Conditions for establishing a tourism company
The establishment of a travel agency shall meet the following conditions:
(1) Having a fixed business place;
(2) Having necessary business facilities;
(3) Operators who have been trained and hold qualification certificates issued by the tourism administrative departments of the people's governments at or above the provincial, autonomous region or municipality directly under the Central Government;
(4) It has registered capital and quality deposit that meet the requirements of Articles 7 and 8 of these Regulations.
Documents submitted by travel companies
Article 10 To apply for the establishment of a travel agency, the following documents shall be submitted:
(1) An application for establishment;
(2) A feasibility study report on the establishment of a travel agency;
(3) Articles of association of the travel agency;
(4) Resumes of the manager and deputy manager of the travel agency and qualification certificates specified in Item (3) of Article 6 of these Regulations;
(5) The capital credit certificate issued by the bank where the account is opened, and the capital verification report issued by the certified public accountant and his accounting firm or audit firm;
(6) Proof of business place;
(seven) proof of operating equipment.
Eleventh tourism administrative departments after receiving the application, according to the following principles:
(a) in line with the tourism development plan;
(two) to meet the needs of the tourism market;
(3) Having the conditions stipulated in Article 6 of these Regulations.
The tourism administrative department shall, within 30 days from the date of receiving the application, make a decision of approval or disapproval, and notify the applicant.
Article 12 The tourism administrative department shall issue the Travel Agency Business License to the applicant who has been examined and approved, and the applicant shall obtain the business license from the administrative department for industry and commerce with the Travel Agency Business License.
Those who have not obtained the Travel Agency Business License shall not engage in tourism business.
Thirteenth travel agencies to change the scope of business, should be approved by the original examination and approval of the tourism administrative department, the administrative department for Industry and Commerce for registration of change.
The travel agency changes its name, business premises, legal representative, etc. , or out of business, it shall go through the corresponding change registration or cancellation registration with the administrative department for industry and commerce, and file with the original examination and approval of the tourism administrative department.
Fourteenth tourism administrative departments shall implement the announcement system for travel agencies. Announcements include opening announcement, name change announcement, business scope change announcement, business suspension announcement and license revocation announcement.
Article 15 If a travel agency receives more than 654.38+10,000 tourists annually, it may establish a branch without legal person status (hereinafter referred to as a branch).
Every time an international travel agency establishes a branch, it shall increase its registered capital by 750,000 yuan and pay an additional quality guarantee of 300,000 yuan. Every time a domestic travel agency sets up a branch, it increases its registered capital by 6.5438+0.5 million yuan and pays a quality guarantee of 50,000 yuan.
Travel agencies and their branches shall implement unified management, unified finance, unified solicitation and unified reception.
Branches established by travel agencies shall be subject to the supervision and management of the tourism administrative departments of local people's governments at or above the county level.
Sixteenth foreign travel agencies to set up permanent offices in People's Republic of China (PRC), must be approved by the tourism administrative department of the State Council.
The resident representative offices of foreign travel agencies can only engage in tourism consultation, liaison and publicity activities, and may not engage in tourism business.
