The "Measures" clarify that the distribution of commercial housing is subject to the policy of "one household is limited to purchase once and one set is limited to purchase". Eligible families of Class III residents and families of Class VII imported talents in Haikou can purchase 1 set, and commercial housing is mainly houses below 100 square meters, with the maximum not exceeding 120 square meters.

Chapter I General Provisions

The first item is to standardize the management of housing commercial housing in this city. According to the "Guiding Opinions of the General Office of the People's Government of Hainan Province on the Pilot Work of the Construction of Affordable Commercial Housing" (No.2/KLOC-0 [2020] of the Government), combined with the actual situation of this Municipality, these measures are formulated.

Article 2 Scope of Application These Measures shall apply to the planning and construction, application review, placement and listing of commercial housing within the administrative area of this Municipality.

The term "housing-type commercial housing" as mentioned in these Measures refers to the commercial housing with policy guarantee nature, limited sales target, sales price, Xing Tao area and transfer conditions, which is built in a government-led and market-oriented operation mode and sold to eligible families.

Article 3 Principles The construction and management of commercial housing in this Municipality shall follow the principles of government leading, market operation, overall planning, rational layout, restricted circulation, openness and fairness.

Article 4 Division of Responsibilities The municipal housing and urban-rural construction department is the administrative department in charge of housing security in this Municipality, and is responsible for the guidance, supervision and management of housing security in this Municipality. The municipal housing and urban-rural construction department may entrust the municipal housing security implementation agency to be responsible for the specific organization and implementation of affordable commercial housing.

District Housing and Urban-Rural Development Department is responsible for organizing and implementing the related work of housing-type commercial housing in this area. District housing and urban-rural construction departments may entrust district housing security implementation agencies to be responsible for the specific organization and implementation of affordable commercial housing.

The municipal development and reform department is responsible for drafting and adjusting the average selling price of commercial housing jointly with the municipal housing and urban-rural construction department and the municipal natural resources and planning department, and is responsible for supporting the infrastructure and public service facilities of commercial housing projects.

The municipal finance department shall, according to the municipal government's investment project plan, do a good job in ensuring the funds for the supporting construction of housing infrastructure and public service facilities.

The municipal natural resources and planning department is responsible for arranging the construction land of residential commercial housing and its supply, and providing housing property registration for the buyers.

The talent development department of the municipal party Committee is responsible for providing the certification documents for the introduction of talents.

The municipal human resources and social security department is responsible for providing the social insurance payment information of the insured.

The municipal public security department is responsible for providing the subscriber's household registration and residence information.

The municipal civil affairs department is responsible for providing proof of the marital status of the subscribers.

The Municipal Bureau of Veterans Affairs is responsible for providing pensions, compensation and preferential treatment certificates.

The municipal tax department is responsible for providing information on the personal income tax paid by the applicant.

Chapter II Planning and Construction

Article 5 Annual Construction Plan The municipal housing and urban construction department shall, jointly with the municipal departments of natural resources and planning, talent development, health, education and other industrial parks, organize the preparation of the annual construction plan for commercial housing in this city according to the city's economic development, industrial policies and the demand for commercial housing, and organize its implementation after being reported to the municipal government for approval.

Article 6 The Municipal People's Government shall incorporate the following housing into the overall housing management scope of this Municipality:

(a) according to the city's housing construction plan, to tender, auction, listing and other ways to obtain housing land, and by enterprises with real estate development and management qualifications to develop and build housing.

(two) according to the city's housing demand and housing construction plan, with the consent of the municipal government, enterprises use the unused stock of commercial housing land for construction or renovation of existing commercial housing to raise housing.

(3) Other commercial houses under the overall management of the government according to regulations.

Article 7 When applying to the local natural resources and planning department for a new project of transferring residential land for housing construction, priority should be given to ensuring the supply of residential land, and all residential land should be used for housing construction, and it should be transferred through bidding, auction and listing. The construction of residential commercial housing is not restricted by the annual implementation plan of commercial housing in this city.

