What procedures and materials are needed for marriage registration?

The current marriage registration process can be roughly divided into three links: application, examination and registration.

(1) application

Those who meet the requirements for applying for marriage registration shall apply for marriage registration at the marriage registration office where one party is located with their registration photos, relevant certificates and supporting materials, and both parties shall fill in the application documents for marriage registration on the spot.

Different people have different requirements on the documents and supporting materials for applying for marriage registration. For example, when applying for marriage registration in China, China citizens need to hold their own identity certificate, household registration certificate, marriage examination certificate, proof of no spouse, and a signed statement that they have no direct blood relationship with each other and collateral blood relationship within three generations. If it is a divorce, you also need to bring divorce papers.

Foreigners (including foreigners residing or temporarily residing in China, overseas Chinese and foreigners residing in China) applying for marriage in China must hold their valid passports or other identification certificates, nationality certificates, Alien Residence Permit issued by public security organs or valid temporary residence permits in China, and certificates that can effectively prove their marital status.

(2) Review

The marriage registration office will examine the application of the parties to find out whether the application for marriage is correct. If the application materials submitted are unclear, the marriage registration authority will ask the parties concerned and ask them to provide corresponding proof materials when necessary.

(3) Registration (Licensing)

The marriage registration office will register eligible couples and then issue marriage certificates; For those who want to remarry after divorce, the marriage registration office will cancel their divorce certificate; If necessary, a written statement will be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not registering.

What procedures and documents do you need for divorce?

The process of divorce registration is roughly as follows:

(1) application

If a husband and wife voluntarily divorce in the Mainland, they shall conclude a written divorce agreement, apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

1, marriage certificate of both men and women;

2. Valid and compliant identification documents, such as household registration book, ID card, pass or passport;

3. An application for divorce registration filled in on the spot.

(2) Accept

The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After the divorce application is found to be correct in the first instance, the parties concerned will receive the Receipt of Accepting the Application for Divorce Registration. If the application conditions for divorce registration are not met, the divorce shall not be accepted, and if necessary, the notice of rejection of divorce registration application shall be issued at the request of the parties concerned.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, any party unwilling to divorce may go to the marriage registration office that accepts the application for divorce registration with his valid identity certificate and the Receipt for Accepting the Application for Divorce Registration (if it is lost, a written explanation is required), withdraw the application for divorce registration, and fill out the Application for Withdrawal of Divorce Registration as required. After verifying the information, the marriage registration authority shall issue the Confirmation of Divorce Registration to the parties concerned, and the application for divorce registration, the application for divorce registration and the Confirmation of Divorce Registration (stub) shall be filed together. Within 30 days after the expiration of the cooling-off period for divorce, if both husband and wife who request a divorce fail to apply for a divorce certificate to the marriage registration authority, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period expires is a holiday, the first day after the holiday will be the date of expiration of the cooling-off period), both parties shall apply to the marriage registration authority for the issuance of divorce certificates together with the documents and materials specified in the Marriage Registration Standard, such as photos, marriage certificates, identity cards or passports, divorce agreements, etc. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. For those who do not meet the conditions for divorce registration, divorce registration procedures are not provided. When necessary, the marriage registration authority may, at the request of the parties concerned, issue a notice not to register for divorce.

(5) Registration (certification)

The marriage registration authority shall, in accordance with the relevant provisions, register the parties concerned and issue a divorce certificate.
