The relevant departments of the people's governments at or above the county level shall do a good job in the disclosure of enterprise credit information within the scope of their respective duties.
The competent information department of the people's government at or above the county level is responsible for the guidance, coordination and supervision of enterprise credit information disclosure activities.
The supervisory organs of the people's governments at or above the county level shall supervise and inspect the activities of the administrative departments to disclose enterprise credit information. Chapter II Disclosure Article 6 The administrative departments shall disclose the following enterprise credit information obtained in the course of performing their duties according to law:
(a) the basic registered items and organization code of the enterprise;
(2) The information about the administrative license obtained by the enterprise;
(3) Certification and trademark identification of enterprise products, services and management systems;
(4) Inspection, inspection, quarantine and testing of enterprise product quality;
(five) the annual audit inspection of enterprises and the annual inspection of enterprise social insurance registration certificate;
(6) Social insurance premiums and administrative expenses owed by the enterprise;
(seven) enterprises in arrears, fraud, tax evasion;
(eight) to investigate and deal with illegal employment, wage arrears and other major labor security violations;
(nine) accountability for major quality, production safety and environmental pollution accidents of enterprises;
(10) Effective records of administrative punishment;
(eleven) other enterprise credit information that should be disclosed according to law.
Where laws and regulations provide otherwise for public matters, such provisions shall prevail. Article 7 The administrative department shall disclose the enterprise credit information stipulated in Article 6 of these Regulations through information networks, news media and public affairs columns. Eighth administrative departments should implement dynamic management of enterprise credit information database.
The administrative department shall, within ten working days from the date of the formation or change of information, disclose the credit information of various enterprises as stipulated in Article 6 of these Regulations. The publicity period is as follows:
(1) Article 6 (1) shall be published until three years from the date of termination of the Enterprise;
(2) Items (2) and (3) of Article 6 shall be published until the expiration of the validity period;
(3) The disclosure period of Items (4) to (10) of Article 6 shall generally not exceed three years.
Upon the expiration of the time limit for the disclosure of enterprise credit information, it shall terminate the public release and turn to file preservation.
Where there are other provisions in laws and regulations on the disclosure period of enterprise credit information, those provisions shall prevail. Article 9 When disclosing enterprise credit information, administrative departments shall abide by laws and regulations, and shall not fabricate or tamper with enterprise credit information, nor collect or disclose false information. Article 10 The administrative department shall, in accordance with the Law of People's Republic of China (PRC) on Guarding State Secrets and other laws and regulations and the relevant provisions of the state, timely review the enterprise credit information to be disclosed, and take confidentiality measures to prevent other contents involving state secrets, business secrets, personal privacy and laws and regulations from being disclosed; If the administrative department is not sure whether it can be made public, it shall report to the relevant competent department or the secrecy department at the same level for determination. Eleventh administrative departments of the same enterprise credit information is inconsistent, the relevant administrative departments shall verify and publish within ten working days from the date of discovery.
If the relevant administrative department disputes the verification results, it shall be handled by the information administrative department. Twelfth citizens, legal persons and other organizations think that the enterprise credit information published by the administrative department is wrong, they can apply for objection and provide relevant basis. The relevant administrative departments shall accept the application and verify it within ten working days from the date of accepting the application. If there is an error, it shall be corrected and publicized. If it is verified, it shall be maintained and the applicant for objection shall be informed in writing.
If the administrative organ considers it necessary to stop the disclosure of the information during the acceptance of the objection application, or if the objection applicant applies for stopping the disclosure, the administrative organ may stop the disclosure if it considers its requirements reasonable. Article 13 People's governments listed at the provincial or prefecture level shall take measures to realize the sharing of enterprise credit information resources among administrative departments, and may designate or entrust relevant units or departments to establish an enterprise credit information publishing system according to needs, and be responsible for collecting, integrating and uniformly disclosing enterprise credit information held by administrative departments. The specific provisions shall be formulated by the provincial people's government.
