The waterway transportation industry as mentioned in these Regulations refers to waterway passenger and cargo transportation, ferry transportation and related waterway transportation services and ship management industry. Third provincial transportation departments in charge of the province's waterway transportation, responsible for organizing the implementation of these regulations. Provincial shipping management agencies and shipping management agencies set up by the municipal and county transportation departments are specifically responsible for exercising the functions of waterway transportation management.
Provincial Land Reclamation Bureau traffic management agencies responsible for the system of waterway transportation management, business to accept the guidance and supervision of the provincial department in charge of transportation. Article 4 People's governments at all levels shall incorporate waterway transportation into the national economic and social development plan and make full use of water resources to develop waterway transportation. Fifth encourage and support social forces to invest in waterway transportation, and prohibit monopoly. Sixth waterway management agencies at all levels shall, in conjunction with relevant departments, organize and coordinate information consultation, communication and navigation, loading and unloading services for water transport vessels, and cooperate with relevant departments to do a good job in dykes along the river and environmental protection. Chapter II Opening, Closure and Closure Article 7 Units and individuals engaged in ordinary passenger transportation (including tourism transportation), ordinary goods waterway transportation, dangerous goods waterway transportation, waterway transportation service and ship management shall meet the business qualification requirements stipulated by the competent department of transportation of the state.
Drifting transportation shall meet the following conditions:
(1) Rafts or other means of water transport shall have a nationally recognized ship inspection certificate or product quality certificate;
(two) in accordance with the provisions of the Provincial Communications Department on the management of drifting transportation.
To operate ferry transportation, the following conditions shall be met:
(a) the ship has obtained a qualified ship technical certificate;
(2) Holding a ship ownership certificate or a ship charter contract;
(3) The crew members have certificates of competency;
(four) passenger ferry transportation shall handle the third party transportation liability insurance.
To operate a high-speed passenger ship (including a hovercraft), the following conditions shall be met:
(1) It meets the transportation conditions of ordinary passenger ships;
(two) with more than three years of ordinary passenger transport experience.
Engaged in ordinary passenger ship transportation or cargo transportation at the corresponding ports of China and Russia, in addition to the qualifications stipulated by the state, they should also have more than 2 years of domestic waterway passenger transportation or cargo transportation experience. Article 8 Units and individuals with business qualifications shall apply to the shipping administration for approval in accordance with the following provisions:
(a) the operation of the corresponding ports between China and Russia and cross-city (prefecture) passenger transportation, inter-provincial cargo transportation and ship management industries shall be approved by the provincial shipping management agencies;
(two) the operation of cargo transportation in the province, passenger transportation in the city (the ground) (including the neighboring counties belonging to different cities) and water transportation service industry shall be approved by the municipal shipping management agency;
(three) the operation of passenger and freight transport and ferry transport in the county (city) shall be approved by the port management institution of the county (city); If there is no shipping management institution, it shall be approved by its superior shipping management institution. Ninth applications for international waterway transportation shall be handled by the provincial shipping management agencies in accordance with the relevant provisions of the state. Tenth provincial shipping management agencies shall determine the qualification of ship operation according to the requirements of ship operation safety and technical development and the relevant national industry standards. Eleventh waterway transport operators and transport management personnel shall obtain the certificate of training on transport safety and related legal knowledge issued by the provincial shipping management institutions. Twelfth units and individuals applying for the operation of waterway transportation industry shall declare materials in accordance with the relevant provisions of the state. Article 13 The shipping management agency shall, within 30 days from the date of receiving the application from the units and individuals bidding for the water transport industry, issue qualified water transport licenses, water transport service licenses and ship management industry licenses (hereinafter referred to as licenses); Do not meet the conditions, give a written reply. Fourteenth units and individuals that have obtained business licenses and licenses shall go to the original approval authority to obtain the ship business transportation certificate. The ship's business transport certificate shall be carried with the ship. Fifteenth units and individuals that have obtained permits and ship business transportation certificates shall go to the original approval authority for examination and approval on an annual basis. The specific verification conditions shall be formulated by the provincial shipping management agencies in accordance with these regulations. Article 16 Units and individuals engaged in non-commercial waterway transportation shall file with the local shipping management agencies with the ship inspection certificate and the ship ownership certificate. Seventeenth units and individuals engaged in waterway passenger and cargo transportation shall go through the corresponding procedures in accordance with the relevant provisions. Eighteenth units and individuals engaged in waterway transportation, need to suspend business, should be filed with the original approval authority and the registration authority, the closure time shall not exceed 1 year. To suspend the business of waterway passenger and cargo transportation, the ship business transportation certificate shall be submitted to the original approval authority.
Units and individuals engaged in waterway transportation should apply to the original approval authority 10 days in advance if they need to go through the formalities of closing their business, and go through the relevant formalities.
Units and individuals engaged in waterway transportation need to change their business items, business scope, merger or division, and shall report to the shipping management agency for approval.
