City, county (city) District People's government and its relevant departments shall incorporate road traffic safety accident hidden danger management, road traffic accident social assistance, road traffic safety publicity and education, road intelligent traffic construction and road traffic safety facilities construction into the road traffic safety management plan, and the required funds shall be included in the fiscal budget at the same level.
Development zone management agencies shall do a good job in road traffic safety in accordance with the provisions of these regulations.
Fourth city, county (city) District People's government traffic management departments of public security organs and equivalent traffic management departments of public security organs at the same level are responsible for the management of road traffic safety within their respective jurisdictions.
The relevant functional departments of production safety, transportation, planning, environmental protection, urban management, gardening, education, agriculture (agricultural machinery), health, quality and technical supervision, industry and commerce, and highway construction management shall, according to their respective functions and duties, do a good job in road traffic safety.
Article 5 The municipal and county (city) people's governments may employ road traffic safety coordinators to assist the traffic police in maintaining road traffic order.
Encourage units and individuals to provide voluntary services for road traffic safety, assist traffic police to maintain road traffic order, and publicize road traffic safety laws and regulations.
Sixth news, publishing, radio, television and other relevant units and media should strengthen the publicity of road traffic safety laws and regulations, broadcast road traffic safety management information, and guide the public to actively maintain traffic safety.
The traffic administrative department of the public security organ shall publish road traffic safety management measures through the Internet, news media and other channels, provide road traffic safety consultation, and release relevant road traffic safety information. Article 7 The pollutants discharged by motor vehicles shall meet the national and local standards for the discharge of motor vehicle pollutants. For vehicles that do not meet the emission standards of motor vehicles, environmental protection inspection marks shall not be issued, and the traffic management department of the public security organ shall not handle the corresponding registration procedures.
Motor vehicle environmental inspection mark shall be affixed to the upper right corner of the front windshield.
Article 8 For a non-motor vehicle that should be registered according to law, the owner shall, within 30 days from the date of purchasing the vehicle, go through the relevant registration formalities at the traffic management department of the public security organ with valid documents and vehicles. Those who are not registered according to law are not allowed to go on the road. Except as otherwise provided by laws and regulations.
Ninth units and individuals are prohibited from producing and selling non-standard cars.
Before the implementation of these regulations, non-standard vehicles that have handled temporary traffic signs can drive on the road within the validity period of the license; When driving on the road, you should carry a temporary pass with the vehicle and abide by the relevant provisions of motor vehicle traffic; If there are more than two motor vehicle lanes in the same direction, you should drive in the rightmost lane. Non-standard vehicles are not allowed to carry people; When loading, it shall be carried out in accordance with the provisions of non-motor vehicle loading.
Tenth urban areas to stop the registration of motorcycles, except for official needs. Motorcycles registered outside the urban area shall not move into the urban area for registration.
According to the road traffic safety situation, the Municipal People's Government may take restrictive measures for the passage of motorcycles, and the specific management measures shall be formulated separately.
Article 11 Vehicles engaged in transporting construction waste and ready-mixed concrete shall, in accordance with the provisions of the traffic administrative department of the public security organ, spray and hang enlarged number plates on the top of the cab, the body or the rear and side of the carriage.
The urban management department shall solicit the opinions of the traffic management department of the public security organ when approving the driving route and time of vehicles transporting construction waste.
Twelfth vehicle number plates and temporary traffic signs shall be hung in the specified position, and shall not be deliberately obscured or defiled, and shall be kept correct, clear and complete. It is forbidden to draw, invert, fold, overlap or engage in other acts that hinder the identification of license plates. It is forbidden to install or use variable number plates or other devices that affect the identification of traffic technical monitoring equipment.
It is forbidden to install and use devices that affect the normal use of traffic technology monitoring equipment on motor vehicles.
Thirteenth units engaged in motor vehicle rental business shall submit the vehicle information to the traffic management department of the public security organ for the record; Before signing the lease contract, the identity information and driving qualification of the motor vehicle lessee shall be checked, and the motor vehicle shall not be leased to a person without driving qualification for driving.
