and approval department. If the administrative examination and approval department does not adopt the opinions of intermediary services, it shall explain in writing the reasons for not adopting the opinions to the applicant for administrative examination and approval and the intermediary service institutions.
