Taxation, industry and commerce, technical supervision, auditing, finance, supervision and other departments shall, in accordance with their respective responsibilities, cooperate with the competent pricing department to do a good job in the management of operating and service charges. Chapter II Government Pricing Behavior Article 6 Government pricing behavior includes setting (including adjustment, the same below) the benchmark price, floating range and pricing method of business service charging standards with government guidance price; Formulate charging standards and pricing methods for business services that are subject to government pricing. Article 7 The government may, when necessary, implement government-guided prices or government pricing for the following business services:
(a) monopoly, compulsory and protective business services as stipulated by laws, regulations or the provincial people's government;
(2) Important public utility service projects;
(3) Important public welfare service projects. Article 8 The pricing authority and specific scope of application of government-guided prices and government pricing shall be subject to the local pricing catalogue formulated by the provincial people's government.
The competent price department of the provincial people's government and other relevant departments shall, in accordance with the pricing authority and specific scope of application stipulated in the local pricing catalogue, formulate government-guided prices and government pricing for operating service projects. Other relevant departments of the provincial people's government to develop government-guided prices, government pricing business services, the competent price department shall, within 0/0 days after pricing, submit relevant materials to the competent price department of the provincial people's government for the record. Article 9 The government-guided prices and government-set charging standards for business service projects shall be reasonably determined according to their average social costs, market supply and demand and social affordability. Tenth provincial people's government departments in charge of prices and other relevant departments shall follow the law of value, timely adjust the government-guided prices and government-set charging standards for business service projects, and reflect the changes in service costs and market supply and demand. Article 11 The opinions of consumers, business operators and other relevant parties shall be listened to when formulating the service charge standards set by the government and guided by the government. When formulating the charging standards for important commercial services involving the vital interests of the masses, a hearing shall be held. Article 12 The competent pricing department of the government and other relevant departments shall, within 30 days, inform the proposer of the suggestions for adjusting the government-guided prices and government-set prices of business services put forward by operators and consumers. Thirteenth government-guided prices, government-set business service fees, fees by the department in accordance with the provisions of the competent price department of the State Council announced to consumers and operators. Chapter III Charging Behavior of Operators Article 14 Operators shall respect consumers' voluntary choice of service items and service prices, and shall not force consumers to accept services against their will in any form. Fifteenth operators shall enjoy the following rights:
(a) independently set the market-adjusted service charge standard;
(two) for the implementation of government-guided business services, formulate specific charging standards within the prescribed charging range;
(three) to put forward suggestions for adjusting the charging standards for business services that are guided by the government and set by the government;
(four) to report and accuse acts that infringe upon their legitimate rights and interests;
(5) Other rights granted by laws and regulations. Article 16 An operator shall perform the following obligations:
(a) abide by the laws, regulations and rules of price;
(two) the implementation of government guidance and government pricing;
(three) to apply for a license for business service charges in accordance with the provisions, and to produce a certificate of charges;
(four) to provide relevant information such as operating costs and expenses required for supervision and management to the competent price department of the government;
(five) the implementation of the provisions of the price tag, a one-time truthfully issue legal bills to consumers, and issue a list of consumption;
(six) other obligations stipulated by laws and regulations. Seventeenth operators shall not have the following acts of unfair charges:
(a) crowding out competitors or monopolizing the market, providing services at a price lower than the operating cost, disrupting the normal production and operation order, and damaging the national interests or the legitimate rights and interests of other operators;
(2) colluding with each other to manipulate market prices and harming the legitimate rights and interests of consumers and other business operators;
(3) Tricking consumers and other business operators into trading with them by false or misleading price means;
(four) reduce the quality of service, improve the service charges in disguise;
(five) in addition to the price tag, no additional fees are indicated;
(six) profiteering in violation of laws and regulations;
(seven) other acts of unfair charges prohibited by laws and regulations.
