How to determine the price of the house auctioned by the court

There are four main ways to determine the house price by court auction:

1. Negotiate with all parties (original owners)

Generally speaking, before the auction, the court should negotiate with the parties to the house in an appropriate way, and the parties should negotiate a result within the prescribed time limit. If one party does not cooperate with the bargaining or escapes and his whereabouts are unknown, the court may consider other ways to determine the evaluation price. If both parties reach an agreement on the bargaining result, which is reasonable and legal, then this bargaining result will become the reference price of the house.

2. Please ask the Housing Authority for directional inquiry.

If the evaluation price is determined in this way, the court will send an inquiry letter to the Housing Authority and other institutions in advance, and the inquiry letter will specify the requirements, completion deadline and other matters. After receiving the inquiry letter from the court, the Housing Authority (or other institutions) needs to issue the inquiry result as the appraisal price of the house within the prescribed time limit.

3. Conduct online inquiry on the judicial online inquiry platform.

At present, there are not many platforms for online inquiry, only three channels are JD.COM, Industrial and Commercial Bank of China and Taobao. These platforms have tools to automatically generate evaluation values, just fill in the relevant information in the auction column of these platforms.

4. Entrust an appraisal company to conduct appraisal.

If you want to find an appraisal company to evaluate the house, the court will ask both parties to negotiate with three appraisal agencies in the list of appraisal companies within the prescribed time limit to determine the appraisal order. If both parties fail to negotiate or one party's whereabouts are unknown, three evaluation agencies and the evaluation order will be determined by random drawing. After determining the order, the court will issue an appraisal power of attorney to the institution with the first order, which will clearly write down the property name, physical characteristics, specifications and quantities, use requirements, completion period and other contents that need to be clarified, and will also hand over the appraised property and related materials to the appraisal institution. After the evaluation, the evaluation institution shall issue an evaluation report, which shall specify the basic information, evaluation methods, evaluation standards, evaluation results and validity period of the evaluated property.

This is also the way that we see courts adopt the most at present, because through the evaluation of evaluation agencies, we can evaluate the value of real estate more directly through data and reduce the error of market prices.

Why is the starting price of auction house so low?

Because according to the "Regulations of the Supreme People's Court on Auction and Sale of Property in Civil Execution of People's Courts", the auction reserve price is determined by the people's court with reference to the evaluation price. At the time of the first auction, the reserve price determined by the people's court shall not be lower than the evaluation price or 80% of the market price. If there is an auction, the reserve price can be lowered as appropriate, but the reduction must not exceed 20% of the previous reserve price, so the price of the auction house is very low. There are several other factors.