Fourteenth units and individuals shall have the following acts:
(1) changing the registration structure and structure of motor vehicles and non-motor vehicles without authorization;
(two) change, dismantle the speed limit device of electric bicycles or install power devices on human tricycles and bicycles;
(3) Forging, altering or using forged or altered non-motor vehicle number plates or non-motor vehicle registration certificates, temporary traffic signs or temporary passes for non-standard vehicles;
(four) the use of other vehicles' license plates, non-motor vehicle registration certificates, temporary traffic signs or temporary passes;
(five) driving a motor vehicle with electronic advertising devices or other signs that affect safe driving on the road;
(six) install spotlights, umbrellas and other equipment that affect traffic safety on vehicles.
The specific contents specified in Item (5) of the preceding paragraph shall be separately formulated by the traffic administrative department of the public security organ in conjunction with the urban management department.
Fifteenth drivers should check the safety and technical performance, vehicle number plate and amplification number of the vehicle before driving the vehicle on the road; Do not drive a vehicle with incomplete safety facilities, parts that do not meet the technical standards or hinder the identification number plate and amplification number.
Article 16 The traffic administrative department of the public security organ and the competent department of agriculture (agricultural machinery) shall establish an information sharing mechanism for tractors, modified tractors and drivers in registration, inspection, examination, verification, traffic violations and traffic accident handling.
The competent department of agriculture (agricultural machinery) shall, when handling the business of tractors, variant tractors and drivers, check the relevant information such as traffic violations and traffic accident handling, and shall not go through the corresponding registration and inspection procedures for untreated traffic violations and traffic accidents.
Seventeenth motor vehicle driver's contact information and motor vehicle owner's name, unit name, address, contact information and other information changes, it should be within thirty days after the change to the traffic management department of the public security organ for the record. Eighteenth new construction, renovation and expansion of urban roads, should be synchronized planning and design of intelligent traffic engineering, monitoring equipment, traffic lights, signs, markings and other traffic safety facilities, and synchronized with road construction projects. The planning, design, construction and completion acceptance of urban roads and road supporting facilities shall solicit the opinions of the traffic management department of the public security organ.
The planning and construction of urban parking lots (garages) shall conform to the road traffic conditions and meet the needs of vehicle parking.
Encourage unit parking lots (garages) to be open to the public.
Nineteenth on the road where traffic accidents are frequent or there are serious traffic safety hazards, the road management and maintenance department shall, in conjunction with the traffic management department of the public security organ, set up warning signs, deceleration or protective facilities.
The traffic administrative department of the public security organ shall, in conjunction with the safety production supervision department, put forward rectification opinions to the relevant responsible subjects in a timely manner if it finds that there are traffic safety hazards in the roads and supporting facilities that have been put into use; Report to the local people's government when necessary, and the local people's government shall make a decision in time.
Twentieth pipelines, lighting, billboards and other facilities and plants installed on both sides of the road and the isolation belt shall not affect the road traffic safety. Whether there is damage or insufficient lighting, as well as street lamps, traffic lights, traffic signs, etc. Obstruct the safe sight distance, affect the road traffic safety, transportation, construction, electric power, urban management, greening, communications, municipal and other relevant units shall promptly repair or eliminate.
Twenty-first units and individuals shall not occupy the road threshing, drying, stacking and other activities that hinder road traffic safety.
It is forbidden to dry articles on road traffic safety facilities.
Twenty-second because of the need to occupy or dig roads for engineering construction, it shall obtain the consent of the competent department of roads in advance; If traffic safety and traffic are affected, the consent of the traffic management department of the public security organ shall be obtained.
The construction unit shall set up safety warning signs and safety protection facilities at both ends of the construction section in accordance with relevant standards. If the vehicle needs to detour, a sign shall be set at the detour. After the completion of the construction, the obstacles on the road should be removed in time to eliminate potential safety hazards, and the traffic can be resumed only after the road authorities and the traffic management department of the public security organ have passed the inspection.
Twenty-third road operation units in road maintenance, maintenance, cleaning, greening and other operations, should take necessary traffic safety protection measures. Operators should wear eye-catching safety protective clothing and use vehicles sprayed or pasted with eye-catching reflective materials.
Road operation units operating in special sections such as elevated roads, overpasses and underpasses shall operate in accordance with the plan agreed by the traffic management department of the public security organ.
When carrying out rescue, rescue vehicles shall set up safety warning signs at the scene of the accident in accordance with the provisions of laws and regulations.
