Detailed Rules for the Implementation of Double Random and One Open Supervision of Chuzhou Public Utilities Administration Bureau of Anhui Province (for Trial Implementation)

Article 1 In order to deepen the reform of "simplifying administration and decentralizing power, strengthening supervision and improving services", strengthen the supervision of "double randomness and one openness", standardize inspection procedures and strictly inspect behaviors, these Detailed Rules are formulated in accordance with the requirements of relevant laws, regulations and policies and in light of the actual situation.

Article 2 The term "double random and one open" supervision as mentioned in these Detailed Rules refers to the supervision and management behavior of the Municipal Public Utilities Bureau, which randomly selects inspection objects, randomly selects law enforcement inspectors, and discloses the inspection results to the public in a timely manner.

Article 3 The "double random and one open" supervision shall follow the principles of legality, openness, fairness and impartiality.

Article 4 "Double Random and Open" supervision shall realize standardization of supervision contents, standardization of supervision methods, informationization of supervision means and openness of supervision process.

Article 5 The Municipal Administration Bureau shall, at the beginning of each year, formulate an annual "double random open" random spot check list and annual spot check plan according to the provisions of the Municipal Administration Bureau, such as the functional allocation, internal organization and staffing, administrative power list and responsibility list.

Spot check list and annual spot check plan shall include the name of spot check task, spot check items, spot check subjects, spot check objects, spot check proportion, spot check time, etc. The list of spot checks and the annual spot check plan shall be made public to the public on the portal website of the Municipal Public Utilities Bureau, except that laws, regulations and provisions are not made public.

Article 6 The Municipal Administration Bureau shall establish a database of public resources trading projects and a directory of law enforcement inspectors. The directory database of law enforcement inspectors mainly includes the name, gender, position, work unit and contact telephone number of law enforcement inspectors.

Seventh departments to carry out law enforcement inspection shall set up an inspection team, which shall be responsible for the team leader, and the inspection team shall have at least 2 staff members. The members of the inspection team were randomly selected from the law enforcement inspector list. Conduct joint inspection with other departments, and the team leader shall be the personnel of other departments, and the personnel shall be randomly selected to participate.

Once the selected law enforcement inspectors are determined, they will not be replaced in principle. If the selected law enforcement inspectors have an interest in the object of inspection, they should take the initiative to avoid it.

Eighth according to the "double random, double open" supervision work needs, the undertaking department may invite relevant experts to assist law enforcement inspectors to carry out inspection work.

Article 9 The undertaking department shall determine the inspection objects by random sampling according to the spot check list and annual spot check plan. For cases assigned by superiors and cases with more complaints and reports, the inspection objects can be directly determined, and the proportion and frequency of spot checks can be increased.

Tenth "double random, one open" general inspection items include tender announcement, tender documents, qualification examination, bid opening, bid evaluation and calibration, objection reply, bidding agency and other key links and carriers, and the sampling ratio is not less than 20% of the total number of inspection objects.

Where laws and regulations clearly stipulate the proportion and frequency of spot checks, such provisions shall prevail.

Eleventh before the implementation of the specific inspection tasks, the undertaking department should make overall arrangements for the division of labor and time schedule, and can conduct centralized study and training before the implementation of the inspection, and clarify the inspection focus and related requirements.

Twelfth before the implementation of specific inspection behavior, inspectors should first identify themselves, produce valid certificates, and explain the inspection basis, inspection content and inspection methods. , and inform the inspection object of the obligation to cooperate with the inspection and the corresponding legal responsibilities.

Thirteenth law enforcement inspectors shall, in accordance with the contents and methods of the random inspection list and the annual random inspection plan, conduct inspections by consulting materials, inspecting the site, asking the parties and insiders.

After the inspection, the law enforcement inspectors shall truthfully fill in the checklist and sign it by the relevant personnel.

Fourteenth law enforcement officers found problems that can be corrected immediately during the inspection, they should give feedback on the spot and order them to correct in time. If it is found that violations of laws and regulations need to be further investigated and dealt with according to law, it is necessary to do a good job in investigation and evidence collection, fixed evidence, rectification within a time limit and follow-up treatment.

Need to be transferred to other departments for investigation and handling, it shall issue a proposal for the transfer of law enforcement inspection.

Fifteenth inspection results shall be published within 20 working days from the date of inspection on the portal website of the Municipal Administration Bureau.

Article 16 The Municipal Public Utilities Bureau shall, jointly with the relevant industry authorities, establish and improve the application mechanism of linking the results of spot checks with credit evaluation in accordance with the principle of "encouraging by keeping promises and punishing by breaking promises".

Seventeenth "double random and open" supervision work found that law enforcement inspectors have violations of discipline, depending on the seriousness of the case, in accordance with the relevant provisions, according to the law. Suspected of illegal crimes, the clues of illegal crimes shall be handed over to the relevant authorities for handling according to law.
