Measures of Sichuan Province on the Administration of Police Auxiliary Personnel of Public Security Organs

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the relevant laws, regulations and provisions of the state and in combination with the actual situation of Sichuan Province in order to standardize the management of police auxiliary personnel in public security organs, ensure that police auxiliary personnel perform their duties according to law, safeguard their legitimate rights and interests, and give full play to the role of police auxiliary personnel in assisting the people's police in preventing, stopping and punishing illegal and criminal activities, maintaining social order and serving the people. Article 2 These Measures shall apply to the recruitment, use, supervision and guarantee of police auxiliary personnel of public security organs within the administrative area of this province. Article 3 The term "police auxiliary personnel" as mentioned in these Measures refers to those who are openly recruited to the public according to the social security situation and the actual needs of public security work and provide auxiliary support for the daily operation and police activities of public security organs.

Police auxiliary personnel include police auxiliary personnel and service police auxiliary personnel.

Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, as well as personnel engaged in logistics work such as catering and cleaning in public security organs, do not belong to police auxiliary personnel. Article 4 Police auxiliary personnel do not have the status of people's police, and their duties shall be performed under the command and supervision of public security organs and their people's police, and the consequences of performing their duties shall be borne by the public security organs that use police auxiliary personnel. Article 5 The management of police auxiliary personnel shall adhere to the leadership of the Communist Party of China (CPC), follow the principle of "whoever uses, manages and is responsible", strengthen the construction of the team's political quality, professional ability and discipline style, manage according to law, strictly supervise and strengthen security.

The public security organ at a higher level shall guide and supervise the management of the police auxiliary personnel of the public security organ at a lower level. Article 6 The allocation of police auxiliary forces shall be adapted to the local social security situation, the level of economic development, the allocation of police force and the actual needs of public security work. The quota management of police auxiliary personnel shall be implemented in accordance with the relevant provisions of the state and the province.

The public security organs of the people's governments of provinces and cities (prefectures) can make overall arrangements for the employment places of police auxiliary personnel approved within their respective administrative areas. Article 7 Public security organs should strengthen the informatization and intelligence construction, optimize their work posts and processes, improve law enforcement ability and efficiency, and rationally use police auxiliary personnel. Article 8 The people's governments at or above the county level shall include the salaries, rewards, social security, equipment, clothing, training and other related funds of police auxiliary personnel into the fiscal budget at the corresponding level for protection.

Relevant functional departments such as organization, finance, human resources and social security, and retired military affairs shall, in accordance with their respective responsibilities, specifically undertake the policy guidance and management guarantee of police auxiliary personnel. Chapter II Responsibilities Article 9 Under the organization and command of the people's police, the police auxiliary police may assist in completing the following tasks:

(a) Administrative work, such as clerical assistance, file management, telegraph inquiry, window service, document processing, information collection and input;

(two) psychological counseling, medical treatment, translation, computer network maintenance, data analysis, software development, communication security, video monitoring, laboratory analysis, on-site investigation, inspection and identification, transportation technology, police dog training, drone control, new media management and other technical support work;

(3) Police services, such as keeping and maintaining police equipment other than weapons and police equipment, and logistics services;

(four) other work that can be carried out in accordance with the relevant provisions of the state. Article 10 The auxiliary police, under the leadership of the people's police, may perform the following tasks:

(a) to assist in the development of rental housing security management, special industries, drug control, entry and exit and other related management and service activities;

(two) to assist in the implementation of traffic control and traffic safety inspection, to stop and correct traffic safety violations;

(three) to assist in patrol, inspection, summons and arrest, maintain order, protect the scene and rescue the wounded;

(4) Assisting in taking temporary protective restraint measures against drunken suspects, drug addicts, patients with mental disorders and other people who have lost the ability to identify or control behaviors;

(five) to assist administrative cases in accepting reports, registering cases, accepting evidence, collecting case information, mediating and serving documents;

(six) to assist in making transcripts, sorting out and keeping the files, and managing the property involved;

(seven) to assist the public security organs in the management of supervision places;

(eight) to help maintain the order of large-scale public activities;

(nine) to assist in handling emergencies;

(ten) other work that can be carried out in accordance with the relevant provisions of the state. Article 11 Under the organization and command of public security organs, auxiliary police officers may perform the following tasks:

(1) Accepting and handling people's requests for help and resolving contradictions and disputes according to law;

(two) to divert traffic, prompt and discourage traffic safety violations, assist in collecting traffic violation information, and guide the parties to the accident to negotiate and deal with minor traffic accidents;

(three) to carry out publicity and education on public security, traffic safety and drug control;

(four) other work that can be carried out in accordance with the relevant provisions of the state. Twelfth police auxiliary personnel engaged in related work need to have corresponding qualifications according to law, and shall obtain corresponding qualification certificates. Thirteenth auxiliary police shall not engage in the following work:

(a) political security, technical reconnaissance, anti-cult, anti-terrorism and other work;

(2) Handling matters involving state secrets;

(3) independently conducting case investigation and evidence collection;

(four) issue an appraisal report to identify the responsibility for traffic accidents;

(five) the implementation of criminal compulsory measures;

(6) Making administrative decisions;

(7) Examining cases;

(8) Holding, carrying and using weapons;

(nine) the provisions of laws and regulations can only be engaged in the work of the people's police of public security organs.