Twenty-fourth formulation and adjustment of bus and long-distance bus routes and stations, construction and transportation departments shall, in conjunction with the traffic management department of the public security organ, in accordance with the requirements of safety and smoothness. Article 25 The traffic administrative department of the public security organ may, according to road conditions and traffic needs, divide lanes according to vehicle types and set lane signs and markings.
Vehicles shall drive in the prescribed lanes, and shall not ride across the road center line or lane separation line, and shall not turn around at will.
Twenty-sixth vehicles and pedestrians should obey the traffic signals when driving in the auxiliary road or entering or leaving the auxiliary road; If the auxiliary road is not equipped with signal lights, it shall pass according to the main road signal lights.
Twenty-seventh vehicles in and out of villages, residential areas, schools, institutions, factories and other enterprises and institutions, should give priority to pedestrians and normal vehicles on the road.
Twenty-eighth in the setting of bus lanes on the road, the bus should travel in the lane; When turning or encountering obstacles, you can temporarily borrow other lanes, and you must drive back to the bus lane in time after turning or overtaking obstacles.
Bus lanes are only for buses and school buses, and other vehicles are not allowed to drive in bus lanes; Special vehicles such as police cars, fire engines, ambulances and engineering rescue vehicles that perform emergency tasks can borrow bus lanes to drive; Under special circumstances, other vehicles can borrow bus lanes under the command of the traffic police.
Article 29 When a motor vehicle passes through an intersection with a direction signal light and a turning waiting area, it shall enter the waiting area in turn and wait according to the signal instructions.
Thirtieth motor vehicle drivers shall abide by the following provisions:
(a) shall not lend or use other people's motor vehicle driver's license;
(two) obey the command of the traffic police, accept the inspection, and shall not leave the scene;
(3) No smoking, eating, wearing slippers, dialing and answering mobile phones, checking mobile phone information, watching TV and videos or other behaviors that hinder safe driving;
(four) motor vehicles really need to borrow non-motor vehicle lanes and sidewalks, and the speed should be less than twenty kilometers, and ensure safety;
(five) non tractor trailers shall not be used for freight purposes;
(6) A trailer or motor vehicle loaded with dangerous goods shall not be used to tow a faulty motor vehicle;
(seven) motorcycles, non-standard cars and electric bicycles are not allowed to tow or boost other vehicles;
(eight) when carrying children, children's safety seats suitable for their age should be used;
(9) Motor vehicles transporting employees to and from work shall stop at the place designated by the traffic administrative department of the public security organ;
(10) Forklifts and wheeled special-purpose mechanical vehicles shall run on the road according to the time and route specified by the traffic management department of the public security organ;
(eleven) motor vehicles are not allowed to let passengers get on or off while waiting for traffic signals or being stopped temporarily in front;
(twelve) no honking in urban areas;
(13) Take the initiative to avoid school buses, police cars, fire engines, ambulances and engineering rescue vehicles that perform tasks, and there shall be no obstruction, interference or rear-end collision;
(14) When driving on urban roads with street lamps at night, high beam lamps are not allowed, except in bad weather such as rain and fog.
Thirty-first vehicles shall comply with the following provisions:
(a) special motor vehicles, heavy and medium-sized trucks, heavy and medium-sized special operation vehicles, heavy and medium-sized full trailers, semi-trailers, wheeled special mechanical vehicles, low-speed trucks, three-wheeled vehicles, tractors, modified tractors and vehicles transporting dangerous goods are not allowed to enter the urban second ring road (excluding the second ring road);
(2) Large buses in other places, motorcycles outside urban areas and non-standard vehicles with temporary traffic signs outside urban areas are not allowed to enter roads and other restricted areas within the Second Ring Road (excluding the Second Ring Road) in urban areas;
(three) large and medium-sized buses in this city and medium-sized buses in other places are not allowed to enter the roads and other restricted areas within the urban first ring road (including the first ring road);
(four) trucks are not allowed to enter the urban area within the first ring road (including the first ring road);
(five) human flatbed, human tricycles are not allowed to enter the city within the first ring road (including the first ring road). It is forbidden to drive tricycles and animal-drawn vehicles on urban roads; When an animal-drawn vehicle is driving on other roads, it is not allowed to carry people except the driver.
If the above-mentioned vehicles really need to pass due to special circumstances, they shall be approved by the traffic management department of the municipal public security organ and run at the specified time and route.
