Regulations of Shanwei Municipality on the Safety Management of Residential Rental Housing

Chapter I General Provisions Article 1 In order to standardize and strengthen the safety management of residential rental houses, protect the personal and property safety of citizens, legal persons and other organizations, and maintain social order and public safety, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on Public Security Administration Punishment, the Law of People's Republic of China (PRC) Municipality on Fire Prevention and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the safety management of residential rental houses within the administrative area of this Municipality.

The term "residential rental housing" as mentioned in these Regulations refers to the housing used or used for living after being rented, excluding homestays, hotel rooms, policy rental housing and self-built dormitories. Article 3 The safety management of residential rental houses shall follow the principles of source prevention, departmental cooperation, territorial management and comprehensive management. Article 4 The municipal and county people's governments shall be responsible for the safety management of residential rental houses within their respective administrative areas, establish a joint meeting system, ensure the personnel and funds needed for the safety management of residential rental houses, promote the informatization construction of residential rental houses management by using modern science and technology such as big data, Internet of Things and cloud computing, and integrate and utilize all kinds of information resources.

The management institutions established by the people's governments at the city and county levels in the development zones and administrative areas shall, in accordance with the duties entrusted by the people's governments at the corresponding levels, do a good job in the safety management of residential rental houses in the management areas. Fifth public security organs shall be responsible for the comprehensive coordination, organization, guidance and supervision of the safety management services of residential rental houses, and perform the following duties:

(a) improve the rental housing information management network system, collect and check the rental housing information;

(two) improve the rental housing information registration system and other management systems;

(three) the establishment of public security reporting system and rental housing security violations reporting system, accepting and handling complaints and reports of rental housing security violations;

(four) to guide and urge the lessor and the lessee to take safety precautions and urge them to submit the rental housing information according to law;

(five) to guide the towns, streets and administrative departments to carry out rental housing security management services, and to train institutional staff;

(six) to conduct daily inspections of rented houses, visit and conduct public security inspections on a regular basis, and organize public security publicity and education;

(seven) other public security management services for residential rental houses. Sixth fire rescue agencies responsible for the comprehensive supervision and management of residential rental housing fire safety, specifically perform the following duties:

(a) to establish and improve the fire prevention guide for residential rental housing;

(two) to guide towns and streets to implement the responsibility of fire safety management of residential rental housing, to carry out fire safety inspection of residential rental housing, and to implement fire safety complaints;

(three) to guide the towns, streets and administrative departments to carry out fire safety publicity and fire safety training for residential rental houses, and to carry out fire warning education for residential rental houses;

(four) other fire safety management work of residential rental houses. Seventh housing and urban and rural construction (real estate) management department is responsible for the supervision and management of residential rental housing, and specifically performs the following duties:

(a) to guide and urge the lessor and lessee to do a good job in the construction safety prevention of residential rental housing;

(two) responsible for the supervision and management of property service enterprises, real estate intermediary service institutions and gas enterprises;

(three) responsible for the registration of urban residential housing lease, in conjunction with the public security, fire protection, market supervision and management departments to urge the parties to the housing lease contract to use a unified format of the housing lease contract model text;

(four) other rental management of residential rental housing. Eighth development and reform, government service data management, power management, emergency management, market supervision, agriculture and rural areas, civil affairs, natural resources and other departments in accordance with their respective responsibilities to do a good job in the safety management of residential rental housing. Ninth Town People's government, street offices shall perform the following duties in accordance with territorial management:

(a) establish and improve the working mechanism of safety management of residential rental housing, and implement grid management measures;

(two) dynamic verification of residential rental housing and lessors, lessees and other information, real-time grasp of the basic data of residential rental housing and lessors, lessees and other areas;

(three) to organize the safety inspection of residential rental houses;

(four) to urge the elimination of residential rental housing security risks;

(five) in violation of the relevant provisions of the safety management of residential rental housing, timely notify the relevant departments to deal with it according to law;

(six) to carry out emergency drills and publicity and education on the safety of residential rental houses;

(seven) other duties as prescribed by laws and regulations. Tenth villagers' committees and residents' committees shall assist in the safety management of residential rental houses and perform the following duties:

(a) to assist in the establishment of residential rental housing information service management system, the implementation of the person in charge;

(two) to assist in the information collection and registration of rental houses in the village and community;

(three) to assist the relevant departments and the town people's government, street offices to carry out the safety inspection of residential rental housing, and report the safety hazards in a timely manner;

(4) Other duties as prescribed by laws and regulations.

Encourage villagers' committees and residents' committees to organize villagers' meetings and residents' meetings, and incorporate the requirements for the safe use of residential rental houses into village regulations and residents' conventions.