Article 8 Conditions for Bidding, Auction and Hanging If the municipal natural resources and planning department transfers the land use right of residential commercial housing construction by bidding, it shall, in combination with the requirements of the municipal housing and urban-rural construction department on the sales object, sales price, apartment type, property right restriction, construction management and other aspects of residential commercial housing, put it into the transaction documents for bidding, and take bidding, auction and hanging as the conditions for land transfer of the project, and incorporate it into the land transfer contract signed with the land bidder (the winning bidder) after the land transaction.

When the bidder (bidder) submits the written bidding materials and bid application, it must also submit a letter of commitment to ensure the organization of development and construction as required.

Article 9 The construction area of a single residential commercial house is mainly within 100 square meter, and the maximum is not more than 120 square meter.

Article 10 The municipal development and reform department shall, jointly with the municipal housing and urban-rural construction department, comprehensively consider the construction cost (including land cost, development cost, management cost, investment interest, taxes and fees, etc.) and other factors. ), the ratio of house price to income and the market price of commercial housing, and determine the sales price of residential commercial housing, which will be implemented after the land is listed and reported to the municipal government for approval. On the premise of operability and sustainability of the project, the sales price should be significantly lower than the average market price in the same region.

Eleventh residential commercial housing construction and sales methods should be in the form of fully decorated and assembled buildings. The specific construction standards shall be formulated separately by the municipal housing and urban-rural construction department.

If the newly leased land for the construction of affordable commercial housing is sold in the form of existing houses, it shall be implemented in accordance with the provisions of laws and regulations on the sale of existing houses.

Article 12. The housing security implementation agencies of one household and one stall city shall implement unified management of affordable commercial housing under the overall management of the municipal government, and establish electronic files of the housing project information, housing supply, application review and placement information of affordable commercial housing in this city jointly with the housing security implementation agencies of the district. The application review and resettlement information of the security object should meet the requirements of one household and one file, so as to ensure that the needs of inquiry and information disclosure can be met.

Chapter III Application and Examination

Thirteenth conditions for the purchase of residential commercial housing in this city are oriented to eligible households with household registration in this city and the introduction of talents.

(a) families who are employed in cities and towns in this Municipality may purchase affordable commercial housing in this Municipality if they meet one of the following conditions.

1, obtained the household registration in this city before April 28, 2020, and the family members have no housing or purchase records in the towns of this province, or have housing 1 set in the towns of this province, and the per capita housing area is lower than that of urban households in this city.

2. After April 28, 2020, the household registration in this city was obtained, and the family members have been paying taxes and social security in this city for more than 36 months (inclusive), lived for more than 540 days (inclusive), and have no housing and no record of buying houses in the towns of this province, or have 1 set of housing in the towns of this province, and the per capita housing area is lower than that of urban households in this city.

3. Without obtaining the household registration in this city, family members have been paying taxes and social security in this city for more than 60 months (inclusive), actually lived for more than 900 days (inclusive), and have no housing or purchase records in the towns of this province.

(two) the introduction of talents who are employed in cities and towns in this Municipality can purchase affordable commercial housing in this Municipality if they meet one of the following conditions.

1. I have obtained the household registration in this city, paid taxes and social security continuously in this city for more than 24 months (inclusive), actually lived for more than 360 days (inclusive), and my family members have no housing and no record of buying houses in towns in this province, or have 1 apartment in towns in this province, and the per capita housing area is lower than that of urban households in this city.

2. All kinds of imported talents who have not obtained the household registration in this city have been paying taxes and social security for more than 36 months (inclusive) in this city, and have actually lived for more than 540 days (inclusive), and their family members have no room in the towns of this province and have no record of buying houses.

3. The accompanying employees who moved to Hainan's corporate headquarters or regional headquarters from outside the province have paid taxes and social security 12 months or more, actually lived 180 days or more, and their family members have no housing or purchase records in the towns of this province, or own housing 1 set in the towns of this province, and the per capita housing area is lower than that of urban households in this city.

4. Employees who are recognized as comprehensive headquarters enterprises and meet the talent introduction standards stipulated by our province have been paying taxes and social security continuously in this city for more than two months (inclusive), actually lived for more than 80 days (inclusive), and their family members have no housing or purchase records in towns and cities in this province.