Thirty-second elevated roads and overpasses, pedestrians and the following vehicles are prohibited:
(a) motorcycles, non-standard cars, wheelchairs for the disabled, electric bicycles, bicycles and other non-motor vehicles;
(2) Special motor vehicles, large and medium-sized special operation vehicles, wheeled special mechanical vehicles and vehicles transporting dangerous goods;
(3) Tractors and variant tractors;
(4) Freight vehicles and large passenger vehicles;
(5) Vehicles with temporary license plates for test vehicles.
Buses, unit buses and special motor vehicles engaged in the maintenance, repair and cleaning of elevated roads and overpasses are excluded.
Article 33 The traffic administrative department of the public security organ may, according to the road traffic conditions, determine the vehicles and areas where traffic is restricted and announce them to the public. In order to prevent and control air pollution, measures to restrict or prohibit the passage of motor vehicles that have obtained the yellow environmental protection inspection mark and motor vehicles that have not obtained the environmental protection inspection mark shall be agreed with the competent administrative department of environmental protection.
Thirty-fourth in the elevated road, overpass bridge deck or under the road, not to reverse or stop.
If a motor vehicle fails on an elevated road, overpass or underground passage, the driver shall move the motor vehicle to the right lane of the road or drive away nearby; If it is temporarily unable to move, it shall immediately turn on the hazard warning flash, set up warning signs, request rescue vehicles and wrecker to tow the faulty vehicles, and call the police quickly if necessary. People in the car are not allowed to move or stay in the driveway.
Thirty-fifth buses should follow the prescribed route, stop at the prescribed stop within 50 cm from the roadside, and leave immediately after boarding and alighting passengers. If it is necessary to temporarily adjust the driving route and stop due to special circumstances, the relevant departments shall obtain the consent of the traffic management department of the public security organ and make a timely announcement.
If more than one bus stops at the same station at the same time, it shall enter and leave the station in order of stopping.
Thirty-sixth taxis should be parked in accordance with the regulations, and when getting on and off passengers, they should be parked within 50 centimeters from the roadside. Where there is a designated parking place, you should stop at the designated parking place and leave immediately after boarding and alighting passengers.
Designated parking sections and parking places shall be uniformly designated by the traffic administrative department of the public security organ and announced to the public.
Other types of operating vehicles are not allowed to park, alight or wait for passengers on urban roads outside parking lots and stations.
Thirty-seventh non-motor vehicles passing through intersections controlled by traffic signals shall pass according to traffic lights, traffic signs and markings. When there is a stop signal, they should stop and wait, and they are not allowed to bypass the intersection. Non-motor vehicles are not allowed to cross the road without setting up non-motor vehicle lanes. When driving on the sidewalk where the traffic management department of the public security organ allows non-motor vehicles to pass, pedestrians should be avoided.
Non-lower limb disabled persons are not allowed to drive disabled motorized wheelchairs. Bicycles and electric bicycles can restrict a minor under the age of twelve when driving on urban roads. Other non-motor vehicles are not allowed to carry people when driving on urban roads.
Thirty-eighth pedestrians or passengers shall abide by the following provisions:
(a) shall not move, climb, cross, rely on road isolation facilities;
(two) shall not stay in the roadway, begging, selling goods, distributing promotional materials and other acts that hinder road traffic safety;
(3) No parking is allowed on the road sections where parking is prohibited and on the roadside in the retrograde direction;
(4) No pedestrians are allowed to cross the road;
(five) take good care of pets or other animals, and do not hinder traffic;
(six) knowing that the driver has not obtained a driver's license or drunk driving a motor vehicle, shall not drive a motor vehicle.
Article 39 No unit or individual may instigate, force or instruct others to drive a motor vehicle after drinking alcohol or taking psychotropic drugs and narcotic drugs under state control. Fortieth the traffic administrative department of the public security organ shall carry out publicity and education on road traffic safety laws and regulations to schools, enterprises and other relevant units every year.
State organs, social organizations, enterprises, institutions and other social organizations shall do a good job in traffic safety education and vehicle management of their own personnel, and establish and improve the internal responsibility system for traffic safety.
