Regulations of Yunnan Province on Promoting Informatization

Chapter I General Provisions Article 1 In order to promote informatization construction, standardize informatization management, improve informatization level in an all-round way, and accelerate economic development and social progress, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 These Regulations shall apply to the development and utilization of information resources, the popularization and application of information technology, the development of information industry, information security and related management within the administrative area of this province. Article 3 The informatization construction shall follow the principles of overall planning, resource sharing, market orientation, innovation-based, deepening application, efficiency-oriented, safety and reliability. Article 4 The people's governments at or above the county level shall strengthen their leadership over informatization, incorporate informatization into the national economic and social development plan, include special funds for informatization in the fiscal budget at the same level, cultivate and introduce informatization talents, and popularize informatization knowledge and skills. Fifth people's governments at or above the county level shall be responsible for the overall planning, coordination, guidance, supervision and management of informatization within their respective administrative areas.

Other relevant departments are responsible for information management within their respective responsibilities. Article 6 Citizens, legal persons and other organizations are encouraged to invest in informatization construction.

Citizens, legal persons and other organizations are engaged in the production, operation and service activities related to informatization, such as the development and utilization of information resources, the popularization and application of information technology and information security, and their legitimate rights and interests are protected by law. Seventh people's governments at or above the county level shall commend and reward the units and individuals that have made remarkable achievements in informatization. Chapter II Informatization Planning and Project Construction Article 8 The development and reform department of the people's government at or above the county level shall, jointly with the competent department of informatization, formulate an informatization development plan, which shall be implemented after being approved by the people's government at the same level.

The approved information development plan shall not be adjusted without authorization. If adjustment is really necessary, it shall be reported to the original approval authority for approval. Ninth people's governments at or above the county level shall incorporate the special planning of public information network infrastructure construction in the information development planning into the overall planning of urban and rural construction at the corresponding level.

The new construction, expansion or reconstruction of public information infrastructure should meet the requirements of information development planning and avoid repeated construction. Tenth organs, institutions, social organizations and state-owned enterprises shall formulate specific plans and organize their implementation according to the information development plan. Eleventh financial investment-oriented information construction projects should be reported to the relevant administrative departments for examination and approval before the project is established, and the information departments at the same level should put forward examination opinions. Without the examination of the competent department of information technology, no project can be established and funds can be arranged. Twelfth applications for computer information system integration level 1 and level 2 enterprise qualification and information system engineering supervision unit qualification, in accordance with the relevant provisions of the state; Apply for the qualification of computer information system integration level 3 and level 4 enterprise or information system engineering supervision level C unit, after the preliminary examination by the competent information department of the provincial people's government, report to the State Ministry of Information Industry for approval.

The competent information department of the people's government at or above the county level shall strengthen the supervision and management of the qualifications of computer information system integration enterprises and information system engineering supervision units.

It is forbidden for unqualified or unqualified units to undertake information construction projects, and it is forbidden to forge, transfer, lease or buy or sell the qualification certificates of computer information system integration enterprises and information system engineering supervision units. Thirteenth information project construction units shall abide by the bidding, contract management, supervision and completion acceptance system, and accept the supervision and management of the relevant competent departments. Fourteenth after the completion of the construction of information projects, the construction unit shall conduct tests in accordance with national standards or industry standards, and carry out acceptance in accordance with state regulations. Without acceptance or unqualified acceptance of the project, shall not be delivered for use.

The construction of financial investment informatization projects shall listen to the opinions of the competent information department at the time of acceptance. Fifteenth financial investment-oriented information projects, the competent department of information technology of the people's governments at or above the county level shall, in conjunction with relevant departments or organizations, conduct regular performance evaluation. The evaluation results should be used as an important basis for evaluating the informatization work. Chapter III Development of Information Industry and Popularization and Application of Information Technology Article 16 The people's governments at or above the county level shall take measures to strengthen the construction and management of public service platforms in the information industry, support key projects in the information industry, establish a venture capital mechanism in the information industry, encourage independent innovation and promote the development of the information industry. Seventeenth provincial people's government departments in charge of information technology should be based on the national information industry policy, information industry development planning and information industry development oriented directory, to guide the development of information industry.

Relevant preferential tax policies enjoyed by key software enterprises within the national planning layout shall be implemented in accordance with relevant regulations. Other enterprises that develop and produce software products shall enjoy relevant preferential tax policies with the approval of the competent department of information industry of the people's government at or above the state (city) level and the approval of the tax authorities according to law. Article 18 The production and software development of electronic information products shall conform to national standards, industrial standards or local standards. Encourage qualified enterprises to participate in the formulation of national standards for information technology and information products. Nineteenth strengthen e-government work, establish and improve a unified e-government platform, promote information sharing and business collaboration, and improve work efficiency and public service level.