5. Employees who are recognized as regional headquarters, high-growth headquarters, regional headquarters of multinational companies, regional headquarters of international organizations (institutions) or major investment promotion project units have full-time bachelor degree or above, or have intermediate or above professional titles, technicians or above professional qualifications, and I have been paying taxes and social security continuously in this city for more than 2 months (inclusive), and actually live in 180.

6. The recognized high-level talents, those who are in urgent need of talents, and those who have been flexibly introduced with high-level talents have been employed in this city for more than 3 years and have served 1 year. I have paid taxes and social security 12 months or more (inclusive) in this city, actually lived 180 days or more (inclusive), and my family members have no housing or purchase records in the towns of this province.

7. I have been paying taxes and social security 12 months or more in this city continuously, and I have actually lived in public recruitment, public transfer, civil servants transferred to this city (including central units stationed in Qionglai and provincial units) and staff members who have entered public institutions (including central units stationed in Qionglai and provincial units) and legal institutions in this city through public recruitment or organization transfer.

The actual residence time mentioned in this article shall be calculated according to half of the taxable amount and social security time. Before April 28, 2020, if the time for tax payment and social security has reached the prescribed level, the actual residence time will not be verified; Those who do not meet the above requirements must verify the actual residence time corresponding to the tax payment and social security time after April 28, 2020.

The housing mentioned in this article includes commercial housing, self-built housing, and resettlement housing. , including second-hand houses and transfer houses.

Fourteenth applicants apply for the purchase of affordable housing in a family unit, and the applicant's spouse and minor children are listed as the same applicant.

Minor children are listed as * * * applicants, which does not affect their ability to form a family alone as adults or apply for housing in this city as single residents after reaching the specified age.

The introduction of talents and single residents who have reached the age of 28 meet the requirements of these measures, and can apply for affordable commercial housing in their own name.

Article 16 The allocation of price-limited houses is subject to "one household is limited to one set".

Family members who apply for family housing reform have purchased public housing, employee fund-raising cooperative housing, affordable housing, price-limited commodity housing, public related commodity housing and other policy housing, and may not apply for the purchase of residential commercial housing.

Family members who have applied for housing subsidies can apply for the purchase of affordable commercial housing, but they will stop enjoying housing subsidies from the date of signing the purchase contract. Where there are other provisions on employee housing subsidies, such provisions shall prevail.

Seventeenth housing area for family members per capita self-owned housing construction area, approved in accordance with the following provisions:

(1) If the property right of self-owned housing has been registered, it shall be approved according to the registered area;

(two) in the city's own housing property rights are not registered, according to the measured area approved.

If the applicant's family members have no property right registration, the town government or sub-district office where the house is located shall assist in issuing relevant certificates of housing conditions.

The per capita housing area of urban households in this city shall be subject to the data of the municipal statistics department, which shall be promulgated and implemented by the municipal government for dynamic management and timely adjustment.

Article 18 The waiting system for housing-type commercial housing shall be implemented, and the district housing security implementation agency shall implement the waiting registration management according to the order in which the applicant has obtained the quasi-purchase qualification and priority protection for housing-type commercial housing. Waiting for registration information shall be made public and subject to supervision.

District housing security implementation agencies shall regularly report the waiting registration of housing security objects in their respective jurisdictions to the municipal housing security implementation agencies for the record, and do a good job in the connection of security information management.

Nineteenth application materials to apply for the purchase of residential commercial housing, it should be submitted to the "Haikou residential commercial housing application form", the applicant's identity certificate, household registration book, marriage certificate and talent identification documents.

The relevant materials specified in the preceding paragraph shall be provided in originals, and a copy shall be kept after verification.

When submitting the materials specified in the preceding paragraph, the applicant shall sign a declaration of good faith on the spot, be responsible for the authenticity, accuracy and legality of the application materials and declaration information submitted by him, and agree to accept the housing situation verification.

If the applicant's family conforms to the provisions of Article 21 of these Measures and can be given priority placement, relevant certification materials shall be provided.

