The principle of unified leadership and hierarchical management shall be implemented in road administration. National, provincial and toll roads are the responsibility of the municipal transportation department, and county and township roads are the responsibility of the district transportation department.
The traffic administrative department may entrust the highway management organization to exercise the duties of road administration and impose administrative penalties in accordance with these Provisions.
Planning, land, water conservancy, forestry, public security, industry and commerce and other relevant departments shall, according to their respective functions and duties, do a good job in road administration. Article 5. Due to the needs of construction, digging, occupying roads or crossing or crossing roads on national and provincial roads must be reported to the municipal transportation department for approval in advance, and reported to the district transportation department for approval in advance on county roads and township roads; If traffic safety is affected, the consent of the public security department must be obtained. If the traffic is interrupted, the traffic management department and the public security department will jointly issue an announcement.
Units and individuals that have been approved to carry out construction operations shall set up obvious warning signs at the scene, and repair roads and restore traffic within a specified time limit. Article 6 When a construction unit or individual adds a level crossing on a highway, it must obtain the consent of the district traffic department in advance, submit the crossing design drawings and other materials, and report to the municipal traffic department for approval before construction can be carried out in accordance with the technical standards for highway engineering. Article 7 The following acts are prohibited within the scope of highways and their land use:
(a) set up shacks, stalls, farmers' markets, gas stations, maintenance yards, parking lots, etc. ;
(two) stacking items and dumping garbage;
(3) Taking soil, quarrying, composting, blank making, kiln burning, planting crops, stocking livestock, digging ditches to divert water, blocking culverts, threshing and drying grain;
(four) the goods on board are dragged on the ground or scattered or leaked;
(five) other acts of occupation, destruction and pollution of highways and highway land. Article 8 No unit or individual may, without authorization, set up signs, billboards and other signs other than highway signs within highways and land used for highways; If it is really necessary to set up, national and provincial roads shall be approved by the municipal transportation department, and county roads and township roads shall be approved by the district transportation department. Article 9 The planned new towns, development zones, residential areas and farmers' markets shall keep a prescribed distance from the highways, and give way on both sides of the highways accordingly to prevent the highways from becoming streets and lanes.
It is strictly forbidden to change the nature of highway use without authorization; If it is really necessary to change the nature of highway use, it must be approved by the municipal department in charge of transportation, approved by the provincial department in charge of transportation, and go through the formalities for changing highway property rights according to law. Tenth transportation departments should strengthen the management of building control areas on both sides of the highway. The building control area is calculated from the outer edge of the highway side ditch: national highway is not less than 20m, provincial highway is not less than15m, county road is not less than10m, and township road is not less than 5m; Road bends, grade crossing and the inner side of urban entrances and exits, national roads are not less than 30m, provincial roads are not less than 25m, county roads are not less than 20m, and township roads are not less than10m; The scope of the building control zones on both sides of expressway shall be determined in accordance with the regulations on the administration of expressway.
After the delineation of the building control area, the transportation department shall set up stakes and boundary markers to strengthen protection and management.
In addition to the needs of highway protection and maintenance, it is forbidden to build buildings and ground structures in the building control areas on both sides of the highway; Where it is necessary to lay pipelines, cables and other facilities in the building control area, the consent of the transportation department shall be obtained in advance. Eleventh in the construction control area on both sides of the highway, the illegal construction of buildings and ground structures must be unconditionally removed within the time limit prescribed by the transportation department; If it is not removed within the time limit, it shall be forcibly removed by the transportation department according to law.
Due to the construction of roads, the original buildings and ground structures that have been approved according to law are in the building control area. According to the needs of highway development, the municipal and district transportation departments shall organize the demolition, and the demolition expenses shall be compensated according to the relevant provisions. No alteration, expansion or reconstruction is allowed before demolition. Twelfth transportation departments are responsible for highway greening, and the greening of toll roads is invested and managed by business units.
According to the principle of "unified planning, multi-party investment, multi-party construction and unified management", the highway green belt will be built. Encourage units and individuals to plant roadside trees, flowers and green spaces on both sides of the highway according to the planning of the transportation department. Thirteenth it is strictly forbidden to cut down trees along the road or damage the flowers and green spaces on the road; It is strictly forbidden to hang billboards, wires and other items on roadside trees. If street trees need to be cut down, they should be approved by the transportation department, go through the formalities in accordance with the provisions of the Forest Law of People's Republic of China (PRC) and other relevant laws and regulations, and complete the task of replanting.
