What is the illegal act of revealing state secrets?

Revealing state secrets is a crime of intentionally revealing state secrets, and criminal responsibility should be investigated according to law.

The crime of intentionally revealing state secrets refers to a serious act of state functionaries or non-state functionaries in violation of the law on guarding state secrets, deliberately making people who should not know know state secrets, or deliberately making state secrets beyond the limited contact scope.

Suspected of one of the following circumstances, it shall be placed on file:

1, revealing top secret state secrets above 1;

2, the disclosure of state secrets more than 3 (pieces);

3. More than 4 items (pieces) of state secrets at the secret level are disclosed;

4, in violation of the confidentiality provisions, the computer or computer information system involving state secrets is connected to the Internet, revealing state secrets;

5, leaking state secrets or losing the carrier of state secrets, concealing, not truthfully providing relevant information or not taking remedial measures;

6. Other serious circumstances.

The crime of negligent disclosure of state secrets refers to the serious behavior of state functionaries or non-state functionaries who violate the law on guarding state secrets, negligently disclose state secrets, or lose the carrier of state secrets, so that state secrets are known by people who should not know or beyond the limited contact range.

State functionaries suspected of intentionally revealing state secrets shall be placed on file under any of the following circumstances:

1, revealing top secret or confidential state secrets;

2, revealing more than 3 state secrets;

3. Spreading or spreading state secrets to the public;

4. The disclosure of state secrets causes serious harmful consequences;

5, the use of authority to instigate or force others to disclose state secrets in violation of the provisions of the state secrets law;

6, for the purpose of revealing state secrets for personal gain;

7. Other serious circumstances.

Legal basis: Article 111th of the Criminal Law of People's Republic of China (PRC).

Whoever steals, spies on, buys or illegally provides state secrets or information for overseas institutions, organizations and personnel shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years; If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment; If the circumstances are relatively minor, they shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention, public surveillance or deprivation of political rights.
