These measures are not applicable to industrial central heating and non-central heating. Article 3 The housing and urban-rural construction department is the administrative department in charge of civil central heating in the central city, and is responsible for the supervision and management of civil central heating activities.
Departments of development and reform, economy and informatization, natural resources and planning, market supervision, finance, taxation, ecological environment, emergency management, public security, administrative examination and approval, etc. shall do a good job in civil central heating according to their respective responsibilities. Article 4 The Municipal People's Government encourages all kinds of investors to invest in the construction and operation of civil central heating facilities, and gives policy support in project planning, construction and operation. Chapter II Planning and Construction Article 5 The municipal housing and urban-rural construction department shall, jointly with natural resources, planning, development and reform departments, formulate a special plan for central heating in Jingmen City according to the overall land and space planning, and implement it after being approved by the Municipal People's Government.
Without legal procedures, the approved special plan for central heating shall not be adjusted. Article 6 The construction of heat sources, heat exchange stations and supporting pipe networks for central heating shall conform to the special plan for central heating.
Within the scope of the special planning of central heating, no new coal-fired (oil) decentralized boiler heating facilities shall be built. The existing coal-fired (oil-fired) boilers within the central heating pipe network should be reformed, gradually dismantled and eliminated within a time limit. Seventh urban construction and transformation should be in accordance with the requirements of the special planning of central heating, supporting the construction of heating facilities or reserving land for the construction of heating facilities. The construction land of the first-class heat exchange station is supplied by allocation according to the land standard of municipal public infrastructure. Eighth new construction, renovation and expansion of urban roads, central heating pipe network channels should be reserved; Has been included in the scope of the special planning of central heating, heating pipelines should be built simultaneously. Article 9 If the newly built, rebuilt and expanded civil buildings within the scope of special planning for central heating need central heating and have heating conditions, the central heating facilities shall be planned at the same time, and the design, construction and acceptance shall be synchronized with the main building project. Tenth existing civil buildings need central heating and meet the heating conditions, heat users can build and transform central heating facilities within the red line of building zoning in accordance with the principle of voluntary self-financing.
If the central heating facilities are newly built or rebuilt in existing residential quarters, the opinions of the owners shall be sought and decided by the owners' meeting. Eleventh central heating projects shall conform to the special planning of central heating, and go through the formalities of planning permission, construction permit, quality and safety supervision, project file submission, completion acceptance and filing in accordance with the relevant laws, regulations and rules of construction project management. Without acceptance or unqualified acceptance, it shall not be delivered for use. Twelfth central heating project installation and use of pressure pipes, heat metering devices and other facilities and equipment should meet the relevant national technical standards, and after passing the statutory testing institutions, can be put into use. The secondary heat exchange station and indoor heating facilities built by heat users shall conform to the relevant national standards. Thirteenth heat users to dismantle, relocate and transform the central heating facilities within the red line of the building division shall formulate the construction plan, solicit the opinions of the heating units, and organize the implementation under the condition of ensuring safety. Article 14 The central heating system of newly-built civil buildings shall be equipped with heating metering devices, indoor temperature control devices and heating system control devices in accordance with the relevant provisions on building energy conservation, with household circulation, household control and household metering functions. Chapter III Heating and Utilization of Heat Article 15 A franchise system shall be implemented for central heating in the central city in accordance with the relevant provisions of the state. The department authorized by the Municipal People's Government shall determine the heating unit through competition and sign a franchise agreement with the heating unit.
The central heating franchise agreement shall include the following contents:
(a) the regional scope and operating period of the central heating franchise;
(two) the ownership and disposal of central heating facilities;
(three) responsible for the construction, management and maintenance of central heating facilities;
(four) heating period, heating quality and service standards;
(five) the way to obtain income, the way to determine the heating price and the adjustment procedure;
(6) government promises and guarantees;
(seven) emergency treatment and temporary takeover;
(8) Performance guarantee for franchising;
(9) Alteration, rescission and termination of the franchise agreement;
(ten) after the termination of the franchise agreement, the transfer methods, procedures and requirements of the project and assets;
(11) Liability for breach of contract;
(12) dispute resolution, etc. Sixteenth heating units shall meet the following conditions:
(1) The qualification of an enterprise as a legal person registered according to law;
(2) Having a safe, sufficient and stable heat source;
(three) facilities, equipment, funds, technology and management personnel suitable for the scale of heating;
(4) Having standardized management and safety systems, operating procedures, service standards and emergency safeguard measures;
(5) Having a good bank credit and financial status and no record of bad behavior;
(six) other conditions stipulated by laws, regulations and rules.
