Online loans will be sued by the court if they are overdue:
1. Overdue online loan is a breach of contract. If the debtor fails to repay the loan, the online lending institution may pursue the debtor's civil liability by suing the court.
2. If there is illegal possession and non-return during online loan borrowing, it may be considered as fraud. At this point, the debtor will be investigated for criminal responsibility.
3. For the conditions of prosecution, time, arrears and willingness to pay back money are all key points. Overdue for more than 90 days will be blacked out or even prosecuted by the bank.
Therefore, online loans need to be repaid on time within the specified time. Many people can't repay in time because of online loans, which leads to the situation of rolling interest, and finally more and more debts are owed, so that they can't repay in the end. Therefore, in real life, if you don't want to bring yourself overdue troubles in the later period, you must abide by the relevant agreements and repay in time. The inability to repay is only a civil dispute and will not go to jail. Article 193 The crime of loan fraud involves defrauding a bank or other financial institution of a loan for the purpose of illegal possession under any of the following circumstances.
