Regulations of Shenzhen Special Economic Zone on Green Building

Chapter I General Provisions Article 1 In order to promote the high-quality development of green buildings, promote the construction of green and low-carbon cities, and create a pioneer of sustainable development, these Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the actual situation of Shenzhen Special Economic Zone. Article 2 These Regulations shall apply to the planning, construction, operation, renovation, demolition, supervision and management of green buildings in Shenzhen Special Economic Zone.

The term "green building" as mentioned in these Regulations refers to high-quality buildings that save resources, protect the environment, reduce pollution, provide people with healthy, applicable and efficient use space, and maximize the harmony between man and nature, including civil buildings and industrial buildings. Third green building work should follow the following principles:

(a) overall planning, standard guidance, according to local conditions;

(2) People-oriented, energy-saving and low-carbon, healthy and livable;

(3) government guidance, market promotion and public participation.

During the whole life cycle of a building, effective measures should be taken in accordance with the requirements of relevant laws, regulations and standards to reduce energy consumption and carbon emissions on the premise of ensuring the use function and indoor environmental quality. Article 4 The municipal and district people's governments shall incorporate the development of green buildings into the national economic and social development plan, make overall plans and coordinate major issues concerning the development of green buildings within their respective administrative areas, and list the development of green buildings as a comprehensive evaluation index.

The municipal housing construction administrative department (hereinafter referred to as the municipal housing construction administrative department) is responsible for guiding, supervising and managing the city's green building activities, formulating the city's green building development special plan and annual implementation plan, and preparing local technical specifications and standards for green buildings.

The district housing construction administrative department (hereinafter referred to as the district housing construction administrative department) is responsible for the organization, implementation, supervision and management of green building activities in this area. Article 5 Departments of development and reform, education, scientific and technological innovation, industry and informatization, finance, human resources protection, planning and natural resources, ecological environment, transportation, water affairs, culture, radio and television, tourism and sports, health and hygiene, market supervision, statistics, local financial supervision, urban management and comprehensive law enforcement shall do a good job in the development of green buildings within their respective functions and duties. Article 6 The construction and operation of new buildings shall meet the requirements of not less than one-star green building standards; The construction and operation of large public buildings and office buildings of state organs shall meet the requirements of not less than two-star green building standards.

Encourage the implementation of green transformation of existing buildings, and the green transformation of existing buildings has reached a one-star evaluation standard. The overall transformation of existing buildings should reach the evaluation standard of green transformation of existing buildings by more than one star. Article 7 The municipal housing and urban-rural development department shall formulate the carbon emission control targets in the construction field of this Municipality, and establish systems and mechanisms such as building carbon statistics, carbon audit, carbon monitoring and carbon publicity. Work with relevant departments to promote carbon neutrality in the construction field.

The municipal housing and construction department should study and establish an evaluation system and reward and punishment measures for the effectiveness of climate change in the construction field. Article 8 The municipal and district people's governments and their relevant departments shall incorporate the grade requirements and standards of green buildings into the quality supervision and management system of construction projects.

The construction unit and the design, construction and supervision units shall bear the responsibility for the quality of green building projects according to law.

The municipal, district housing construction departments and other relevant departments shall strengthen the quality supervision and management of green building projects, and urge the responsible subjects and project leaders to implement the lifelong responsibility for the quality of green building projects stipulated in the preceding paragraph in accordance with the relevant provisions of the state. Ninth building owners should bear the main responsibility for the operation and use of green buildings in accordance with the law, and ensure the good operation of green buildings.

Building owners, users and their entrusted management service units shall ensure that the building meets the operational requirements of green building grade. Tenth to carry out green community creation activities, the concept of green development throughout the whole process of community planning, construction, management and service activities, to promote the construction and upgrading of community living environment in a simple and moderate, green and low-carbon way. Eleventh vigorously develop ultra-low energy buildings, encourage the demonstration construction of near-zero energy buildings, zero-carbon buildings and near-zero carbon emission experimental areas, and reduce the carbon emission intensity and total carbon emission of buildings through the large-scale application of green building materials, renewable energy and other products and technologies to achieve carbon emission targets. Chapter II Planning and Construction Article 12 The municipal housing construction administrative department shall, jointly with the municipal development and reform, planning, natural resources and other departments, organize the preparation of special plans for the development of green buildings, and define the development objectives, main tasks and safeguard measures of green buildings.

The special planning for the development of green buildings shall conform to the national spatial planning, and be coordinated with relevant special planning such as ecological environment protection, comprehensive utilization of energy, comprehensive utilization of water resources, development and utilization of underground space, comprehensive utilization of solid waste, and urban infrastructure.

The municipal planning and natural resources department shall incorporate the relevant contents of the special planning for the development of green buildings into the regulatory detailed planning, and make clear the requirements of green building grades, assembly and other new industrial building methods in the planning conditions of construction land according to the regulatory detailed planning.

City, district planning and natural resources departments should indicate the requirements of green building grade, assembly and other new building industrialization construction methods in the contract for transferring the right to use state-owned construction land or the decision on the allocation of state-owned land, as well as the construction project planning permit.
