Regulations of Guizhou Province on Food Safety

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Food Safety Law of People's Republic of China (PRC) (hereinafter referred to as the Food Safety Law), the Regulations for the Implementation of the Food Safety Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this province. Article 2 Those engaged in the production and business activities of food, food additives and food-related products and food safety supervision and management activities within the administrative region of this province shall abide by these regulations.

These Regulations shall be observed in the formulation of local standards for the quality and safety of edible agricultural products and the release of information related to the safety of edible agricultural products in this province. Article 3 Food producers and operators shall engage in production and operation in accordance with laws, regulations and food safety standards, establish and improve food safety management systems, be responsible for food safety in their production and operation, accept social supervision and assume social responsibilities. Article 4 The people's governments at or above the county level shall be responsible for, lead, organize and coordinate the food safety supervision and management within their respective administrative areas, and perform the following duties:

(a) the food safety work into the national economic and social development plan, and the food safety sampling funds, risk monitoring funds and supervision and management funds included in the fiscal budget at the corresponding level;

(two) to establish and improve the supervision and management mechanism of the whole process of food safety, which combines administrative supervision, self-discipline of producers and operators and social supervision;

(three) unified leadership and command of food safety emergencies;

(four) improve the implementation of food safety supervision and management responsibility system;

(five) the establishment of food safety information sharing mechanism;

(six) to strengthen the capacity building of food safety supervision and management, and establish a team of personnel suitable for food safety supervision and management;

(seven) the food safety supervision and management work into the government's annual work target assessment.

Township (town) people's governments and neighborhood offices (communities) shall do a good job in food safety supervision and management in accordance with the provisions of these Regulations and the people's governments at higher levels, and employ food safety coordinators to focus on assisting in the social supervision of food safety in rural areas, rural primary and secondary schools (kindergartens), urban communities and construction sites.

The village (neighborhood) committee shall assist the local people's government in food safety supervision and management, and report the food safety situation in a timely manner; The food safety supervision and administration department shall give guidance and support. Article 5 People's governments at or above the county level shall set up food safety committees to undertake the following duties:

(1) To analyze the food safety situation in this region, and study, deploy, coordinate and guide the food safety work in this region;

(two) put forward policies and measures for food safety supervision and management;

(three) to establish and improve the coordination mechanism and comprehensive supervision and management system;

(four) supervision and inspection of the implementation of food safety supervision and management responsibilities;

(five) other duties stipulated by the people's government at the same level.

The Food Safety Committee has an office, which is a permanent institution and is responsible for the daily work of the Committee. Article 6 The administrative department of health shall be responsible for food safety risk monitoring, formulating local food safety standards, publishing food safety information, organizing the investigation and handling of major food safety accidents, and supervising and managing centralized disinfection of tableware.

The quality supervision department is responsible for the supervision and management of food production activities.

The administrative department for industry and commerce is responsible for the supervision and management of food circulation activities.

The food and drug supervision and management department shall undertake the supervision and management responsibilities of catering service activities.

Agriculture, urban management, entry-exit inspection and quarantine, commerce, food, salt industry, housing and urban and rural construction, transportation, public security, education, environmental protection, tourism and other departments shall do a good job in food safety supervision and management within their respective functions and duties.

If the laws and regulations do not stipulate the responsibilities of food safety supervision and management, it shall be determined by the people's governments at or above the county level and announced to the public. Article 7 The food industry association shall assist the food safety supervision and administration department to standardize and strengthen the food safety work in the industry, establish and improve various self-discipline management systems, strengthen self-discipline in the industry, publicize and popularize food safety knowledge, promote the construction of industry integrity, and guide food producers and operators to produce and operate according to law. Eighth people's governments at or above the county level shall establish and improve the communication mechanism of news media. The news media should carry out public welfare publicity on food safety laws and regulations, food safety standards and knowledge, report food safety information in a timely, comprehensive and accurate manner, and conduct public opinion supervision on violations of food safety laws and regulations. Article 9 People's governments at all levels shall organize publicity and education on food safety laws and regulations, food safety standards and knowledge, raise the awareness of food safety in the whole society and enhance citizens' self-protection ability.

Encourage consumer organizations, industry associations and other social groups and village (neighborhood) committees to carry out various forms of food safety publicity and popularization, and do a good job in food safety supervision.

Schools should strengthen the publicity and education of students' food safety knowledge and improve students' awareness of food safety. Tenth people's governments at or above the county level shall establish and improve the reward system for reporting food safety, set up special reward funds, and encourage reporting violations of food safety laws and regulations in food production and operation; Protect the legitimate rights and interests of informants, and reward those who provide clues about illegal acts and verify them.
