Regulations of Taiyuan Municipality on Gas Management (revised on 20 10)

Chapter I General Provisions Article 1 In order to strengthen the management of gas, ensure public safety, safeguard the legitimate rights and interests of users and operators, and promote the development of gas industry, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 Gases mentioned in these Regulations refer to natural gas, artificial gas, liquefied petroleum gas and other gaseous fuels. Article 3 These Regulations shall apply to the planning, construction, operation, use, facility protection, safety management, sales, installation and maintenance of gas appliances within the administrative area of this Municipality. Article 4 This Municipality adheres to the principles of unified planning, supporting construction, adjusting measures to local conditions, rational use of energy, equal emphasis on construction and management, and fair competition in developing gas. Fifth city gas management department is responsible for the management of city gas. The municipal gas management department may entrust the municipal gas management institution to be responsible for the specific management of gas management.

The Municipal People's Government shall, in accordance with the responsibilities entrusted by the Municipal People's Government, do a good job in gas management within its jurisdiction.

County (city) gas management department is responsible for the gas management in this area.

The relevant government departments shall, in accordance with their respective responsibilities, do a good job in gas management. Article 6 The government encourages and supports the research of gas science and technology, and actively promotes the use of safe, energy-saving and efficient new technologies, new processes and new products.

City, county (city) people's government shall commend and reward the units and individuals that have made remarkable achievements in gas science and technology research, gas facilities development and maintenance, and emergency rescue and disaster relief. Chapter II Gas Planning and Construction Article 7 The gas development plan shall be formulated by the gas management department in conjunction with relevant departments according to the overall urban planning and implemented after being approved by the people's government at the same level. Eighth new construction, renovation and expansion of gas engineering projects shall conform to the gas development plan, carry out environmental protection demonstration and safety evaluation, and report to the relevant departments for approval in accordance with the relevant state construction project approval procedures. Ninth units engaged in the design, construction and supervision of gas engineering shall have corresponding qualifications and engage in activities within the scope of their qualification grades.

It is forbidden to undertake the design, construction and supervision of gas engineering without qualification certificate or beyond the scope permitted by qualification certificate. Tenth gas engineering design and construction must implement the relevant national technical standards and norms.

The construction unit shall organize design, construction, supervision and other relevant units and gas safety experts to participate in the completion and acceptance of gas projects. Without acceptance or unqualified acceptance of gas engineering, shall not be delivered for use.

After the completion and acceptance of the main gas pipeline network or important projects, the construction unit shall, within fifteen days from the date of acceptance, report the project completion and acceptance report and related documents to the municipal gas management department for the record. Eleventh city construction and transformation should be in accordance with the gas development plan, supporting the construction of gas facilities or reserve land for supporting the construction of gas facilities.

No unit or individual may occupy or change the use of land for supporting construction of gas facilities or reserved land for supporting construction of gas facilities. Twelfth because of the need to change the gas facilities, the construction unit shall report to the competent department of gas management for approval. The cost of changing gas facilities shall be borne by the construction unit.

If the construction unit applies for changing the gas facilities, involving other departments such as planning, it shall also go through the relevant formalities according to law. Thirteenth no unit or individual may obstruct the construction and installation of approved gas engineering projects. Chapter III Gas Operation Article 14 The franchise system shall be adopted for pipeline gas operation, and the licensing system shall be adopted for other gas operations.

Engaged in pipeline gas transmission and distribution and pipeline gas sales and business activities, shall be recognized by the municipal gas management department in accordance with the law, and signed a franchise agreement. Article 15 Gas enterprises refer to enterprises that produce, store, transport, distribute and supply gas.

A newly-built gas enterprise shall meet the following conditions:

(a) the construction project meets the requirements of city gas planning and has passed the acceptance;

(2) Having a stable gas source that meets the national standards;

(3) Having a safety evaluation report issued by a safety evaluation agency, which meets the requirements of safe operation;

(four) gas production, transmission and distribution, storage, filling, supply and other facilities meet the relevant national standards and fire safety and construction quality requirements;

(5) Having registered capital and professional gas technicians suitable for the business scale;

(six) a sound management system and safety management system;

(seven) there are operators who have received professional training in gas;

(eight) including infrastructure, production and operation, technical equipment, materials and safety in production and other complete information and files;

(nine) there is a sound emergency plan for safety accidents, and there are emergency rescue institutions, personnel, instruments, equipment and means of transportation that are suitable for the scale of gas supply;

(ten) enterprises engaged in the operation of liquefied petroleum gas have complete production facilities such as transportation, loading and unloading, storage, filling and residual liquid recovery.

Newly-built gas enterprises shall be approved by the municipal gas management department, and shall go through relevant registration before they can operate. Sixteenth gas supply stations shall meet the following conditions:

(1) Having a stable gas source that meets the national standards;

(2) Having a business place suitable for its business scale;

(3) Having fuel gas facilities and fire safety facilities that are suitable for the scale of operation and meet the relevant national standards and regulations;

(four) there are managers and technicians who meet the prescribed number and have passed professional training;

(5) Having sound rules and regulations and a safety responsibility system.

The establishment of a gas supply station shall be approved by the municipal gas management department, and the gas can be supplied only after the relevant registration is handled according to law.
