Article 5. Alteration, termination and rescission of the labor contract:

Article 3 Obligations of Party A

2. Party A is responsible for coordinating all external relations of the project construction and providing external conditions for the supervision work. 3. Party A shall provide Party B with the project-related engineering materials needed for the supervision work free of charge within the time agreed by both parties.
4. Party A shall make a written decision on all matters submitted by Party B in written form and required to be decided within the agreed time.
5. Party A shall authorize a resident representative who is familiar with the engineering situation and can make a decision within the specified time to contact Party B and inform Party B before replacing the resident representative.
6. Party A shall promptly notify the contractor of the selected contract in writing of the supervision right granted to Party B and the division of functions and supervision authority of Party B's main members, and make it clear in the contract signed with the third party.
7. Party A shall provide the following information within the time that does not affect Party B's supervision:
(1) List of manufacturers of raw materials, components and equipment cooperating with this project;
(2) Provide the cooperative units and the list of cooperative units related to this project.
8. Party A shall provide Party B with office space, communication facilities, employee housing and agreed facilities free of charge, and give reasonable economic compensation to Party B's own facilities.
Article 4 Party A's responsibilities
1. Party A shall perform the obligations stipulated in the entrusted supervision contract. If it violates this contract, it shall bear the liability for breach of contract and compensate the economic losses caused to Party B. ..

Article 5 Rights of Party B
1. Within the scope of the project entrusted by Party A, Party B enjoys the following rights according to the authorization of Party A and relevant laws and regulations:

(2) the right to approve the selection of project subcontractors;
(3) The right to make suggestions to Party A on matters related to project construction, including project scale, design standards, planning and design, production process design, functional requirements, etc.
(4) According to the principle of safety and optimization, put forward suggestions to designers on technical problems in engineering design; If the proposed scheme may increase the project cost or extend the construction period, Party A's consent shall be obtained in advance. If it is found that the engineering design does not meet the quality standards of construction projects promulgated by the state or the design contract, Party B shall report to Party A in written form and ask the designer to correct it;
(5) According to the principles of quality assurance, time limit for a project and cost reduction, examine and approve the project construction organization design and technical scheme, make suggestions to the contractor, and submit a written report to Party A;
(6) Be responsible for the organization and coordination of relevant cooperative units in engineering construction, and report important coordination matters to Party A in advance;
(7) With the consent of Party A, Party B has the right to issue a commencement order, a suspension order and a resumption order, but it shall report to Party A in advance. If it fails to report in advance in case of emergency, it shall report to Party A in writing within 24 hours;
(8) the right to check the materials used in the project and the quality of the project. 2. Under the authorization of Party A, Party B may propose changes to the contractual obligations of any contractor. If this seriously affects the project cost or quality or progress, such changes must be approved by Party A in advance. In case of emergency, if Party A fails to get approval in advance, Party B shall also inform Party A of the changes made as soon as possible. In the process of supervision, if the contractor's personnel are found to be ineffective, the supervision institution may require the contractor to replace the relevant personnel.
3. Within the scope of the entrusted project, any opinions and requirements (including claims) of Party A or the contractor to the other party must first be put forward to the supervision organization, which will study and handle the opinions and then negotiate with both parties. In case of dispute between Party A and the contractor, the supervision institution shall make independent judgment and mediate fairly according to its own functions. If the dispute between the two parties is mediated by the administrative department of construction of the government or arbitrated by an arbitration institution, the factual materials to prove it shall be provided.
Article 6 Obligations of Party B
1. Party B shall dispatch the supervision institutions and Party B's personnel required for supervision according to the contract, submit the list of appointed chief supervision engineers and main members of supervision institutions and supervision plans to Party A, and complete the supervision business within the scope of supervision projects agreed in the special terms and conditions of the supervision contract. During the performance of contractual obligations, the supervision work shall be reported to Party A on a regular basis as agreed in the contract.
2. When performing the obligations under this contract, Party B shall work diligently and conscientiously, provide suggestions suitable for Party A, and fairly safeguard the legitimate rights and interests of all parties.
3. The facilities and articles provided by Party A used by Party B belong to Party A's property. When the supervision work is completed or suspended, the facilities and remaining items shall be handed over to Party A in the time and manner agreed in the contract.
4. During the contract period or after the termination of the contract, confidential information related to the project and the contract business shall not be disclosed without the consent of the relevant parties.
Article 7 Responsibility of Party B
1. The responsibility period of Party B is the validity period of the entrusted supervision contract. In the process of supervision, if the date agreed in writing is exceeded due to the delay or delay of construction progress, both parties shall further agree to extend the contract period accordingly.

Second, the responsibilities of both parties.
(1) Party A's responsibilities:
1. Assist Party B to determine the buildings, attachments and related equipment for project demolition.
2. Supervise the organization, safety protection measures, site management and project implementation during the construction of this project, and check the project progress and construction quality.
3. Organize the project completion acceptance in time.
(II) Party B's responsibilities:
1. According to the project contents and requirements agreed in Article 1 of this Agreement, ensure that the above-ground buildings (structures), attachments, equipment relocation and site leveling are completed within the agreed time limit (relocation means that the outdoor terrace elevation is 0. 00) and dirt garbage removal, etc.
2. Comply with national, provincial and municipal regulations on the construction of this project. Party B shall not subcontract the project. During the construction process, the representative of Party B shall stay at the site for a long time to command and coordinate until the end of the project.
3. Third, the liability for breach of contract
1. If the construction period is delayed due to Party B's reasons, Party A will deduct it from Party B's demolition business expenses according to the standard of 500 yuan/day.
2. In the process of construction, if Party A fails to cooperate with or violate one of Party B's responsibilities in a timely and effective manner, Party A has the right to invite other construction units to carry out construction, and Party B shall leave the site unconditionally without interference.

1. In case of any dispute between Party A and Party B during the performance of this contract, both parties shall settle it through consultation in a common, understanding and friendly manner; If negotiation fails, you can apply for mediation to the construction administrative department where the project is located; If mediation fails, it may be submitted to Xiamen Arbitration Commission for arbitration.
2. If the construction period is delayed due to the shutdown caused by Party A or natural factors of force majeure, or the demolition is blocked by the relocated households, the construction period will be postponed.
3. If there are matters not covered in the implementation of this contract, Party A and Party B may sign a supplementary contract or agreement separately through consultation, and the supplementary contract or agreement has the same legal effect as this contract.
