Provisions of Qingdao Municipality on Minimum Living Security for Urban Residents
Chapter I General Provisions
Article 1 In order to standardize the work of minimum living guarantee for urban residents in our city (hereinafter referred to as urban minimum living guarantee) and improve the quality of urban minimum living guarantee, these Provisions are formulated according to the Regulations on Minimum Living Guarantee for Urban Residents in the State Council and the Measures for the Implementation of the Regulations on Minimum Living Guarantee for Urban Residents in Shandong Province, combined with the actual situation of this Municipality.
Article 2 Non-agricultural registered permanent residence residents of this Municipality and family members living together whose monthly per capita income is lower than the minimum living standard of this Municipality may apply for urban minimum living assistance.
Article 3 The civil affairs department shall, according to the local expenses for clothing, food, housing and basic medical care needed to maintain the basic life of urban residents, and give due consideration to the expenses for water, electricity, coal (including gas) and compulsory education for minors, formulate the urban minimum living standard, which shall be reported to the government for approval according to procedures and announced to the public by the civil affairs department.
The urban minimum living standard should be adjusted according to the local economic and social development.
Article 4 Urban subsistence allowances shall be mainly provided by government differential assistance, supplemented by classified assistance, temporary assistance, medical assistance, housing assistance, children's education aid, policy support and other supporting measures.
Article 5 Urban subsistence allowances shall follow the principles of guaranteeing the basic livelihood of urban residents, encouraging self-help through labor, people-oriented, standardized operation, fairness and openness.
Chapter II Responsibilities of Management Department
Article 6 Urban subsistence allowances shall be managed at four levels: city, district (city), street and community.
The main responsibilities of the seventh city urban minimum living security management department are:
(a) responsible for the overall coordination of the city's urban minimum living security work, the development of urban minimum living security policy;
(two) to guide, supervise and inspect the implementation, distribution and use of the city's urban minimum living security funds;
(three) to accept the consultation and complaints of the city's urban subsistence allowances, and to be responsible for the administrative reconsideration of the city's urban subsistence allowances;
(four) responsible for the city's urban minimum population census statistics, dynamic analysis, security standards, subsidies and other work.
The main responsibilities of the eighth district (city) urban minimum living security management department are:
(a) responsible for the evaluation and approval of the special application for urban subsistence allowances;
(two) the preparation of the local (city) annual budget, responsible for the distribution and use of local (city) urban subsistence allowances;
(three) to guide, supervise and inspect the implementation of the urban minimum living security system in the whole region (city), and summarize and popularize advanced experience;
(four) to organize the professional training of the local (city) urban minimum living security staff;
(five) to accept the consultations and complaints of the whole region (city) urban subsistence allowances, and to be responsible for the administrative reconsideration of the whole region (city) urban subsistence allowances;
(six) responsible for the local (city) urban minimum living security statistics summary, file management and information computer network management.
The main responsibilities of the ninth street city residents management department are:
(a) to be responsible for the examination and review of the qualification of applying for urban subsistence allowances;
(two) responsible for the issuance of urban subsistence allowances;
(three) to guide the community urban subsistence allowances;
(four) to organize urban residents who have the ability to work but are not employed to participate in public welfare activities, and to provide employment services for urban residents who have the ability to work together with employment service agencies;
(five) to provide urban minimum living security policy consulting services, and investigate and deal with illegal acts such as defrauding and impersonating urban minimum living security funds and materials;
(six) the management of urban subsistence allowances files, report the relevant information and data of urban subsistence allowances.
Tenth community neighborhood committees are entrusted by the street, district (city) urban subsistence allowances management department to engage in the daily management and service of urban subsistence allowances. Its main responsibilities are:
(1) Accepting applications from residents and registering the families applying;
(two) the establishment of urban minimum living security assessment team, the organization of urban minimum living security qualification assessment;
(three) according to the evaluation and publicity results, held a community democratic appraisal meeting, put forward preliminary audit opinions and report;
(four) responsible for the publicity of urban residents;
(five) guarantee on behalf of the city residents;
(6) Organizing unemployed urban residents who have the ability to work to participate in public welfare activities;
(seven) responsible for regularly verifying the income of urban residents, and put forward preliminary opinions on adjusting the security benefits;
(eight) quarterly renewal registration;
(nine) the management of urban minimum living security object files in the community.
Chapter III Application, Evaluation and Approval
Eleventh city residents work generally in accordance with the individual application, community assessment, audit, publicity, street audit, district (city) approval procedures.
Community to establish urban subsistence allowances assessment team, responsible for the investigation and verification of the families applying for urban subsistence allowances, introduce the qualification assessment of the families applying for urban subsistence allowances to the community democratic Council, investigate the problems reflected by the masses, and re-evaluate the families that need to be reviewed.
Street to establish a city subsistence allowances evaluation committee, responsible for the community did not pass and I have objections to the city subsistence allowances for re-evaluation.