Article 20 After accepting the application for waiting, the housing security implementation institution in the review procedure area shall complete the following work within 20 working days:

(1) application. The applicant shall apply to the district housing security implementation agency where the registered permanent residence is located, fill in the Haikou Housing Application Form and submit relevant materials;

(2) acceptance. District housing security implementation agencies to conduct a preliminary examination of the application materials, the materials are complete and in line with the prescribed form, to be accepted, and issue an acceptance receipt to the applicant; If the application materials are incomplete or do not conform to the statutory form, the materials that need to be corrected shall be informed in writing on the spot or within 5 days.

(3) review. District housing security implementation agencies to review the application materials, through departmental surveys, letters, household surveys and other means to investigate and verify.

Audit matters involving other departments, by the district housing security implementation agencies through internal circulation. Relevant functional departments such as household registration, social security, individual tax, property right registration, marriage and talent identification should provide relevant information through government information exchange or issue clear verification results within five days.

(4) publicity. After investigation, the list of applicants who meet the requirements for purchasing affordable commercial housing shall be publicized by the district housing security implementation agency on the website of the district government and the website of the department, and the publicity time limit shall not be less than seven days. If there is any objection to the publicity, and it is verified that it does not meet the conditions for purchasing affordable commercial housing, the district housing security implementation agency that accepts the application shall inform the applicant in writing.

(5) approval. If there is no objection after publicity, the district housing security implementation agency will approve and issue the Notice of Quasi-purchase of Residential Commodity Housing (hereinafter referred to as the Notice of Quasi-purchase).

(6) Overall housing planning. District housing security implementation agencies shall regularly classify and register the housing needs of applicants who have obtained the notice of quasi-purchase, and report to the municipal housing security implementation agencies for the record. City housing security implementation agencies according to the housing situation and the overall situation of the applicant for resettlement.

Twenty-first priority applicants in any of the following circumstances, under the same conditions, can give priority to the placement of residential commercial housing:

(a) to obtain the qualification of quasi-purchase of price-limited commercial housing and affordable housing;

(2) Model workers at or above the provincial or ministerial level working in this Municipality; Veterans who have won second-class merit and above;

(3) The house where you currently live has been identified as a dangerous house that should be demolished or stopped;

(four) the applicant's family members have severe disabilities or are entitled to special care;

(five) other circumstances in which priority can be given to housing in accordance with the regulations.

Twenty-second waiting information disclosure city housing security implementation agencies should be in line with the waiting application conditions of the applicant, * * with the applicant's relevant information to the public through a unified information platform, accept social supervision.

Chapter IV Placing

Twenty-third commercial housing distribution range should be oriented to the city waiting for placement. Enterprises using their own stock of land construction or stock of commercial housing renovation housing, priority can be given to enterprises waiting for resettlement.

The Municipal People's Government may determine a certain proportion of the houses and place them in a targeted manner to the qualified enterprise employees in this Municipality.

Twenty-fourth placement scheme before the placement of housing projects, the municipal housing security implementation agency shall, according to the housing projects available for sale and waiting for registration, formulate the placement scheme of housing projects, and promptly announce it to the public and accept supervision.

The placing plan shall include the following contents:

(a) the basic information of the commercial housing to be sold, including the project location, apartment area and sales price;

(2) The scope and specific conditions of the allotment;

(3) The method and procedure for placing shares;

(four) the way of signing the house sales contract;

(5) Other necessary contents.

Twenty-fifth qualification examination before the placement of residential commercial housing, the district housing security implementation agency shall conduct qualification examination of the placing object, and if it no longer meets the conditions, it shall inform it in writing and explain the reasons.

Article 26. The signing applicant shall sign a sales contract for affordable commercial housing within the specified place and time limit after selecting the number of allocated houses in accordance with the methods and procedures specified in the allocation plan.

If the applicant fails to sign the house-for-house sales contract after selecting the allocation house number according to the agreed methods and procedures, it shall be deemed that the applicant has waived the qualification of house-for-house purchase. Applicants who give up the qualification for this purchase can participate in the next housing placement. However, if the applicant fails to sign a contract for the sale of affordable commercial housing with the construction unit due to his own reasons after selecting the house number twice according to the prescribed methods and procedures, his subscription qualification will be cancelled.

