Provisions on Supervision of Civil Airport Construction (revised 1997)

Chapter I General Provisions Article 1 In order to strengthen the management of civil airport engineering construction, ensure the engineering quality, improve the construction level, and give full play to the investment benefit, these provisions are formulated in accordance with the Regulations on Construction Supervision of the competent construction department of the State Council and in combination with the actual construction of civil airport engineering. Article 2 These Provisions shall apply to the supervision of the main project construction of newly built, rebuilt and expanded civil airports (including the civil part of the airport for military and civilian use, the same below).

The above main projects include: flight area project, route and airport navigation control, communication and navigation, meteorological project and visual navigation aid system project. Article 3 The supervision of civil airport engineering construction refers to the supervision unit entrusted by the owner to supervise and manage the civil airport engineering construction.

The supervision unit shall supervise and manage the civil airport construction according to the national engineering construction policies and regulations, the approved engineering design documents, the signed construction supervision contracts and engineering contracting contracts. Article 4 The General Administration of Civil Aviation of China (hereinafter referred to as "CAAC") is responsible for the supervision and administration of civil airport construction throughout the country. The Capital Construction Airport Management Department of CAAC is responsible for the examination and approval of civil airport engineering construction supervision units and the supervision and management of the implementation of supervision business. Chapter II Supervision Units Article 5 Only units with legal person qualification, supervision qualification certificate, qualification for civil airport construction supervision and qualification recognized by the Civil Aviation Administration can undertake the supervision business of airport main project construction.

The qualification mentioned in the preceding paragraph refers to the conditions that a unit undertaking engineering construction supervision should have in terms of personnel quality, amount of funds, professional skills, management level and supervision performance. Article 6 An engineering design unit with the qualification of civil airport engineering construction supervision may concurrently engage in airport engineering construction supervision business with the approval of the Civil Aviation Administration.

The supervision institution affiliated to the engineering design unit shall not supervise the construction of the civil airport project designed by the unit. Under special circumstances, if it is really necessary to undertake supervision business, it must be reported to the Civil Aviation Administration for approval, but the personnel directly responsible for the project design of this unit shall not participate in supervision. Seventh supervision units engaged in civil airport construction supervision staff shall not be staff of state organs, nor shall they work part-time in construction, equipment manufacturing and material supply units; Supervision units and their staff shall not be in partnership with construction, equipment manufacturing and material supply units or have economic interests. Article 8 Chinese and foreign supervision units that jointly supervise the construction of the main project of civil airports shall meet the following requirements in addition to the general requirements of these Provisions:

(1) Cooperation matters shall be reported by the Chinese supervision unit to the Civil Aviation Administration for approval;

(2) Foreign supervision units must pass the qualification examination of CAAC;

(three) the two sides signed a written cooperation contract according to law, and reported to the Civil Aviation Administration for approval. Ninth supervision units engaged in civil airport engineering construction supervision activities, should abide by the "law-abiding, honest, fair and scientific" basic professional ethics. Chapter III Scope of Supervision Article 10 Civil airport engineering construction supervision units are divided into Grade A, Grade B and Grade C according to their qualifications, and the scope of supervision undertaken by each level is as follows:

(1) A Grade-A supervision unit can undertake the supervision of the construction of national civil airports, and the airport level is not limited;

(two) Class B supervision units can undertake the construction supervision of airport projects at or below the 4D flight zone level;

(3) Class C supervision units can undertake the construction supervision of airport projects with the flight zone level of 4C or below.

Those who undertake the supervision of civil airport construction beyond the scope of supervision must report to the Civil Aviation Administration for approval. Chapter IV Contents of Supervision Article 11 The supervision of civil airport construction includes the following contents:

(1) Pre-construction stage:

1, investment decision;

2. Project evaluation;

3. Feasibility study of the project.

(2) Design stage:

1, organize design bidding;

2. Select the design scheme and design unit;

3. Assist the owner to sign the design contract and supervise the implementation of the contract;

4. Check the design estimate (pre-calculation).

(3) Construction preparation stage:

1, to assist the owner in preparing the tender documents;

2, check the construction drawing design and budget (budget);

3. Organize bidding activities;

4. Assist the owner to sign the contract with the winning bidder.

(4) Construction stage:

1, to assist the owner and contractor in preparing the commencement report;

2. Confirm the subcontractor selected by the contractor;

3, examination and approval of construction organization design;

4. Issue a commencement order;

5. Review the contractor's materials and prepare the purchase list;

6. Check the specifications and quality of materials, components and equipment used in the project;

7, check the construction technical measures and safety protection facilities;

8, presided over the negotiation of engineering design change and engineering negotiation (beyond the entrusted authority of the change and negotiation, must obtain the consent of the owner);

9. Supervise the performance of the contract, mediate disputes between the two parties and handle claims;

10, check the project progress and construction quality, accept partial projects, and sign the project payment voucher;

12, participating in the project completion acceptance;

13, check the project settlement.

(5) Engineering warranty stage:

Within the specified warranty period, be responsible for checking the quality of the project, identifying the responsibility for quality problems, and urging the responsible units to repair.
