The West Lake Court heard the dispute. During the trial, the two sides argued fiercely. Sister Wang of Wu Shuo had unjust enrichment, but she insisted that Wu gave her the money.
Wu's agent said that during the provision of domestic service, Sister Wang talked about her financial difficulties, hoped that Wu could help and promised to marry Wu. Wu sympathized with his experience and looked forward to marrying him, so he borrowed money from relatives to help Sister Wang. However, one night in March, Wu was sent to the hospital for emergency treatment because of illness, but Sister Wang took the opportunity to slip away the next morning. Wu believes that Sister Wang took advantage of people's crisis to gain their trust by fraudulent means and expected to defraud money, which is unjust enrichment and should be returned in full and compensated for economic losses.
Sister Wang is another way of saying it. Sister Wang said that in addition to taking care of Wu's daily life, she also helped Wu handle some affairs. Because she did a good job, she won Wu's trust. In their daily chat, Wu learned that she was in financial difficulties, and there was still more than 89,000 yuan for the house purchase, expressing her willingness to pay the money for her.
After Wu was rescued and discharged from hospital in March, Wu and his lawyer asked Sister Wang to either marry Wu or write an iou, otherwise they could only meet in court. Sister Wang thinks that the money should be a gift, and she doesn't agree to get married or write an iou.
The West Lake Court found through trial that Wu transferred 89,000 yuan to Sister Wang from June 2065,438 to June 2007/kloc-0. After receiving the money, Sister Wang did give more than 70,000 yuan to a real estate company in Hangzhou the next day.
The court held that Wu advocated that Sister Wang cheated on the premise of marriage, but did not submit evidence to prove it, and Sister Wang refused to recognize it. Wu only provided bank vouchers to prove the fact that she paid 89,000 yuan to Sister Wang, and did not further prove that Sister Wang had no legal basis for obtaining the money. Therefore, the evidence of Wu's claim is insufficient. In the end, the court ruled that Wu's claim was rejected.
