Regulations of Sichuan Province on Tourism

Chapter I General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, standardize the order of the tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Regulations are formulated in accordance with the provisions of relevant state laws and administrative regulations and the actual situation of Sichuan Province. Article 2 These Regulations shall apply to the provision of transportation, sightseeing, accommodation, catering, shopping, entertainment, information and other services for tourists and their supervision and management activities within the administrative area of Sichuan Province. Article 3 The development of tourism should follow the principles of government leading, social participation, market operation and industry self-discipline, combine the protection of tourism resources with rational development and utilization, and realize the unity of ecological benefits, economic benefits and social benefits. Article 4 The local people's governments at or above the county level shall incorporate the development of tourism into the national economic and social development plan, formulate industrial policies for the development of tourism, and strengthen the construction of tourism infrastructure. Article 5 The tourism administrative departments of local people's governments at or above the county level shall be responsible for the organization, coordination, guidance, supervision and management of tourism within their respective administrative areas. Other relevant administrative departments shall, in accordance with the provisions of these regulations and their respective responsibilities, coordinate in the supervision and administration of tourism.

Tourism administrative law enforcement quality supervision and management institutions are responsible for the law enforcement supervision of tourism service quality and the handling of tourism complaints, and their funds are included in the fiscal year budget at the same level. Sixth tourism industry associations should improve the industry self-discipline system, carry out activities according to law, play the role of service, guidance and supervision, and promote the healthy development of tourism. Chapter II Tourism Promotion Article 7 Tourism development shall be planned in a unified way and shall conform to the tourism planning.

Tourism planning should highlight local characteristics, conform to the overall land use planning and urban and rural planning, and coordinate with the planning of natural ecological protection areas, cultural relics protection areas and scenic spots. Other relevant planning should take into account the tourism function and tourism development. Article 8 The tourism administrative departments of the people's governments of cities (prefectures) and counties shall, jointly with relevant departments, organize the preparation of tourism development plans, scenic spots plans and special tourism plans, which shall be submitted to the people's governments at the same level for approval and implementation after being examined by the tourism administrative departments at the next higher level.

The tourism administrative department of the provincial people's government shall, jointly with the relevant departments, organize the preparation of the province's tourism planning, cross-city (state) regional tourism planning and organize the review and report to the provincial people's government for approval and implementation.

Changes and cancellations of tourism planning shall be reported to the original approving authority for approval.

Where financial funds are used to prepare tourism plans, qualified professional institutions shall be determined to undertake the preparation of technical services through bidding. Ninth local people's governments at or above the county level shall, according to the local tourism development and financial situation, include the funds needed for the development and protection of tourism resources, tourism administration and tourism publicity in the annual budget, and increase it year by year. Conditional places can set up special funds for tourism development. Article 10 The construction of tourism projects shall conform to the tourism planning. Tourism project construction shall solicit the opinions of the tourism administrative department in writing when the project is established, and shall be submitted for approval in accordance with the relevant construction procedures. Eleventh state-owned tourism resources can be properly separated from the right to operate, and legal persons and other organizations can obtain the right to operate state-owned tourism resources through legal forms such as leasing, contracting and bidding. Where laws and regulations provide otherwise, such provisions shall prevail.

The management right of national scenic spots shall not be transferred as a whole. The transfer of the management right of other scenic spots and some scenic spots in national scenic spots shall be approved by the relevant administrative departments of the provincial people's government after being audited by the municipal and state people's governments. The tourism administrative department of the provincial people's government shall, during the Spring Festival, International Labor Day, National Day and other major tourism activities, publicly release the tourism reception information of major tourist areas to the public through mass media.

The main tourist areas may endanger the personal and property safety of tourists, and the tourism administrative department shall timely release the tourism early warning information. Thirteenth tourism administrative departments of local people's governments at or above the county level shall establish a database of tourism resources to promote the construction of tourism informatization.

Public transport hubs, major tourist attractions and important commercial blocks shall set up public welfare tourism consultation points to provide tourist information consultation services for tourists. Fourteenth local people's governments should support the development of citizens' self-help tourism and provide convenience for citizens' self-help tourism. Chapter III Tourism Management Section 1 General Provisions Article 15 Tourism management refers to the act of using tourism resources and tourism service facilities to attract and receive tourists and provide them with comprehensive services such as transportation, sightseeing, accommodation, catering, shopping, entertainment and information. Sixteenth tourism management should follow the principle of fairness in concluding contracts.

When concluding a contract with standard clauses, tourists and tour operators shall use the model contract text provided by the provincial administrative department for industry and commerce and the provincial tourism administrative department. Seventeenth tourism management should follow the principle of good faith and fulfill its obligations in accordance with the contract.

Tourism operators who agree on the percentage of commission for business promotion expenses through the contract shall not pay directly to tourism professionals.

Tourism operators who have not been graded by the national service quality standards shall not use the service quality grade marks and titles. After evaluation, the service quality grade mark and title shall not be used in violation of regulations.

Tourism professionals shall not forge, alter, buy, sell or lend a travel license.
