Notice of Dalian Municipal People's Government on Printing and Distributing the Interim Provisions of Dalian Municipality on the Administration of Public Information Network

Chapter I General Provisions Article 1 In order to strengthen the management of public information networks, ensure the safe and orderly operation of public information networks, promote the development and utilization of information resources, and improve the service level of information socialization, these provisions are formulated in accordance with the relevant provisions of the state, provinces and municipalities and in light of the actual situation of Dalian. Article 2 All units and individuals that use public information networks to exchange, transmit, provide and use information, or engage in public information network operation and network interconnection (including international networking) within the administrative area of Dalian shall abide by these provisions. Article 3 The term "public information network" as mentioned in these Provisions refers to the national information network within the administrative area of Dalian and the information network built by various organs, organizations, enterprises and institutions to provide various information services for the public. Article 4 Dalian Information Industry Bureau is the working body of the Municipal People's Government to manage the city's information construction and information industry development. According to the functions set by the municipal government, responsible for the planning and construction of the city's public information network, as well as the examination and approval of the operation of public information network, the formulation of information technology standards and norms, and consulting services.

Dalian Public Security Bureau is in charge of the security protection of the city's computer information system.

Radio and television, industry and commerce, security, price, copyright, culture and other departments, according to their respective responsibilities, * * * do a good job in public information network management. Article 5 The construction of public information network shall adhere to the principles of overall planning, unified management, co-construction and sharing, network interconnection and avoiding redundant construction, continuously strengthen the construction of information infrastructure, rationally develop and utilize information consultation, develop information industry and improve information service system.

Information exchange platforms within the administrative area of this Municipality shall be interconnected.

The public information network provides services for the society, and on the basis of ensuring the public welfare, practicality, fairness, openness and cooperation of the network, it can implement paid services. Chapter II Operation and Management of Public Information Networks Article 6 The operation of public information networks shall be subject to a licensing system. Units engaged in public information network operation (including individual industrial and commercial households) shall apply to the Municipal Bureau of Information Industry for an office information network operation license and go through the registration formalities with the administrative department for industry and commerce. Has obtained the license issued by the state and the province, should be filed with the Municipal Information Industry Bureau.

The public * * * information network operating units shall implement the licensing annual inspection and annual report system. Seventh public information network operating units engaged in public information network operation activities, shall comply with the following provisions:

(a) the implementation of relevant laws, regulations and rules, and accept the guidance and supervision of the Municipal Information Industry Bureau;

(two) strictly implement the security system, do a good job in network information security management, and provide users with safe and reliable services;

(three) to organize users to surf the Internet under unified technical specifications, and to be responsible for the technical guidance and training of network users and the management of network interconnection technical interfaces;

(four) strictly fulfill the service contract, provide users with a safe, convenient and fast network environment, and ensure the normal operation and maintenance of the public information network;

(five) other matters stipulated by laws, regulations and rules. Article 8 Users shall apply to the public information network operation unit for Internet access, and the public information network operation unit shall arrange Internet access.

The fees charged by public information network operators to users must strictly abide by the relevant provisions of the state. Chapter III Management of Information Resources Article 9 Information resources consist of computer application systems and databases. The construction of computer application system should be carried out in strict accordance with the unified planning of the whole city. Within the unit, the competent business department is responsible for the organization and unified implementation; Inter-departmental and inter-regional projects shall be jointly constructed and developed in accordance with relevant national, provincial and municipal standards.

The construction of computer application system should make full use of public information network, and no special network will be set up unless approved by the municipal government. The established private network shall be interconnected with the public information network, except those involving state secrets. Article 10 Units and individuals that develop information resources shall abide by the following provisions:

(a) in line with the information resources development plan approved by the municipal government;

(two) the private network has been built, and the public information resources developed should be released to the public through the public information network;

(three) the use of public information network to build an internal network, technical isolation measures should be taken to protect the safety of internal information resources;

(four) government agencies and organizations shall not use public information resources to engage in business activities. If the market really needs it, it should be operated by enterprises and institutions and strictly isolated from internal information resources;

(5) Internal information resources shall not be published as public information resources, and public information resources shall not be published as internal information resources. Eleventh units and individuals are encouraged to engage in information resources development and business activities to promote the development of information service industry. Chapter IV Security and Confidentiality Management of Public Information Networks Article 12 Information providers shall be responsible for the legality, authenticity, accuracy and security of information on public information networks. Thirteenth public information network operating units and users shall abide by the following confidentiality provisions:

(1) The information content accessed by users on the Internet shall be subject to confidentiality review by users and network centers to ensure that the information accessed on the Internet does not involve state secrets;

(2) Computer application systems involving state secrets are not allowed to access international information networks or public information networks, and are completely isolated from public information networks;

(three) shall not store, process or transmit information involving state secrets in the public information network;

(four) the public information network operating unit shall formulate the network security management system, and be responsible for educating users on information security. Once the leakage problem is found, measures should be taken to remedy it in time and report to the relevant departments;

(five) other information confidentiality provisions stipulated by laws, regulations and rules.