Article 41 The municipal, county (city) district people's governments and their relevant departments shall, in accordance with the principles of preventing and reducing traffic accidents and ensuring the smooth and safe road traffic, formulate emergency plans to deal with natural disasters, bad meteorological conditions, environmental pollution and other emergencies that affect road traffic safety.
Public security, production safety, transportation, environmental protection, health and other relevant departments shall formulate their own specific implementation plans according to the emergency plan. In case of any situation specified in the emergency plan, all relevant departments should immediately start the emergency plan, communicate and feedback information in time, and cooperate closely.
Forty-second due to poor management, raised animals caused by road traffic accidents, animal breeders or managers should bear the responsibility for the accident; If other parties are at fault, they shall bear corresponding responsibilities.
Article 43 If a party to a road traffic accident fails to go to the traffic administrative department of the public security organ for accident investigation without justifiable reasons, the traffic administrative department of the public security organ shall indicate it in the confirmation of the road traffic accident. Other parties may bring a civil lawsuit to the people's court on the issue of damages confirmed by road traffic accidents.
Forty-fourth after a traffic accident, a motor vehicle driver who commits one of the following acts shall bear full responsibility, except as otherwise provided by laws and regulations:
(1) Leaving the scene without justifiable reasons after reporting the case;
(2) sending the injured to the hospital and escaping;
(three) after the traffic accident, although he did not leave the scene, he refused to admit that he was the driver of the traffic accident vehicle, or found someone to be an impostor;
(four) after the traffic accident, the relevant matters can not be reached through consultation, or the compensation paid after consultation is obviously insufficient, and I left the scene without leaving my valid information.
Article 45 The traffic administrative department of the public security organ shall establish a reward system for reporting traffic accidents. If the report is true, the informant shall be rewarded and kept confidential.
Forty-sixth minor traffic accidents within the administrative area of this Municipality shall be dealt with quickly in accordance with the provisions of the traffic management department of the municipal public security organ. Article 47 The traffic administrative department of the public security organ shall promptly correct the illegal acts of road traffic safety and punish them according to law; If the illegal act is minor, the violator is willing to provide voluntary services for road traffic safety, or assist the traffic police in maintaining road traffic order and publicizing road traffic safety laws and regulations, he may be exempted from fines, unless otherwise stipulated by laws and regulations.
Forty-eighth in violation of the provisions of the second paragraph of Article 7 of these regulations, failing to paste the motor vehicle environmental inspection mark, the traffic management department of the public security organ shall order it to make corrections, and if it refuses to make corrections, it shall be fined one hundred yuan.
Article 49 Whoever, in violation of Article 8 of these regulations, drives a non-motor vehicle on the road without being legally registered by the traffic administrative department of the public security organ shall be given a warning or fined 50 yuan by the traffic administrative department of the public security organ, and the vehicle may be detained until the punishment is completed, and the parties concerned shall provide corresponding legal certificates.
Fiftieth in violation of the provisions of the first paragraph of Article 9 of these regulations, the production and sale of non-standard cars shall be punished by the quality and technical supervision or the industrial and commercial departments according to law.
In violation of the provisions of the second paragraph of Article 9 of these regulations, driving a non-standard car on the road, under any of the following circumstances, the traffic administrative department of the public security organ shall impose a fine on 200 yuan, and may detain the vehicle:
(1) No temporary traffic signs have been obtained or the temporary traffic signs have expired;
(2) Failing to carry a temporary pass with the vehicle;
(three) not according to the provisions of the lane;
(four) in violation of the provisions of manned cargo.
Article 51 In violation of the provisions of the first paragraph of Article 11 of these regulations, vehicles engaged in transporting construction waste, ready-mixed concrete, etc. fail to spray or hang enlarged number plates in accordance with the provisions, the traffic administrative department of the public security organ shall order it to make corrections and impose a fine on 200 yuan.
Article 52 whoever, in violation of the provisions of Article 12 of these regulations, hangs the license plate, temporary traffic sign or device installed and used by motor vehicles and non-standard vehicles on the road, in any of the following circumstances, shall be fined 200 yuan to the driver; The traffic administrative department of the public security organ shall forcibly dismantle and confiscate the illegal devices, and may detain the vehicles until the illegal state is eliminated:
(a) not hanging in the specified position or deliberately blocking or defacing;
(2) Failing to keep the number plate straight, clear and complete, or having graffiti, inversion, folding or overlapping, or having other behaviors that hinder the identification of the number plate;
(three) the installation and use of variable number plates or other identification devices that affect traffic technology monitoring equipment;
(four) the installation and use of devices that affect the normal use of traffic technology monitoring equipment.
