Interim provisions on the administration of land appraisal institutions

Article 1 In order to strengthen the management of land appraisal institutions, ensure the scientificity, impartiality and authority of land appraisal results, and promote the healthy development of the land market, these Provisions are formulated according to the needs of current land appraisal work and relevant national policies and regulations. Article 2 The qualifications of land appraisal institutions shall be graded.

Grade A land appraisal institutions can engage in land appraisal work nationwide. Grade B land appraisal institutions can only engage in land appraisal within the county-level administrative area where the appraisal institutions are located. Article 3 The State practices the qualification certification system for land appraisal institutions.

The qualification certification of land appraisal institutions shall be approved by the State Bureau of Land Management and the land (land) administrative departments of provinces, autonomous regions and municipalities directly under the Central Government.

The qualification of Grade A land appraisal institutions shall be approved by the State Bureau of Land Management.

The qualification of Grade B land appraisal institutions shall be approved by the land administrative departments of provinces, autonomous regions and municipalities directly under the Central Government. Article 4 A land appraisal institution applying for a land appraisal qualification certificate must meet the following conditions:

1. Enterprises and institutions with independent legal personality;

2. There are professionals in land valuation, including not less than 2 qualified land valuers, and not less than 25% of the total number. Not less than 50% of the people who have the qualification of land appraisers and have high or intermediate titles have presided over land appraisal examples.

3. Have a certain proportion of professional and technical personnel in construction, economy, accounting and management;

4. Have some experience in land valuation.

In addition to land appraisal professionals, land appraisal institutions may employ part-time personnel. Article 5 An institution applying for Grade-A land evaluation qualification shall meet the conditions stipulated in Article 4 and the following supplementary conditions:

1. More than five people have obtained the qualification of land valuer;

2 engaged in land valuation for more than three years. Article 6 An institution applying for Grade B land appraisal qualification certificate shall meet the requirements of Article 4 and have been engaged in land appraisal for more than two years. Seventh meet the requirements of Article 4, but not fully meet the requirements of Article 5 or Article 6, and the land management departments at or above the provincial level have the ability of land appraisal, and the national or provincial land management departments shall issue the qualification certificates of temporary appraisal institutions respectively. The validity period of the qualification certificate of the temporary assessment institution shall not exceed two years. During the validity period, the appraisal institution may engage in land appraisal in the corresponding administrative area. Article 8 Any institution that meets the conditions stipulated in Article 5 and Article 6 and wants to engage in land appraisal may apply to the provinces, autonomous regions, municipalities directly under the Central Government or the State Bureau of Land Management for land appraisal after being appraised by the municipal and county land management departments. The following materials shall be submitted when applying:

1. Application form for qualification certification of land appraisal institutions;

2. Certification materials of enterprises and institutions as legal persons;

3 professional and technical personnel title certification materials and full-time, external part-time staff of land appraisal institutions;

4. Articles of association of the land appraisal institution;

5. Examples of land valuation;

6. Application report for land evaluation qualification. Article 9 After receiving the application materials of the applicant's land appraisal qualification, the land management department shall make a conclusion within three months. Those who pass the examination shall be awarded the qualification certificate of land appraisal institution by the land management department.

The qualification certificate of land appraisal institutions shall be uniformly printed by the State Bureau of Land Management. Article 10 An appraisal institution holding a land appraisal qualification certificate issued by the national or provincial land administration department may undertake the corresponding land appraisal work and accept the supervision and management of the land administration department.

Land valuation should provide paid services. Eleventh land appraisal institutions qualification registration system, valid for three years. Before the expiration of the validity period, the land appraisal institution shall apply to the license issuing agency for re-registration. When re-registering, the land appraisal institution shall provide a three-year work report, personnel information and five typical appraisal examples. The land management department shall review the land appraisal institutions in accordance with these regulations, and if they pass the examination, the land management department shall register. If there are no examples of land valuation for two consecutive years, the land valuation is not carried out according to the relevant laws and regulations of the state, or the institutions engaged in land valuation no longer have other conditions, their land valuation qualifications will be cancelled and the qualification certificates of land valuation institutions will be recovered. Article 12 An institution qualified for land appraisal may, with the approval of a person qualified as a land appraiser, send a special person to the land administration department where the appraised object is located to apply for consulting the land registration documents, land price data and maps related to the appraised land. Thirteenth land appraisal institutions shall abide by the following working rules when conducting land appraisal:

1. Strictly abide by relevant national laws, regulations, rules and regulations;

2 adhere to the principle of fairness, objectivity and seeking truth from facts, and be responsible for the content, authenticity and legality of the land appraisal report issued;

3. The information provided by the entrusting party shall be kept strictly confidential;

4. The relevant land valuation work shall be completed within the time limit agreed in the entrustment agreement. The scope of submission of appraisal results should be strictly limited, and in principle, only the entrusting party and the land management department can be provided;

5. The land registration information provided by the land management department shall be kept strictly confidential and shall not be transferred or publicly quoted;

In violation of the above provisions, the land management department has the right to cancel its land appraisal qualification.
