Regulations of Zhuhai Special Economic Zone on Island Protection in Sea Area

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the reality of Zhuhai Special Economic Zone in order to strengthen the management of islands in sea areas, protect and improve the marine environment and promote the sustainable development of economy and society. Article 2 These Regulations shall apply to island protection and related management activities in the sea areas under the jurisdiction of this Municipality. Article 3 The protection of islands in sea areas shall follow the principles of land and sea planning, planning and guidance, ecological priority and green development. Article 4 The municipal and district people's governments (hereinafter referred to as municipal and district governments) shall strengthen the island protection work, establish a communication and coordination mechanism and a joint handling mechanism for public emergencies, and coordinate and solve major problems in the island protection work in this region.

Fishery, maritime affairs, public security, construction, natural resources, transportation, tourism, urban management, ports, waterways, water affairs and other administrative departments shall, according to their respective functions and duties, supervise and manage the protection of sea islands. Article 6 This Municipality shall establish a marine resources investigation system. The municipal marine administrative department shall, jointly with the municipal ecological environment and other relevant departments, carry out surveys on marine resources and marine environment, establish survey files and update them in time. Article 7 This Municipality shall establish a marine information sharing system. The municipal marine administrative department is responsible for the construction and management of the marine comprehensive information platform, timely input data and information such as marine ecological environment protection, marine monitoring and marine resources investigation, and dynamically update them. Ecological environment, transportation, maritime affairs, emergency management and other related departments. Ocean-related data and information should be input into the city's comprehensive marine information platform to promote the sharing of marine information. Chapter II Planning and Management Article 10 The municipal marine administrative department shall, according to the marine functional zoning of Guangdong Province, work out the marine functional zoning of this Municipality in conjunction with relevant departments, and announce it to the public after approval in accordance with legal procedures, except for the contents involving state secrets.

The compilation of marine functional zoning shall specify the development and protection priorities, development sequence, protection requirements and control measures of each marine functional zone. Article 11 The municipal administrative department of ecological environment shall, jointly with the relevant departments and the district government, formulate the marine environmental protection plan of this Municipality according to the marine functional zoning, and announce it to the public after approval in accordance with legal procedures, except for the contents involving state secrets.

Marine environmental protection planning should follow the principles of protecting and improving the ecological environment and ensuring the sustainable utilization of sea areas, and clarify the objectives, standards and main measures of marine environmental protection. Twelfth fishery administrative departments shall, in conjunction with natural resources, ecological environment, transportation, ports, maritime affairs, waterways and other relevant departments, according to the city's marine functional zoning, formulate aquaculture water beach planning, and report it to the government at the same level for approval before implementation.

The mudflat planning of aquaculture waters shall specify the prohibited aquaculture areas, restricted aquaculture areas and aquaculture areas, as well as the scope, capacity, control objectives and main control measures of aquaculture areas. Thirteenth city marine administrative departments in conjunction with the natural resources, ecological environment and other relevant departments to prepare the city's island protection plan, and reported to the municipal government for approval before implementation.

The port planning of this Municipality and the planning of sea islands involving aquaculture, transportation, tourism and wetland protection shall conform to the marine functional zoning.

The city's marine functional zoning, marine environmental protection planning and island protection planning should be linked with the city's national economic and social development planning, overall land use planning and overall urban planning. Chapter III Protection Measures Section 1 Protection of Sea Areas Article 15 The development and utilization of marine resources shall be based on the rational distribution of marine functional zoning, comply with the requirements of marine ecological red line control, and safeguard the health and safety of marine ecology. Article 16 Strengthen the protection of the natural coastline of the mainland, and prohibit construction projects from illegally occupying or destroying the natural coastline. Strengthen the renovation and repair of damaged coastline.

The maritime administrative department shall regularly announce the strictly protected coastline, restricted development of coastline and optimized utilization of coastline selected according to law.

The natural coastline as mentioned in these Regulations refers to the coastline formed by the interaction between land and sea, including sandy coastline, muddy coastline, bedrock coastline, biological coastline and other primary coastline. Seventeenth prohibit reclamation in key bays, marine nature reserves, special marine reserves, key estuaries, important coastal wetlands, important sandy coastlines and sand source protection areas, special protection islands and important fishing areas; Strictly restrict the implementation of reclamation in ecologically fragile and sensitive areas and sea areas with poor self-purification ability.