If a non-motor vehicle driving on the road is under any of the circumstances listed in the preceding paragraph, the traffic administrative department of the public security organ shall order the driver to correct it immediately and impose a fine of 30 yuan.
If it is the responsibility of the vehicle owner or manager, the vehicle owner or manager shall be punished.
Fifty-third in violation of the provisions of the first paragraph and the second paragraph of article fourteenth of this Ordinance, without changing the motor vehicle registration structure, a fine of five hundred yuan shall be imposed; Without changing the structure and structure of non-motor vehicle registration, changing or removing the speed limit device of electric bicycles, or installing power devices on human tricycles and bicycles, a fine of fifty yuan will be imposed. In case of the above-mentioned acts, the traffic administrative department of the public security organ shall order it to correct immediately, and may detain the vehicle until the illegal state is eliminated.
Whoever, in violation of the provisions of Item (3) and Item (4) of Paragraph 1 of Article 14 of this Ordinance, forges, alters or uses the license plates, registration certificates, temporary traffic signs or temporary passes of other non-motor vehicles and non-standard vehicles that are forged, altered or used shall be confiscated by the traffic control department of the public security organ, and a fine of 50 yuan shall be imposed on non-motor vehicle violations and 200 yuan shall be imposed on non-standard vehicle violations.
Whoever, in violation of the provisions of Item 5 and Item 6 of Paragraph 1 of Article 14 of these Regulations, drives a motor vehicle equipped with electronic advertising devices or other signs affecting safe driving on the road and installs spotlights shall be ordered by the traffic administrative department of the public security organ to make corrections and be fined 200 yuan.
Article 54 If, in violation of the provisions of the first paragraph of Article 20 of these regulations, pipelines, lighting, billboards and other facilities or plants planted on both sides of roads and isolation belts are damaged or lack of lighting, and street lamps, traffic lights and traffic signs are damaged, which hinders the safe sight distance and affects the road traffic safety, the traffic administrative department of the public security organ shall order the perpetrator or the relevant responsible unit to promptly remove the obstruction or repair it. Refuses to implement, punishable by a fine of five hundred yuan and one thousand yuan; If the circumstances are serious, a fine of not less than 1,000 yuan but not more than 2,000 yuan shall be imposed, and the obstruction shall be removed or repaired in a timely manner, and the expenses required shall be borne by the actor or the relevant responsible unit.
In violation of the provisions of the second paragraph of Article 20 of this Ordinance, without the consent of the traffic administrative department of the public security organ, drying articles on the road traffic safety facilities or hanging banners or setting signs on the traffic isolation guardrail, the traffic administrative department of the public security organ shall forcibly remove obstacles and impose a fine of 200 yuan on the perpetrator.
Whoever, in violation of the provisions of Article 21 of these regulations, occupies roads for threshing, drying goods, stacking goods or carrying out other activities that hinder road traffic safety shall be forcibly removed by the traffic administrative department of the public security organ.
Fifty-fifth in violation of the provisions of article twenty-second, article twenty-third, affecting road traffic safety, under any of the following circumstances, the traffic administrative department of the public security organ shall order the perpetrator to stop the illegal act; Whoever commits the first and fifth acts may be fined between two hundred yuan and one thousand yuan:
(1) occupying or digging roads without the consent of the traffic administrative department of the public security organ;
(two) the construction unit did not set up obvious safety warning signs and safety protection measures at both ends of the construction section or did not set up signs on the bypass section;
(3) When the road operation unit carries out maintenance, repair, cleaning and greening operations on the road, it fails to take necessary traffic safety protection measures or uses vehicles sprayed or pasted with eye-catching reflective materials;
(four) after the completion of the construction, without the acceptance of the road authorities and the traffic management department of the public security organ, the traffic is resumed without authorization;
(five) road operation units in the elevated roads, overpasses, underpasses and other special sections of the operation, without the consent of the traffic management department of the public security organ.
Article 56 In violation of the provisions of Article 29 of these regulations, if the turning vehicles do not enter the waiting area in turn when the intersection of the turning waiting area is set up and the straight vehicles in the same direction are released, the traffic management department of the public security organ shall order them to make corrections and may impose a fine of 100 yuan.
