Real estate broker qualification examination and its registration management
The qualification of real estate brokers shall be subject to a unified national outline, unified proposition and unified examination system, which shall be organized and implemented by the Ministry of Personnel and the Ministry of Construction, and shall be held once a year in principle. People's Republic of China (PRC) citizens who abide by national laws and regulations, obtain the qualification of associate real estate broker (not required before 2005), and reach the required education and working years can sign up for the qualification examination of real estate broker. Those who pass the examination will be issued the "People's Republic of China (PRC) Real Estate Broker Qualification Certificate" uniformly printed by the Ministry of Personnel and the Ministry of Construction by the provincial personnel department. The certificate is valid nationwide, and the employer can hire the holder as an economist according to the needs of the work.
The real estate broker qualification examination consists of four subjects, including basic real estate system and policy, introduction to real estate broker, real estate broker practice and related knowledge. Test scores are managed in a two-year cycle. Participants in all four subjects must pass the examination subjects within two consecutive examination years. Persons who have obtained the qualification of real estate appraisers can sign up for the qualification examination of real estate brokers, and do not participate in the subject of "Basic Policies and Systems of Real Estate", but they must pass the other three examination subjects within one examination year.
A person who has obtained the Qualification Certificate of People's Republic of China (PRC) Real Estate Broker can engage in real estate brokerage activities in the name of a real estate broker only after he has registered and obtained the Registration Certificate of People's Republic of China (PRC) Real Estate Broker.
Real estate broker associate qualification examination and its registration management
The qualification of associate practitioners of real estate brokers shall be subject to a unified national outline, and the provinces, autonomous regions and municipalities directly under the Central Government shall propose and organize examinations. All People's Republic of China (PRC) citizens who abide by national laws and regulations, have a high school education or above, and are willing to engage in real estate brokerage activities can sign up for the real estate broker associate qualification examination. For those who pass the examination, the personnel departments of all provinces, autonomous regions and municipalities directly under the Central Government shall issue the "People's Republic of China (PRC) Real Estate Associate Qualification Certificate" in a unified format of the Ministry of Personnel and the Ministry of Construction. The certificate is valid within the administrative area. The provincial real estate management department is responsible for the registration and management of the associate qualification of real estate brokers.
Rights and obligations of real estate agents
Real estate brokers have the right to initiate or join real estate brokerage institutions according to law, assume key positions of real estate brokerage institutions, guide real estate brokers to assist in various brokerage businesses, conclude important business documents such as real estate brokerage contracts with the authorization of their institutions, conduct real estate brokerage businesses and obtain reasonable commissions. When conducting real estate brokerage business, a real estate agent has the right to ask the client to provide information related to the transaction, pay the costs and expenses arising from real estate brokerage activities, and refuse to execute the illegal instructions issued by the client.
The assistant real estate agent has the right to join a real estate agency, and under the guidance of the real estate agent, assist the real estate agent in handling brokerage-related affairs and get reasonable remuneration.

Real estate brokers and associate real estate brokers should use professional knowledge and experience to handle or assist in handling the details of real estate transactions, disclose relevant information to customers, be honest and trustworthy, abide by contracts, complete entrusted business, keep business secrets for customers and fully protect their interests. Real estate agents and assistant real estate agents must receive continuing vocational education and constantly improve their professional level.
Real estate agents and associate real estate agents can only be registered and employed in brokerage institutions and engage in brokerage activities in the name of real estate brokerage institutions. Do not engage in brokerage activities as a real estate agent or quasi-real estate agent, and do not work part-time in other brokerage institutions. Those who have not obtained the qualification certificate of registered real estate broker or the associate qualification certificate of registered real estate broker shall not engage in real estate brokerage activities.
With the consent of the relevant state departments, foreigners and professionals from Hong Kong, Macao and Taiwan who are allowed to work in People's Republic of China (PRC) and meet the prescribed conditions may also sign up for the real estate broker qualification examination and apply for registration.
