Has the loan from Shanghai Yuqiao Cui Bo been completed?

This project is the third phase project of Yisheng Yunjinyuan of Haidong Real Estate. The first and second phases of this project were not completed because of the thunder of Shanghai three sheng Real Estate, the parent company of Haidong Real Estate. Under the coordination of relevant government departments, Jinke Real Estate introduced the third phase, obtained the pre-sale permit on March 2, 2022, and opened the subscription on March 6-12. In view of the unfinished business in the first and second phases, the developers Shanghai Haidong Real Estate Co., Ltd. and Shanghai Judas Economic Development Co., Ltd. signed the Fund Supervision Agreement with Kangqiao Town People's Government of Pudong New Area, Shanghai Chen Hao Law Firm and Shanghai Real Estate Transaction Fund Management Co., Ltd., the manager of entrusted fund supervision account, on March 22, 2022 (see annex for details). The general content is that the third phase of the project is earmarked for special purposes, and the sales expenses of the third phase are limited. When the real estate sales supervision agreement is announced, buyers can buy with confidence.

In this context, on June 10- 12, the third phase of Yisheng Yunjinyuan Project opened for sale. There are 5 12 suites in 555 suites. After that, according to the requirements of Haidong Real Estate, buyers will pay the house payment one after another before June 20, and go through the formalities of mortgage loan and online signing as needed. On August 5, buyers began to get the original pre-sale online signing contract signed and sealed by the developer. However, some property buyers have never signed online before, and the excuse given by developers is "no online signing quota". Later, the owner inquired in the real estate trading center that some of the houses subscribed by the owner had been sealed up, and some houses were sealed up by the court on March 22, and there was a waiting list for sealing up after July (see annex 1- production adjustment for details). Other customers who have signed online have also inquired at the real estate trading center and found that the houses that have been pre-ordered online have also been seized by the court. Later, the owners learned that these houses were sued by Haidong real estate creditors and sealed up by Shanghai Pudong New Area People's Court and Shanghai No.1 Intermediate People's Court.

As a well-known uncompleted residential flats in Pudong, the pre-subscription of Yisheng Yunjinyuan Phase III was very low. Later, in order to attract buyers to subscribe, developers publicly displayed the fund supervision agreement in the sales office. Most property buyers participated in the subscription out of trust in the four-party fund supervision agreement, especially the people's government of Kangqiao Town, Pudong New Area, Shanghai, as the project manager, and completed the subsequent subscription payment for house selection as required.

At present, according to preliminary statistics, there are 17 suites for the houses that have not been signed online, 43 sets of unapproved houses have been sealed up, and many houses that have been signed online have also been sealed up. Due to the existence of seizure, there is great uncertainty in the purchase funds and housing delivery. The buyer hopes to get the reply of Kangqiao Town People's Government in Pudong New Area to the following questions:

1. Why can the house sealed up by the court on March 22nd be approved by the relevant functional departments and pre-sold to the buyers in June through online house selection, and the house selection activity is "supervised by Shanghai Pudong New Area Construction and Transportation Committee, associated with Shanghai Pudong New Area Housing Information Center" and notarized by Shanghai Oriental Notary Office on the spot (see Annex 3- House Selection Rules for details)? In this process, is there any behavior that developers cheat property buyers in violation of laws and regulations? Is there any dereliction of duty in the pre-sale related regulatory authorities?

2. Follow-up measures and related schedules of the seized houses. How to ensure that it will not be seized continuously?

3. Since the construction of this building stopped in March, there has been no sign of resumption of work, and the developer is urged to give a clear timetable and progress for resumption of work.

4. Publicize the fund supervision agreement, and strictly abide by it. The principle of giving priority to the third phase remains unchanged, and ensure that the third phase delivery (including housing delivery and real estate license handling) is higher than the remaining problems (solving difficulties and paying debts, etc.). )