Article 57 In violation of the provisions of Item (10) of Article 30 of these regulations, forklifts and wheeled special-purpose mechanical vehicles fail to travel on the road at the time and route specified by the traffic administrative department of the public security organ, which shall order them to make corrections and impose a fine of 100 yuan.
Article 58 If, in violation of the provisions of Article 33 of these regulations, a motor vehicle that has obtained the yellow environmental protection inspection mark or failed to obtain the environmental protection inspection mark enters the no-go zone, the traffic administrative department of the public security organ shall order the driver to drive out of the no-go zone and impose a fine of 100 yuan.
Article 59 Whoever, in violation of the provisions of Article 35 and Article 36 of these regulations, drives or parks various operating vehicles such as buses and taxis in violation of the provisions shall be fined 100 yuan by the traffic management department of the public security organ.
Article 60 Anyone who, in violation of the provisions of Article 37 and Article 38 of these regulations, enters the underground passage by non-motor vehicles or pedestrians shall be ordered by the traffic administrative department of the public security organ to make corrections and be given a warning or a fine of 50 yuan.
In violation of the provisions of Item 1 and Item 2 of Article 38 of these regulations, pedestrians or passengers move, climb, cross, lean on road isolation facilities or stop, beg, sell goods, distribute publicity materials and have other acts that hinder road traffic safety. The traffic administrative department of the public security organ shall order it to make corrections and impose a warning or a fine on 50 yuan.
Article 61 Anyone who drives a motorcycle, a non-standard car, a wheelchair for the disabled, a human tricycles, a non-motor vehicle equipped with a power plant or carries a person in violation of regulations on the roads that are forbidden to pass in urban areas may detain the vehicle and be punished according to law.
Article 62 If a low-speed truck, tricycle, tractor or modified tractor violates the provisions on road traffic safety management and the non-motor vehicle driver refuses to accept the fine, the traffic control department of the public security organ may detain the vehicle.
Article 63 If the driver, owner or manager of the vehicle detained by the traffic administrative department of the public security organ according to law refuses to accept the treatment within the prescribed time limit and cannot return it according to law due to the reasons of the parties concerned, the traffic administrative department of the public security organ may auction, dismantle, scrap or disintegrate the vehicle according to law.
Article 64 The traffic administrative department of the public security organ may punish the illegal motor vehicle driver or owner or manager according to law for the traffic safety violations identified by the information obtained through traffic technology monitoring and detection equipment such as photography, video recording, speedometer, alcohol tester, weighing instrument and automatic recording system for traffic violations.
Article 65 If the traffic administrative department of the public security organ and its traffic police fail to strictly enforce the law or violate the law and discipline, corresponding administrative sanctions shall be given to the directly responsible person in charge and other directly responsible personnel in accordance with Article 115 of the Road Traffic Safety Law of the People's Republic of China.
Article 66 If the traffic administrative department, production safety, transportation, planning, environmental protection, urban management, gardening, education, agriculture (agricultural machinery), health, quality and technical supervision, industrial and commercial departments of public security organs, development zone management agencies and their staff fail to perform relevant duties, resulting in major traffic accidents or other serious consequences, the directly responsible person in charge and the directly responsible person shall be given corresponding administrative sanctions according to law. Article 67 Non-standard vehicles mentioned in these Regulations refer to wheeled vehicles or machinery driven and towed by power devices (including all two-wheeled, three-wheeled, four-wheeled and multi-wheeled vehicles or machinery) whose vehicle elements, such as design maximum speed, empty mass and overall dimensions, do not meet the national standards for non-motor vehicle products or motor vehicle products.
The "elevated roads" as mentioned in these Regulations refer to roads that maintain a certain space with the ground and ground connecting roads that are included in the traffic management of elevated roads.
The scope of urban roads as mentioned in these Regulations shall be determined and promulgated by the Municipal People's Government according to the economic and social development of this Municipality.
Article 68 These Regulations shall come into force as of 20 14 1+0. On August 20, 2004, the 11th meeting of the Standing Committee of the Tenth People's Congress of Anhui Province approved the Regulations of Hefei on Urban Road Traffic Safety Management, which shall be abolished at the same time.