Twenty-seventh housing sales contracts for the record should use a unified format contract, and according to the relevant provisions of the implementation of housing sales contracts online signing and filing management. The municipal housing and urban-rural construction department is responsible for the organization and implementation of online signing and filing management of residential commercial housing sales contracts in this Municipality.

Chapter V Property Rights Restrictions and Listing Transactions

Article 28 An applicant who has paid taxes and social security for 15 years or reached the statutory retirement age in this province, and the online signing and filing time of the house purchase contract has reached 10 years since the filing date of the house purchase contract, can be listed and traded.

Article 29. Closed-loop commodity housing does not meet the conditions for listing and trading, but it is really necessary to transfer due to enterprise relocation, job changes and other reasons, and the purchaser shall meet the conditions for applying for the purchase of commodity housing. If the purchaser does not meet the requirements, the real estate registration agency shall not handle the registration of commodity housing property rights.

Thirtieth the property owner died after obtaining the certificate of ownership of the house, resulting in the inheritance of the rights of the house purchased by the purchaser, and the successor listed the house, referring to the relevant provisions of these measures for the purchaser.

Thirty-first commercial housing listed for trading and income sharing meets the conditions for listing and trading, and can be listed and traded only after being approved by the municipal housing and urban-rural construction department and going through the following procedures:

(1) Pay the value-added income in proportion, and the proportion of government share shall be determined according to the preferential ratio between the original purchase price stipulated in the purchase contract and the deduction of the housing holding period after meeting the listing and trading conditions (deducted by 1% every year);

(2) Handle the relevant real estate ownership registration procedures according to law, cancel the notes on the original real estate ownership certificate, and obtain the complete property rights of the house.

Thirty-second property registration real estate registration agencies should indicate the words "housing oriented commodity housing" on the ownership certificate of housing oriented commodity housing.

Chapter VI Supervision and Administration

Thirty-third price supervision of commercial housing placement should be clearly marked; The market supervision and management department shall strengthen the supervision and inspection of the sales price of residential commercial housing, and deal with the illegal acts such as the construction unit's unauthorized increase of the sales price and price fraud in violation of the clearly marked price.

Article 34 the legal liability of the applicant If the applicant conceals or falsely reports the population, household registration, age, marriage and housing status, or adopts improper means such as bribery, the municipal housing and urban-rural construction department will reject his application and refuse to accept his housing application.

If the applicant has taken over the housing, the applicant shall be ordered to vacate the housing, and the municipal housing and urban-rural construction department or its designated unit shall recover the purchased housing at the original price, taking into account depreciation and other factors. District housing security implementation agencies will no longer accept their applications for purchasing affordable commercial housing. The losses caused by fraudulent purchase of affordable commercial housing shall be borne by itself; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 35 If the applicant for credit management and the applicant violate the relevant laws and regulations and the provisions of these Measures, in addition to being punished according to law, the municipal housing and urban-rural construction department shall include it in the record of bad behavior, publicize it on the website of the department, and send a copy of the publicity content to the subordinate units and relevant credit platforms for credit supervision.

Thirty-sixth administrative departments and implementing agencies that accept housing security reports shall set up and publicly report telephone numbers, mailboxes and e-mails. , smooth channels for reporting letters and visits, and adopt various ways to accept the supervision of the implementation of housing security for commercial housing in this city.

Article 37 If the staff members of the administrative organs responsible for housing security management departments, implementing agencies and other relevant administrative departments neglect their duties, abuse their powers or engage in malpractices for selfish ends in the management of commercial housing, they shall be given administrative sanctions by their departments or supervisory departments according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VII Supplementary Provisions

Article 38 Family members mentioned in these Measures include the applicant, spouse and minor children.

Thirty-ninth commercial housing especially suitable for grassroots teachers and medical staff to live in shall be managed by the municipal administrative department of education and health with reference to these measures.

Fortieth the specific application of these Measures shall be interpreted by the municipal housing and urban-rural construction department.

Article 41 These Measures shall come into force as of, 2020 and shall be valid for five years.
