Policy Interpretation of "Measures for the Administration of Bid Evaluation Experts in Tianjin"

In order to strengthen the management of bid evaluation experts in government procurement, standardize the bid evaluation work and improve the quality of bid evaluation, according to the People's Republic of China (PRC) Municipal Government Procurement Law, the Regulations for the Implementation of the People's Republic of China (PRC) Municipal Government Procurement Law, and the Notice of the Ministry of Finance on Printing and Distributing (Caiku [20 16] 198) and other laws, regulations and relevant regulations, combined with the actual situation of this Municipality, the municipal finance department revised the Tianjin Municipality. The relevant contents are now explained as follows:

I. Revision background of the Measures for the Administration of Experts

In 20 16, in order to strengthen the management of government procurement evaluation activities and standardize the evaluation behavior of government procurement evaluation experts (hereinafter referred to as evaluation experts), the Ministry of Finance re-formulated the Measures for the Administration of Government Procurement Evaluation Experts (Caiku [2065 438+06] 198, hereinafter referred to as the "Measures of the Ministry of Finance"), clarifying that the financial departments of provincial people's governments can formulate. On March 29th, 20 17, the Municipal Finance Bureau, in combination with the measures of the Ministry of Finance, formulated the Measures for the Administration of Experts of Tianjin Municipal Government Procurement Review (Cai [2065 438+07] 10, hereinafter referred to as the Measures), which is valid for five years. The current measures have improved the selection, employment, use and withdrawal mechanism of evaluation experts.

In the past five years, the Municipal Finance Bureau has continuously collected bid evaluation experts from the society in accordance with the current Measures, and the number of effective bid evaluation experts has increased substantially, and the scale has been continuously expanded, fully meeting the needs of bid evaluation of government procurement projects in our city. At the same time, with the deepening of the reform of government procurement system and the development and actual needs of the management of bid evaluation experts, the existing methods still need to be further strengthened and refined in the aspects of training and evaluation of bid evaluation experts, selection of bid evaluation majors, responsibilities, rights and obligations, payment of labor remuneration, bad behavior and punishment, and constantly improve the dynamic management level of bid evaluation experts. Therefore, based on the principle of revising according to law, highlighting key points, problem-oriented and strengthening management, the Municipal Finance Bureau sorted out the new situations and problems found in the management of bid evaluation experts in the past five years, and drew lessons from the advanced management experience of Shanghai, Chongqing, Zhejiang and other provinces and cities to draft and revise the Measures for the Management of Experts, which provided institutional guarantee for further strengthening the management of bid evaluation experts in our city.

Two. Revision process of the Measures for the Administration of Experts

The revision of the Measures for the Administration of Experts has gone through many processes, such as drafting, revision, public consultation, revision and fair competition review. During the revision process, comments were sought from the public through the dynamic column of Tianjin government procurement network, which lasted for 7 working days from March/KLOC-0 to March 9, 2022. By the end of the consultation, * * * had received 65,433 items. In response to the feedback opinions and suggestions, we have conducted sufficient research, adopted reasonable opinions and suggestions, and strictly implemented the fair competition review system as required to prevent the problems of excluding and restricting market competition.

Three. The Measures for the Administration of Experts contain specific contents.

The Measures for the Administration of Experts consists of eight chapters and 49 articles, including four annexes, which is three chapters 13 more than the current measures. The main contents are as follows:

Chapter I General Provisions Article 4. Clarify the purpose, basis, scope of application, management principles, basic concepts of bid evaluation experts and bid evaluation, and realize the whole process supervision of the selection, dismissal, extraction, use and evaluation of bid evaluation experts through the construction of random selection system of bid evaluation experts.

Chapter II Generation and Dismissal of Appraisal Experts, Article *** 12. Clarify the selection procedures, basic conditions, application materials, major selection, information change, employment period, rights and obligations, dismissal and non-renewal of the evaluation experts, further sort out the specific conditions and performance of the evaluation experts from warehousing to withdrawal, formulate targeted regulatory measures, and improve the level and ability of dynamic management.

Chapter III Selection and Use of Appraisal Experts. Clear the process of random selection of bid evaluation experts, the basic requirements of self-selection of bid evaluation experts, the handling methods of special circumstances, the confidentiality and announcement requirements of the list of bid evaluation experts, etc. , further refine the steps and time requirements of random sampling, and sort out and formulate relevant solutions and processes in view of possible special circumstances such as difficulty in determining suitable evaluation experts through random methods, insufficient number of on-site evaluation experts, and assistance of original evaluation experts in handling supplier inquiries.

Chapter iv responsibilities of purchasers and procurement agencies. From the perspective of bid evaluation organizers, this paper comprehensively combs the work of purchasers and procurement agencies in organizing bid evaluation, and defines the establishment of bid evaluation committee, site preparation for bid evaluation, matters needing attention, responsibilities and prohibited behaviors in bid evaluation, evaluation by bid evaluation experts and other related requirements.

