Article 3 In order to create a fair and competitive automobile market environment, give full play to the basic role of the market in resource allocation, follow the laws of the socialist market economy, further introduce the competition mechanism, expand internal and external opening, break the regional blockade, and promote the free circulation of automobile products throughout the country. Article 4 Guide automobile trading enterprises to operate in good faith according to law, ensure the quality of goods and services, and provide satisfactory services to consumers. Article 5 In order to improve the overall level of China's automobile trade, the state encourages foreign investors with strong economic strength, advanced management experience and marketing technology, and perfect international sales network to invest in the automobile trade field. Article 6 Give full play to the bridge role of industry organizations, certification bodies and testing institutions, establish and improve an independent, fair and standardized intermediary service system for automobile trade evaluation, consultation, certification and testing, and actively promote the marketization process of automobile trade. Seventh, actively establish and improve relevant laws and regulations to speed up the legalization of automobile trade. The establishment of an automobile trading enterprise shall meet the relevant conditions stipulated by laws and administrative regulations. The competent department of commerce of the State Council shall, jointly with relevant departments, study, formulate and improve the management measures, norms and standards for automobile brand sales, second-hand car circulation, automobile parts circulation and scrapped automobile recycling. , manage and standardize the automobile trade behavior according to law, and maintain a fair market order. Chapter III Automobile Sales Article 10 Where domestic and foreign automobile manufacturers sell their own automobiles in China, they shall establish a perfect automobile brand sales and service system as soon as possible, so as to ensure that consumers get good service in the process of purchase and use and safeguard their legitimate rights and interests. Automobile production enterprises can invest in or authorize automobile general dealers to establish brand sales and service systems according to relevant state regulations. To engage in automobile brand sales activities, you should first obtain the authorization of the automobile production enterprise or its authorized automobile dealer. Automobile (including used cars) operators shall carry out automobile business activities within the business scope approved by the administrative department for industry and commerce. Article 12 An automobile supplier shall formulate an automobile brand sales service network plan. In order to protect the interests of consumers, the distance between automobile brand sales and its supporting parts supply and after-sales service outlets shall not exceed 150 km. Article 13 Automobile suppliers shall strengthen the management of brand sales service network, standardize sales service, announce the list of authorized or cancelled automobile brand sales service enterprises to the public after filing with the State Council Administration for Industry and Commerce on a regular basis, and shall not provide automobile resources to dealers who are not authorized by brands or do not have operating conditions. Automobile suppliers have the responsibility to announce the discontinued models to the public in time and take active measures to ensure the supply of spare parts within a reasonable period of time. Article 14 An automobile supplier and dealer shall specify their rights and obligations by signing a written contract. Automobile suppliers shall provide guidance and technical support to dealers, and shall not require dealers to accept unequal cooperation conditions, force distribution quantity and tying, or terminate the cooperative relationship with dealers at will. Article 15 Automobile suppliers shall undertake automobile quality assurance obligations and provide after-sales service in accordance with relevant national laws and regulations and commitments to consumers.

Automobile dealers shall clearly indicate the automobile quality assurance and after-sales service promised by automobile suppliers to consumers in their business premises, and provide corresponding after-sales service in accordance with their authorized business contracts and service specifications.

Automobile suppliers and dealers shall not supply and sell automobiles that do not meet the national safety technical standards for motor vehicles, have not obtained the national compulsory product certification, and are not included in the road motor vehicle production enterprises and product announcements. Imported cars that have not passed the inspection of People's Republic of China (PRC) Import and Export Commodity Inspection Law and its implementing regulations shall not be sold or used.
