Regulations on the Administration of Hunchun Border Economic Cooperation Zone

Chapter I General Provisions Article 1 In order to speed up the construction of Hunchun Border Cooperation Zone, develop foreign trade and economic and technological cooperation, and promote the prosperity and stability of border areas, these Regulations are formulated in accordance with relevant state laws and regulations. Article 2 The Hunchun Border Economic Cooperation Zone as mentioned in these Regulations (hereinafter referred to as the Cooperation Zone) refers to the Hunchun Border Economic Cooperation Zone approved by People's Republic of China (PRC) and the State Council. The cooperation zone is located in the south of Hunchun City, Yanbian Korean Autonomous Prefecture. Article 3 These Regulations shall apply to the development, construction and management of the cooperation zone. Article 4 The Cooperation Zone encourages Chinese and foreign investors to set up export processing industries, high-tech industries and corresponding tertiary industries in the Cooperation Zone to develop an export-oriented economy. Article 5 The cooperation zone provides a good investment environment and working and living conditions for domestic and foreign investors. Provide water supply, power supply, drainage, communication and other infrastructure, public facilities, service facilities and information consulting services for the establishment of enterprises. Article 6 Employees of enterprises and institutions in the cooperation zone have the right to establish trade union organizations and carry out trade union activities according to law. Article 7 The investment, property, income and other lawful rights and interests of investors in the Cooperation Zone shall be protected by the laws of People's Republic of China (PRC). All units and individuals in the cooperation zone must abide by the laws, administrative regulations and local regulations of People's Republic of China (PRC). Chapter II Management Article 8 The Management Committee (hereinafter referred to as the Management Committee of the Cooperation Zone) shall be established in the Hunchun Border Economic Cooperation Zone to conduct unified leadership and management of the economic and administrative affairs of the Cooperation Zone on behalf of the Hunchun Municipal People's Government. The Management Committee of the Cooperation Zone has the provincial-level economic management authority granted by the Jilin Provincial People's Government to Hunchun City. Article 9 The Administrative Committee of the Cooperation Zone shall exercise the following functions and powers:

(a) according to the provisions of national laws, regulations and these regulations, formulate various administrative rules and regulations of the cooperation zone;

(two) the preparation of the overall planning and economic and social development plan within the administrative area of the cooperation zone, and organize the implementation after approval;

(three) to make overall arrangements for investment projects in the cooperation zone, and to examine and approve investment projects in the cooperation zone according to the authority prescribed by the state and the province;

(four) responsible for the planning, requisition, development and management of land in the cooperation zone;

(five) responsible for the financial, state-owned assets, taxation, labor and personnel and industrial and commercial administration in the cooperation zone;

(six) planning and management of infrastructure and public facilities in the cooperation zone, and management of urban construction;

(seven) to establish and manage public utilities such as culture, education, health and sports in the cooperation zone;

(eight) responsible for environmental protection in the cooperation zone;

(9) Handling the foreign affairs of the cooperation zone and managing the import and export business of the cooperation zone in accordance with state regulations;

(ten) to coordinate the work of the branches of finance, insurance, foreign exchange management, customs, commodity inspection and other departments in the cooperation zone;

(eleven) to supervise the enterprises and institutions in the cooperation zone according to law;

(twelve) responsible for the social security and household registration management in the cooperation zone, protect the person and property in the cooperation zone from infringement according to law, and mediate the relevant disputes in the cooperation zone;

(thirteen) in accordance with the provisions of the authority to appoint and remove, hire and reward and punish the staff of the CMC organs and subordinate units;

(fourteen) other functions and powers granted by the superior government. Article 10 The Administrative Committee of the Cooperation Zone may, according to the needs of development and construction, set up a number of functional departments upon approval in accordance with the principle of high efficiency and lean, and be specifically responsible for various administrative affairs of the Cooperation Zone. Eleventh financial, insurance, foreign exchange management, customs, commodity inspection and other departments can set up branches or agencies in the cooperation zone to handle related affairs. Twelfth cooperation zone land examination and approval authority, in accordance with the provincial people's Congress Standing Committee on the provincial land examination and approval authority delegated to the Hunchun Municipal People's government. Chapter III Investment and Operation Article 13 The investment and operation of the cooperation zone may take the following forms:

(1) Sino-foreign joint ventures;

(2) Sino-foreign cooperative operation;

(3) foreign capital operation;

(4) Domestic enterprises and other economic organizations or individuals operate independently or jointly;

(5) Processing with supplied materials, processing with supplied samples, assembling with supplied parts and compensation trade;

(6) lease operation;

(seven) to buy bonds and stocks in the cooperation zone;

(8) Other ways permitted by laws and regulations of People's Republic of China (PRC). Article 14 The Cooperation Zone encourages the establishment of the following projects:

(1) Export processing industry;

(2) High-tech industries;

(3) products can replace imports;

(4) Energy, transportation and tertiary industry. Article 15 The following items are prohibited in the cooperation zone:

(a) backward technology or outdated equipment;

(two) the discharge of pollutants exceeds the statutory standards;

(3) It is explicitly prohibited by the state. Article 16 Chinese and foreign investors who invest and set up enterprises and institutions in the Cooperation Zone shall apply to the Management Committee of the Cooperation Zone, and after examination and approval, they shall go through relevant procedures such as land use, industrial and commercial registration and tax registration respectively before starting business. Seventeenth approved construction projects, the construction unit must invest funds and start construction within the prescribed time limit. Can not be scheduled to invest funds, start construction, with the consent of the original approval unit, can be extended; If the time limit is exceeded without approval, the land use right shall be recovered and its land use certificate shall be cancelled.