District (city) to establish a city subsistence allowances evaluation committee, responsible for the evaluation of the streets that are still uncertain, to review the application for city subsistence allowances that need district (city) evaluation, and to urge the city subsistence allowances staff.
Twelfth applications for urban subsistence allowances, by the head of the household in written form to the domicile of the community or street, and provide family members' accounts, income certificates and other necessary materials.
Communities and streets should explain the relevant provisions to the parties who intend to apply for urban subsistence allowances, and publish the publicity of urban residents' minimum living allowances.
Thirteenth communities receive personal application materials, by the community urban minimum living security assessment team on the family's income, living conditions, physical condition of members of the investigation and evaluation and publicity. After investigation, evaluation and publicity, the community will issue and guide the applicant to fill out the "Application Form for Minimum Living Security for Urban Residents". The investigation and evaluation shall be collectively studied by the members of the community urban subsistence allowance evaluation team, and the opinions of investigation and evaluation shall be formed and submitted to the community democratic Council for discussion.
Community Democratic Council to discuss the application for urban subsistence allowances, community residents group leader and the applicant shall attend the meeting as nonvoting delegates.
The general agenda of the community democratic Council to discuss the application for urban subsistence allowances is:
(1) The applicant reads the application form;
(two) the assessment team introduced the assessment;
(three) the members of the board of directors ask the applicant;
(4) the applicant answers the inquiry;
(5) The applicant withdraws his application;
(six) to vote on the investigation and evaluation opinions.
Fourteenth the applicant's qualification for urban minimum living allowance shall be reviewed by the community review team, and the community democratic review meeting shall be held for deliberation. If the democratic appraisal is unanimously adopted, it shall be directly audited by the street and reported to the district (city) urban minimum living security management department for approval.
Fifteenth to apply for the qualification of urban minimum living security by the community democratic Council discussion failed, the applicant insisted on the application, the community neighborhood committee shall report to the street evaluation committee for re-evaluation.
Article 16 If the applicant fails to pass the street assessment and insists on applying, the district (city) urban subsistence allowances assessment committee will make a special assessment, and the district (city) urban subsistence allowances management department will make a decision on examination and approval according to the assessment results.
Seventeenth district (city) urban minimum living security management department shall complete the examination and approval procedures within 30 days from the date of receiving the applicant's application (except for the applicant's incomplete certification materials).
After the applicant submits an application and provides supporting materials, the community shall investigate and publicize the applicant within 3 working days; Hold a community democratic Council meeting to discuss within 7 working days, and report eligible applications to the street; The street should complete the audit within 5 working days, and submit the qualified application to the district (city) urban minimum living security management department for approval; District (city) urban minimum living security management department shall complete the examination and approval within 5 working days.
If the street needs to be audited, it shall not exceed 7 working days; District (city) city minimum living security management department to conduct a special assessment of the time shall not exceed 7 working days.
District (city) urban minimum living security management department to meet the conditions, be approved, by the street or community on behalf of the "urban residents minimum living guarantee Jinling evidence", the next month through the bank to the minimum living guarantee; Do not meet the conditions, shall not be approved, and notify the applicant in writing.
Eighteenth communities should publicize the situation of urban subsistence allowances in accordance with the following provisions:
(a) in the community held before the democratic appraisal meeting of urban subsistence allowances, the application for urban subsistence allowances will be publicized for 3 days;
(two) the situation that has been included in the urban subsistence allowance is publicized once every quarter;
(three) the abolition of urban subsistence allowances, timely publicity.
The publicity content includes the name, number, per capita income and home address of the head of the urban minimum living allowance family.
Chapter IV Determination of Urban Minimum Living Security Object
Nineteenth applicants for urban subsistence allowances must meet the following conditions:
(a) the domicile is not in agricultural registered permanent residence;
(two) the monthly per capita income of family members living together is lower than the local urban minimum living standard.
Article 20 * * * Family members who live together refer to those who have a legal relationship of support, upbringing and maintenance and live together for a long time.
Twenty-first families in any of the following circumstances, can not enjoy the treatment of urban subsistence allowances:
(1) Failing to truthfully declare family income as required;
(2) Failing to receive the security fund on time for two consecutive months;
(three) do not accept the verification of urban subsistence allowances;
(four) no special circumstances did not apply for renewal of registration;
(5) Refusing to introduce employment or skills training to relevant departments twice within 1 year without justifiable reasons;
(6) refusing to participate in public welfare activities without justifiable reasons;
(7) Intentionally giving up or transferring all personal assets;
(eight) other districts (cities) and above urban subsistence management departments can not enjoy the treatment of urban subsistence allowances according to relevant procedures.
