Interim Measures for the Administration of Marine Fishing in Zhoushan National Marine Special Reserve

Chapter I General Provisions Article 1 In order to regulate the business activities of marine fishing organizations and individuals, promote the sustainable utilization of marine resources and ensure the healthy and orderly development of marine fishing activities, these Measures are formulated in accordance with the Fisheries Law of People's Republic of China (PRC), the Regulations on the Administration of Zhoushan National Marine Special Reserve and other relevant laws and regulations. Article 2 These Measures shall apply to the management of marine fishing activities and activities in Zhejiang Shengsi Ma 'an Archipelago Marine Special Reserve and Zhejiang Putuo Zhongjieshan Archipelago Marine Special Reserve (hereinafter referred to as "Protected Areas"). Article 3 The term "marine fishing" as mentioned in these Measures refers to marine fishing activities other than fishing production by using embankments, reefs, rocks and ships for entertainment and sports purposes.

Fishing engaged in recreational fishery activities in protected areas shall be managed in accordance with the Regulations on the Administration of Recreational Fisheries, and productive fishing at sea shall be managed in accordance with the Fisheries Law of People's Republic of China (PRC). Article 4 A licensing system shall be implemented for marine fishing in protected areas. Any organization that has not obtained the business license for sea fishing shall not carry out the business activities of sea fishing in the protected areas; No individual without a fishing license may engage in fishing activities in the protected areas.

Marine fishing in protected areas shall be subject to total control and individual fishing quota management.

Encourage individuals and their own fishing boats to be included in the unified management of relevant organizations. Article 5 The municipal fishery administrative department shall mainly perform the following duties:

(a) to formulate the development plan of the city's marine fishing industry;

(two) to determine the total amount of marine fishing business licenses and marine fishing licenses;

(three) responsible for the city's marine fishing management information construction;

(four) other duties entrusted by the municipal government. Sixth protected areas where the county (District) fishery administrative departments mainly perform the following duties:

(1) Licensing, supervision and inspection of marine fishing management;

(two) the implementation of marine fishing base terminal supervision, marine fishing license inspection and catch inspection;

(three) to urge marine fishing institutions to implement various management systems;

(four) the proliferation and release of fishery resources in the fishing grounds of protected areas;

(five) do a good job in the statistical work of marine fishing and other data. Seventh protected area management agencies mainly perform the following duties:

(a) the implementation of fishery management in protected areas;

(two) to carry out scientific research on the investigation, monitoring and evaluation of marine fishery resources;

(three) to assist in the proliferation and release of fishery resources in protected areas and the construction of artificial reefs;

(4) Proposing suggestions on adjusting the total amount of marine fishing, fishing standards, fishing quotas, closed fishing areas and closed fishing periods in protected areas;

(five) to organize the publicity work of marine fishing management in protected areas. Eighth protected areas where the county (District) tourism departments, maritime departments and other units shall, in accordance with their respective responsibilities, do a good job in the supervision and management of marine fishing institutions, marine fishing boats and marine fishing behavior. Article 9 Organizations and individuals are encouraged to report illegal sea fishing, and after the report is verified, appropriate rewards will be given to informants. Chapter II Application and Administration of Marine Fishing Licenses Article 10 Applications for marine fishing business licenses and marine fishing licenses shall be submitted to the fishery administrative department of the county (district) where the reserve is located.

The validity period of the marine fishing business license is five years.

Marine fishing licenses are divided into long-term licenses and temporary licenses. The long-term certificate is valid for five years. There are three kinds of temporary documents: one day, three days and five days. Article 11 An application for a marine fishing business license shall meet the following conditions:

(1) Having the qualification of a legal person;

(2) Having a ship that has passed the inspection by the relevant department;

(3) Having a perfect safety production management system and implementing safety management personnel;

(4) Having a special berth, equipped with safety facilities such as fire fighting and lifesaving;

(5) Other conditions stipulated by laws and regulations. Article 12 An application for a marine fishing license shall meet the following conditions:

(1) Having full capacity for civil conduct;

(2) Obeying the safety management of sea fishing;

(3) Other conditions stipulated by laws and regulations. Thirteenth to apply for a marine fishing license, the following materials shall be provided:

(a) the business license of the business institution;

(2) Inspection certificate, ownership certificate and nationality certificate of marine fishing vessels, and a lease agreement is required for leasing vessels;

(three) the certificate of the right to use the berthing dock of the marine fishing vessel, and the lease agreement shall also be provided if the dock is leased;

(four) the unit safety management system, safety management personnel roster, communication, fire, emergency rescue and other safety facilities and equipment configuration certification materials;

(5) Other materials as prescribed by laws and regulations. Article 14 To apply for a marine fishing license, the following materials shall be provided:

(a) a copy of my ID card, and foreign citizens are required to submit personal passports and travel or work certificates in China;

(two) a letter of commitment to obey the safety management of sea fishing;

(3) Other materials as prescribed by laws and regulations.

The sea arrest permit can be handled by myself or by the sea arrest operation organization. Entrusted to handle the need to provide a power of attorney. Fifteenth fishing organizations and individuals shall pay the fees for the proliferation and protection of fishery resources according to law. The fee for the proliferation and protection of fishery resources shall be earmarked for the proliferation and protection of fishery resources.

The protection fee for the proliferation of fishery resources shall be collected by the fishery administrative department of the county (district) where the reserve is located and implemented after approval by the competent department.
