What procedures and materials are needed for marriage registration?
The marriage registration process is roughly as follows:
(1) application
Couples who meet the requirements for marriage registration can bring relevant certificates, supporting materials and registration photos, apply for marriage registration at the marriage registration office where one party's household registration is located, and fill in the declaration required for applying for marriage registration on the spot.
The documents and materials for applying for marriage registration depend on individual circumstances. For example, when China citizens apply for marriage registration in China, they need to hold their ID card, household registration book, marriage examination certificate, single certificate and declaration of no blood relationship (lineal blood relatives and collateral blood relatives within three generations) and other materials. Divorced people need a divorce certificate to apply for remarriage.
Foreigners (including foreigners residing or temporarily residing in China, China people and foreigners residing in China) applying for marriage in the mainland of China need to hold their valid passports, valid alien residence permits, official proof of marital status and other materials.
(2) Review
The marriage registration office will examine the application of the parties to find out whether the marriage application submitted is within the conditions. If there is any ambiguity, the marriage registration authority will ask the parties concerned and ask them to provide relevant certification materials when necessary.
(3) Registration (Licensing)
If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and then issue a marriage certificate; For divorced people, the marriage registration office will generally cancel the divorce certificate; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.
What procedures and documents do you need for divorce?
The divorce registration procedure is as follows:
(1) application
If the husband and wife divorce voluntarily, the two parties who need a divorce shall sign a divorce agreement according to the regulations, apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:
1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;
2. Valid and compliant identity documents, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc. ;
3. An application for divorce registration filled in on the spot.
(2) Accept
The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After the documents and certification materials submitted by the parties have been verified in the first instance, a "Receipt for Accepting the Application for Divorce Registration" will be issued. If the application conditions are not met, the divorce will not be accepted, and the registrar may issue a notice that the application for divorce registration will not be accepted.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, any party who does not want to divorce can bring his valid identity certificate and the receipt for accepting the application for divorce registration (if he loses it, he may not provide it, but he needs to explain the situation in writing), and ask the marriage registration office that accepts the application for divorce registration to withdraw the application for divorce registration, and fill in the application for withdrawal of divorce registration in person. After verification by the marriage registration authority, a Confirmation Letter for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both husband and wife who request divorce fail to apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday is the expiration date), both parties shall apply to the marriage registration authority for the issuance of divorce certificates together with the documents and materials specified in the Marriage Registration Standard, such as photos, marriage certificates, identity cards or passports, divorce agreements, etc. The marriage registration authority shall conduct a review in accordance with the relevant procedures and conditions, refuse to go through the divorce registration formalities for the parties who do not meet the conditions for divorce registration, and issue a notice of not going through the divorce registration at the request of the parties when necessary.
(5) Registration and certification
The marriage registration authority shall, in accordance with the provisions of the marriage registration work norms, carry out relevant registration and issue divorce certificates to the parties.
