Article 49 The national science and technology plan may organize expert consultation activities in feasibility demonstration, project evaluation, bidding, evaluation, mid-term inspection and project acceptance. Expert opinions should be used as a reference for scientific and technological management and decision-making.
Article 50 The Special Planning Department of the Ministry of Science and Technology shall determine the conditions and composition of consulting experts according to the characteristics of various national science and technology plans. The basic conditions for consulting experts are:
(1) Having good scientific ethics and professional ethics, and being able to make suggestions objectively, fairly and realistically;
(two) familiar with the consulting project in the field or industry of scientific and technological economic development, understand the characteristics and laws of scientific and technological activities, in this field or industry has a high authority.
The group composition of consulting experts should be representative and complementary. The number, age and knowledge composition should be relatively reasonable. The expert group should be familiar with the development of related fields or industries, master the knowledge of technology, economy, market and industrial policy, and have certain comprehensive analysis and judgment ability.
Article 51 The following persons shall not be selected as consulting experts:
(a) personnel who have an interest in the object of consultation;
(2) Persons who have formally applied for withdrawal in writing in advance by the customer for justifiable reasons;
(3) Persons with bad records in previous consulting activities.
Article 52 When hiring experts, the Special Planning Department of the Ministry of Science and Technology and the project organization and implementation management institution shall explain to the experts the purpose, working principles, responsibilities and rights of consulting experts, and clarify the tasks and requirements of consulting. After the experts agree, they can be hired as consulting experts and formally participate in consulting activities.
Article 53 The Special Planning Department of the Ministry of Science and Technology and the project organization and implementation management institution shall provide consulting experts with materials, information and data related to consulting work, provide necessary working conditions and expenses, introduce and explain the relevant consulting contents and project background, and be responsible for keeping the specific opinions of consulting experts confidential.
Fifty-fourth special planning departments of the Ministry of Science and Technology, project organization and implementation management institutions shall not exert tendentious influence on consulting experts, and shall not intentionally guide the consulting opinions of experts. The opinions of consulting experts shall not be forged or modified. Shall not spread the opinions and suggestions of consulting experts to the consulting object and any unit or individual irrelevant to the planning management decision. The decision-making behavior after consulting experts should be borne by decision makers.
Fiftieth consulting experts in the process of consulting for the project, must abide by the following norms:
(a) should adhere to the principle of seeking truth from facts, independent, objective and fair to provide personal and responsible advice, without interference from any factors affecting fairness, should be in accordance with the requirements of managers to complete the consulting task on time and in quality;
(2) Maintain the intellectual property rights and technical secrets of the client, properly preserve the consulting materials, and return them to the manager as required after the consulting activities, and shall not copy the consulting-related materials or disseminate relevant information to units or individuals other than the manager;
(three) when the consulting matters have an interest relationship with the experts, they must take the initiative to declare to the management personnel and avoid them;
(four) during the consultation, without the permission of the organizer, the consulting experts shall not contact the consulting object and related personnel on the consulting matters. It is even more forbidden to collect the remuneration and expenses of the consulting object in various ways.
Fifty-sixth there are irregularities in the consultation activities, the Department of Special Planning of the Ministry of Science and Technology may, depending on the seriousness of the case, take measures such as recording its credibility, invalid expert opinions, and publicly canceling the qualification of expert consultation; Those who violate the law shall be investigated for legal responsibility by the judicial department according to law.
Article 57 The Special Planning Department of the Ministry of Science and Technology shall record and file the important contents of expert consultation activities, mainly including the consultation tasks, contents, methods, procedures, methods and rules for using the opinions of consulting experts, the list of consulting experts, personal opinions of consulting experts, comprehensive analysis conclusions, institutions and personnel organizing consulting activities and other matters that need special explanation.
Fifty-eighth when necessary, the relevant special planning and comprehensive planning departments of the Ministry of Science and Technology may establish a dynamic database of consulting experts according to actual needs. According to the needs of the consulting task, a number of stable consulting experts are hired to participate in the whole process of project management, so as to enhance the responsibility of consulting experts and improve the quality of consulting work.
