(a) the tendering agency violates the provisions of article twelfth of these measures;
(two) the survey unit violates the provisions of Article thirteenth and Article fourteenth of these measures;
(three) the design unit violates the provisions of article fourteenth of these measures;
(four) the rental unit violates the provisions of article fifteenth of these measures;
(five) the detection unit violates the provisions of article sixteenth of these measures.
Forty-first construction units in violation of the provisions of these measures, one of the following acts, a fine of 1000 yuan to 30000 yuan:
(a) the person in charge of the construction unit or the person in charge of the project fails to carry out pre-shift inspection or in-class production in accordance with the regulations;
(two) full-time safety production management personnel are not on duty without justifiable reasons;
(three) the construction unit has not established a separate account to use the safety production expenses;
(four) in violation of the provisions of article twenty-first;
(five) did not fulfill the obligation to inform in accordance with the provisions of article twenty-second;
(six) the hidden dangers of safety accidents are not rectified within the specified time, or the rectification does not meet the requirements.
Forty-second engineering supervision units in violation of the provisions of these measures, one of the following acts, a fine of 1000 yuan to 30000 yuan:
(a) The project supervision plan does not include special provisions on safety supervision;
(two) the detailed rules for the implementation of safety supervision have not been compiled or implemented for the sub-projects with greater risks;
(three) did not fulfill the obligations stipulated in article twenty-seventh of these measures;
(four) found that the hidden dangers of safety accidents did not promptly urge the construction unit to rectify or stop construction.
Article 43 If the project leader of the construction unit fails to fulfill the responsibility for production safety stipulated in Article 18 of these Measures, he shall be fined between 5,000 yuan and 20,000 yuan.
Full-time safety production management personnel who fail to perform the safety production duties stipulated in Article 18 of these Measures shall be fined between 65,438 yuan and 5,000 yuan.
Forty-fourth engineering supervision personnel in violation of the provisions of these measures, one of the following acts, more than 2000 yuan 10000 yuan fine:
(1) Failing to conduct on-site supervision of subprojects with high risks in accordance with regulations, or failing to conduct on-site supervision of subprojects with high risks exceeding a certain scale;
(2) signing false technical documents.
Forty-fifth construction workers in violation of the provisions of article twenty-fourth (two), (three) and (four) of these measures, one of the following acts, the construction unit at 200 yuan more than 0000 yuan fine:
(1) Failing to use safety protection articles correctly;
(two) there is no protective facilities for the entrance to the border;
(three) lifting objects without command;
(four) the use of damaged power protection facilities, illegal use of electrical equipment;
(five) other illegal acts on the construction site.
Forty-sixth administrative organs safety supervision personnel have one of the following acts, resulting in serious consequences, shall be given administrative sanctions according to law; Suspected of a crime, transferred to judicial organs for criminal responsibility according to law:
(a) failing to implement supervision according to the supervision work plan;
(two) found that illegal acts are not handled in accordance with the provisions;
(three) the complaint or report that should be accepted is not accepted, or it is not handled in accordance with the provisions after acceptance;
(4) soliciting or accepting other people's property or seeking other benefits.
In any of the following circumstances, safety supervisors shall not bear administrative responsibility:
(a) production safety accidents caused by force majeure;
(2) Failing to go through the construction procedures such as the construction permit, and causing a safety accident in the construction project;
(3) Being ordered and urged to rectify the main body responsible for the construction project, and the main body responsible for the construction project refuses to rectify or a production safety accident occurs within the rectification period;
(four) due to the main responsibility of the construction project to take concealment, deception and other acts, resulting in the failure to correctly fulfill the regulatory responsibilities;
(five) due to the suspension or termination of the construction project, a safety accident occurred after the safety supervision was stopped;
(six) the safety supervisor has performed his duties in accordance with the supervision work plan.