Chapter V Determination of Family Income
Article 22 Family income refers to the sum of all monetary income and physical income of family members living together. Monetary income includes wages, bonuses, allowances and subsidies, as well as labor insurance benefits, one-time resettlement fees, economic compensation (including self-employment) or living allowance, retirement pension, basic living expenses for central retirement, unemployment insurance benefits, deposits and interest, securities and dividends, franchise income, rental income, income from accepting gifts and inheritance, alimony, support, income from second occupation and income from self-employment. Income in kind is included in family income at market price.
If the above-mentioned family income of the applicant is unstable, it shall be determined by dividing the average family income in the first three months from the date of application by the number of family members.
Pensions, subsidies, nursing expenses and health care payments for the entitled groups, special contributor bonuses issued by the government, honorary allowances enjoyed by model workers above the district (city) after retirement, nursing expenses for employees injured at work, one-time pensions and funeral expenses enjoyed by those who died at work and their families, nursing expenses for educated youth who returned to the city disabled at work, housing accumulation fund and various social insurance co-ordination fees paid by individuals according to regulations, and government.
Twenty-third employees who have not received wages for more than six months in a row or have not received wages in full (including those who have left the factory, retired in the factory, sick leave, etc.) ), family income is calculated according to actual income. The determination of wage income shall be put forward by the employees of the units below the municipal level (including the municipal level), and shall be determined by the labor and social security department of the district (city) where the enterprise is located after being audited by the trade union and the labor department of the unit. Employees of units above the provincial level (including provincial level) shall be audited by the trade union and labor department of the unit and signed by the main leaders of the unit.
The basic living expenses of retirees in the twenty-fourth center shall be audited by the labor department of the unit where the employees work, signed by the main leaders of the unit, and confirmed by the city, district (city) re-employment service center.
Twenty-fifth insured persons shall be identified by applying for unemployment benefits or employment (living) subsidies.
Twenty-sixth unemployment insurance benefits for the unemployed and pensions for retirees shall be confirmed by my unemployment certificate and pension passbook.
Twenty-seventh engaged in domestic service, cleaning, greening and other informal employment income, according to the reference standards formulated by the district (city) urban minimum living security management department to assess.

Article 31 If it is difficult to determine the per capita income of a family, the applicant shall provide proof of payment of monthly water, electricity, gas and telephone charges for the first four months of his family.
Chapter VI Handling of Special Applications
Article 32 If the household registration is inconsistent with the place of residence, and the applicant has lived in the current place of residence for more than 1 year, the applicant shall provide the household registration information of family members, the housing situation at the place of household registration and the urban subsistence allowance certificate, and apply to the community where he actually lives.
Thirty-third agricultural registered permanent residence children whose applicants are under 16 years of age or over 16 years of age who are still studying in ordinary secondary schools can enjoy the urban minimum living allowance according to regulations.
Thirty-fourth people with severe disabilities who have reached the age of 30 and are unmarried may apply for urban subsistence allowances separately.
Chapter VII Classified Management and Rescue
Thirty-fifth according to the economic income of the main members of the family, the urban low-income families are divided into three categories: A, B and C for management:
(1) A family refers to a family whose main members are elderly people who are widowed or severely disabled, and whose family income has not changed and is in difficulty;
(2) Class B families refer to families whose main members have retired or formally employed, and whose income sources are relatively clear and stable;
(3) Class C families refer to families whose main members have the ability to work at the age of employment but are not employed, and whose family income fluctuates greatly or whose family members are easily changed and obviously unstable.
Thirty-sixth families that have been included in the urban minimum living standard are reviewed once a year, once every six months, and once every quarter.
Article 37 If an applicant's family members have the ability to work within the working age and are not employed, the family members shall first go to the street labor and social security service center or employment agency where the household registration is located for employment registration, and the street offices and community neighborhood committees shall give priority to providing them with employment and training opportunities in conjunction with the street labor and social security service center. Urban minimum living security management department shall apply for urban minimum living security in accordance with the provisions with the job application certificate issued by the street labor security service center or the employment agency.
Thirty-eighth urban residents who have the ability to work but have not yet been employed in the employment age group shall be organized by community neighborhood committees or street offices to participate in public welfare activities with a monthly cumulative of not less than 24 hours. Among them, for some urban residents who lose their ability to work, they can arrange lighter jobs appropriately, and the working hours can be reduced to no less than 12 hours per month as appropriate.
Thirty-ninth C families should apply for renewal of insurance in the community within 10 days after receiving the security fund in the last month of each quarter, and truthfully declare their family income in this quarter.
Fortieth to meet the following conditions, the implementation of classified assistance:
(a) the implementation of temporary relief for families in need who do not enjoy the urban minimum living allowance due to policy reasons and families in need caused by emergencies;
(two) for urban low-income families whose family members are sick, medical assistance is provided by reducing or exempting medical expenses and medical assistance for major diseases;
(three) the implementation of special living allowances for orphans, the disabled and the elderly in urban low-income families;
