First, the prosecution shall submit a complaint to the people's court, and submit a copy according to the number of defendants.
If it is really difficult to write a complaint, it can be made orally, which will be recorded by the people's court and the other party will be informed.
The complaint shall contain the following items:
(1) The name, sex, age, nationality, occupation, work unit, domicile and contact information of the plaintiff, the name and domicile of the legal person or other organization, and the name, position and contact information of the legal representative or principal responsible person;
(2) Information such as the name, gender, work unit and domicile of the defendant, and information such as the name and domicile of the legal person or other organization;
(3) the request and the facts and reasons on which it is based;
(4) Evidence and its sources, names and residences of witnesses.
Two, the creditor requests the debtor to pay money, securities, meet the following conditions, can apply to the grassroots people's court with jurisdiction for payment order:
(1) There is no other debt dispute between the creditor and the debtor;
(2) Payment orders can be served on the debtor.
The application shall specify the amount of money or securities required and the facts and evidence on which it is based.
Three, the parties applying for arbitration shall meet the following conditions:
(1) There is an arbitration agreement;
(2) There are specific arbitration claims, facts and reasons;
(3) It falls within the scope of acceptance by the Arbitration Commission.
When applying for arbitration, the parties shall submit an arbitration agreement, an arbitration application and a copy thereof to the Arbitration Commission.
The application for arbitration shall contain the following items:
