(1) Real estate brokerage fees

(2) Real estate consulting service fee

Real estate intermediary service institutions shall, according to the requirements of the clients, provide consulting services on real estate policies, regulations, technology and information, and may charge real estate consulting service fees. Real estate consulting fees are divided into oral consulting fees and written consulting fees according to service forms.

Other acts prohibited by laws and regulations Real estate intermediary service personnel refer to those who are affiliated with intermediary service institutions and engaged in real estate intermediary services, including real estate consulting salesmen, price appraisers (clerks) and real estate brokers. In order to strengthen management and ensure specialization and standardization, at present, China adopts unified examination, professional qualification certification and registration management methods for real estate intermediary service personnel.

(1) Qualification management of real estate consulting practitioners. Personnel engaged in real estate consulting business must be professional and technical personnel with technical secondary school education in real estate and related majors, junior professional titles in real estate consulting business and above, and have obtained examination certificates. The examination methods for real estate consultants shall be formulated by the construction administrative departments of the people's governments of provinces and autonomous regions and the real estate management departments of municipalities directly under the Central Government.

(2) Qualification management of real estate price appraisal practitioners. The state implements the qualification certification system for real estate valuers. Real estate appraisers are divided into real estate appraisers and real estate appraisers.

The real estate appraiser must be a person who has passed the national unified examination and qualification certification, obtained the qualification certificate of real estate appraiser, and obtained the registration certificate of real estate appraiser through registration. Persons who have not obtained the registration certificate of real estate appraisers shall not engage in real estate appraisal business in the name of real estate appraisers. The examination method for real estate appraisers shall be jointly formulated by the administrative department of construction and the competent department of personnel of the State Council.

The real estate appraiser must be a person who has passed the examination and obtained the qualification certificate of real estate appraiser. Personnel who have not obtained the post certificate of real estate appraiser shall not engage in real estate appraisal business. Measures for the examination of real estate appraisers shall be formulated by the construction administrative departments of the people's governments of provinces and autonomous regions and the real estate management departments of municipalities directly under the Central Government.

(3) Qualification management of real estate agents. A real estate agent must be a person who has passed the examination, registered and obtained the qualification certificate of real estate agent. Personnel who have not obtained the qualification certificate of real estate broker shall not engage in real estate brokerage business.

Provisions on Real Estate Intermediary Service Institutions (1) Conditions for the Establishment of Real Estate Intermediary Service Institutions

Real estate intermediary service agencies are the main bodies that undertake real estate intermediary services, including real estate consulting agencies, real estate price evaluation agencies and real estate brokerage agencies. China's "Urban Real Estate Management Law" regulates the establishment of real estate intermediary service institutions, stipulating that real estate intermediary service institutions shall meet the following conditions:

(1) has its own name and organization.

(2) Having a fixed service place.

(3) Having a certain amount of property and funds.

(4) There are enough professionals.

The establishment of a real estate intermediary service institution shall apply to the local administrative department for industry and commerce for registration of establishment and obtain a business license before it can start business. The real estate management department shall inspect the professional conditions of real estate intermediary service institutions once a year, and publish the list of qualified real estate intermediary service institutions at the beginning of each year. Those who fail the inspection shall not engage in real estate intermediary services.

(3) Obligations of real estate intermediary service agencies

Real estate intermediary service institutions must fulfill the following obligations:

① Abide by relevant laws, regulations and policies.

② Abide by the principles of voluntariness, fairness, honesty and credit.

③ Engage in business activities in accordance with the approved business scope.

(4) Charge fees according to the prescribed standards.

⑤ Pay taxes and fees according to law.

⑥ Accept the guidance, supervision and inspection from the competent department of industry and other relevant departments.
