People's Republic of China (PRC) Anti-unfair Competition Law
Article 2 In market transactions, business operators shall follow the principles of voluntariness, equality, fairness, honesty and credibility, and abide by recognized business ethics.
Unfair competition as mentioned in this Law refers to the acts of business operators that violate the provisions of this Law, damage the legitimate rights and interests of other business operators and disrupt social and economic order.
The term "business operators" as mentioned in this Law refers to legal persons, other economic organizations and individuals engaged in commodity business or profit-making services (hereinafter referred to as commodities including services).
Article 7 The government and its subordinate departments shall not abuse their administrative power to restrict others from purchasing the commodities of the operators designated by them, or restrict the legitimate business activities of other operators.
The government and its subordinate departments shall not abuse administrative power to restrict foreign goods from entering the local market or local goods from flowing to foreign markets.
Sixteenth supervision and inspection departments at or above the county level may supervise and inspect acts of unfair competition.
Article 30 If the government and its subordinate departments, in violation of the provisions of Article 7 of this Law, restrict others from buying the commodities of the operators designated by them, restrict the legitimate business activities of other operators, or restrict the normal circulation of commodities between regions, the higher authorities shall order them to make corrections; If the circumstances are serious, the person directly responsible shall be given administrative sanctions by the authorities at the same level or at a higher level. If the designated business operator sells inferior and high-priced goods or overcharges, the supervision and inspection department shall confiscate the illegal income and may impose a fine of more than one time and less than three times the illegal income according to the circumstances.
Law of the People's Republic of China on Protection of Consumer Rights and Interests
Article 9 Consumers have the right to choose their own commodities or services. Consumers have the right to choose their own operators to provide goods or services, choose their own varieties of goods or services, and decide whether to buy or not to buy any kind of goods or accept or not to accept any kind of services. Consumers have the right to compare, identify and choose their own goods or services. Consumers have the right to return the newly-added goods purchased through non-fixed places such as telephone sales, postal sales and door-to-door sales within 30 days after receiving them, without bearing any expenses, except those that affect the re-sale of the goods.
Article 28 Obligations of Industrial and Commercial Departments The industrial and commercial administrative departments of the people's governments at all levels and other relevant administrative departments shall, within the scope of their respective duties and in accordance with the provisions of laws and regulations, take measures to protect the legitimate rights and interests of consumers. The relevant administrative departments shall listen to the opinions of consumers and their social organizations on the trading behavior of operators and the quality of goods and services, and promptly investigate and deal with them. Article 29 Obligations of Other State Organs Relevant state organs shall, in accordance with the provisions of laws and regulations, punish business operators for their illegal and criminal acts that infringe upon the legitimate rights and interests of consumers in providing commodities and services. Article 30 Obligations of the People's Court The People's Court shall take measures to facilitate consumers to bring lawsuits. Disputes over consumers' rights and interests in accordance with the provisions of the Civil Procedure Law of People's Republic of China (PRC) must be accepted and tried in a timely manner.
Article 34 Disputes over consumers' rights and interests between consumers and business operators can be resolved through the following channels: (1) settlement through consultation with business operators; (2) Requesting consumers' associations to mediate; (three) to appeal to the relevant administrative departments; (four) according to the arbitration agreement reached with the operator, submit it to an arbitration institution for arbitration; (5) bring a lawsuit to the people's court.