Chapter v functions of the review committee and its members, article 7. From the perspective of bid evaluation participants, comprehensively sort out the work of bid evaluation experts and buyers' representatives as members of the bid evaluation committee and the bid evaluation committee composed of them, and clarify the relevant requirements such as avoidance situation, composition of the bid evaluation committee, responsibilities and prohibited behaviors of the bid evaluation committee, emergency experts, handling of disputes and other special circumstances, and evaluation of buyers' representatives and procurement agencies.

Chapter VI Responsibilities of the Financial Department Article 4. From the perspective of evaluation experts and supervisors, comprehensively sort out the work of the financial departments at the municipal and district levels in performing their supervisory duties, and clarify the relevant requirements such as training and assessment, formulating labor remuneration standards, analyzing and applying performance evaluation results, and implementing hierarchical management.

Chapter VII Supervision and Management of Appraisal Experts. The penalties for illegal acts of bid evaluation experts, purchasers, procurement agencies and financial departments in the course of performing their duties were mainly clarified, and 14 cases in which bid evaluation experts were included in bad behavior records and 10 cases in which they were suspended from random sampling were mainly sorted out, so as to continuously strengthen the supervision and management of bid evaluation experts and bid evaluation work.

Chapter VIII Supplementary Provisions Article 3. It is clear that special personnel shall refer to the implementation, and if there are other provisions of the state, it shall be implemented from the date of its provisions and implementation.

Four. Main features and changes of the Measures for the Administration of Experts

First, further strengthen the warehousing management of review experts. Mainly including according to the needs of the evaluation expert database and the government procurement evaluation work, the existing applicants will apply to the Municipal Finance Bureau for registration at any time to carry out the selection and appointment of evaluation experts in batches; The working mechanism of training, assessment and publicity before warehousing has been added; Added two materials: the explanation of the performance of duties issued by my unit and the certificate of no criminal record issued by the public security department, and became an evaluation expert.

The second is to further strengthen the dynamic management of evaluation experts. Change the current "tenure system" of evaluation experts to "tenure system" that is found to be dismissed or illegal, and change the employment period of evaluation experts to no more than 3 years. After the expiration of the validity period, it is necessary to renew and provide or update relevant information again; At the same time, the evaluation experts are required to participate in the training and assessment organized by the Municipal Finance Bureau during the employment period. Those who do not participate in the training will not be re-employed, and those who fail the training assessment will be dismissed; It is clear that the relevant information of bid evaluation experts should be updated within five working days after the change. If it is not updated on time, it will be suspended for a certain time.

The third is to further improve the exit mechanism of evaluation experts. Increased the rights and obligations of bid evaluation experts, familiar with the use of computer bid evaluation, master the system account operation and other related requirements; It is clear that there are 7 kinds of non-renewal of employment and 5 kinds of dismissal of evaluation experts, which are 8 kinds more detailed than the withdrawal and dismissal of experts in the Measures for the Administration of Experts of the Ministry of Finance. It is clear that the dismissed bid evaluation experts will be published by the Municipal Finance Bureau on the website of Tianjin municipal government procurement.

The fourth is to further refine the selection and use of evaluation experts. The random sampling procedure is divided into four steps: demand statement, extraction time, extraction process and list decryption, which effectively improves the openness, transparency and fairness of the random sampling system. For procurement projects with self-selected evaluation experts, written self-selected opinions shall be issued and filed together with the procurement documents, and the main contents of self-selected opinions, seal requirements and the management responsibility of the competent budgetary unit for such projects shall be clarified.

The fifth is to improve the handling of emergencies. First, China put forward the concept of emergency experts, which is mainly used to deal with the emergency situation that the number of experts on the review site does not meet the requirements due to the absence and avoidance of experts, and needs to be supplemented in time. The evaluation experts can voluntarily choose whether to become emergency experts according to their own reality. At the same time, considering the particularity of emergency supplementary pumping projects, higher standards and requirements are put forward for emergency experts, such as not refusing emergency invitations many times, not taking time off after agreeing to participate in emergency supplementary pumping projects, and not being late or not participating in the review.

The sixth is to further strengthen the supervision and management of evaluation experts. It mainly includes: 14 cases in which bid evaluation experts are listed in the record of bad behavior, 7 cases more than the current method, which is further refined and improved; It is more suitable for the actual needs of supervision and management of bid evaluation experts to cancel the situation of reducing sampling probability in the current method and increase the situation of 10 suspending random sampling for 6 months to 12 months.

The seventh is to further improve the labor remuneration standard of the evaluation experts in our city. The labor remuneration standard of the evaluation experts in our city shall be formulated separately as an annex to the Measures, * * * 1 1. The main changes are as follows: the concept of experts from other provinces and cities and the requirements for reimbursement of actual expenses such as transportation and accommodation between cities are clarified; Clarify the subsidy standards and payment requirements for local transportation expenses; Clarify the term and method of payment of labor remuneration and the issue of withholding and paying taxes.
