According to statistics, as of 20 14, there were 460,000 motor vehicle maintenance businesses in China, including about 20,000 automobile 4S shops, accounting for less than 5% of the total maintenance business in China. Because 4S stores are authorized by automobile manufacturers, they have unique development advantages in terms of maintenance parts and maintenance technology, while most social maintenance operators have no legal channels to obtain special maintenance technology, resulting in unfair competition in the market and de facto technology monopoly, limiting automobile consumers' consumption choices to a certain extent and increasing consumers' burden. In addition, the "non-disclosure" of maintenance technology has affected the improvement of the overall technical level of the automobile maintenance industry, and brought about related problems such as improper maintenance, incomplete maintenance, excessive maintenance, hidden dangers of automobile driving safety, excessive exhaust emissions and so on, which has a wide impact. Automobile maintenance technology monopoly is strictly prohibited by law in the European Union, the United States and Japan. Automobile enterprises shall disclose the technical information related to vehicle maintenance according to law to ensure the safe operation of vehicles and the emission standards. To this end, the Guiding Opinions on Transformation and Upgrading of Maintenance Industry proposes to establish and implement the information disclosure system of automobile maintenance technology in China, break the technology monopoly, and truly play the decisive role of the market in resource allocation.

In order to thoroughly implement the spirit of the 18th CPC National Congress and the Third Plenary Session of the 18th CPC Central Committee, the provisions of the Law on the Prevention and Control of Air Pollution, the State Council's Opinions on Promoting Fair Competition and Maintaining Normal Market Order, and the ten ministries' Guiding Opinions on Promoting the Transformation and Upgrading of Automobile Maintenance Industry and Improving Service Quality, since last September, the Ministry of Transport has organized forces to comprehensively start the preparation of the Measures. A symposium on compilation was specially held, and a drafting group was set up. The actual situation in China was fully investigated, and the situation abroad was comprehensively understood, and the compilation principles and work requirements of the Measures were determined.

What is the basis and significance of the formulation of the Measures?
The Third Plenary Session of the 18th CPC Central Committee pointed out that it is necessary to speed up the formation of a modern market system featuring independent operation of enterprises, fair competition, free choice of consumers, independent consumption, free flow of goods and elements and equal exchange, and oppose monopoly and unfair competition. In June last year, the State Council issued "Several Opinions on Promoting Fair Competition and Maintaining Normal Market Order", pointing out that it is necessary to break regional blockades and industrial monopolies and abolish regulations and practices that hinder national unified market and fair competition.
On August 29th this year, the Law on the Prevention and Control of Air Pollution was discussed and passed at the16th meeting of the NPC Standing Committee, and came into force on 10/6. The laws of this Ministry explicitly authorize our Ministry to establish and implement the information disclosure system of automobile maintenance. Article 55 stipulates that "motor vehicle manufacturing and importing enterprises shall announce the maintenance technical information of motor vehicle models manufactured and imported by them to the society. The transportation departments shall strengthen supervision and management according to law. Article 1 1 1 also authorizes the transportation department to punish automobile enterprises that fail to implement the regulations.
On August 8 this year, the Ministry revised and adjusted the relevant contents of the Regulations on the Administration of Motor Vehicle Maintenance, and revised the fourth paragraph of Article 26 to read: "Motor vehicle manufacturing enterprises have the obligation to announce their maintenance technical information and working hours quota to the public within six months after new models are put on the market. The specific requirements shall be implemented in accordance with the regulations of the relevant state departments on the disclosure of automobile maintenance technical information. "

In the process of drafting the Measures, automobile manufacturers generally believe that when new models are put on the market, they should be given a transition period of six months to prepare, sort out and compile relevant technical information on vehicle maintenance. At the same time, in accordance with international practice, information disclosure will be implemented by vehicle types and stages, and the implementation time of different types of automobile models will be proposed, which will be implemented according to the following requirements.
1. Each automobile production enterprise shall report the information disclosure of its automobile maintenance technology to the Ministry of Transport for the record before 20 15 12 3 1.
