Article 5 Urban planning should consider people's needs, improve the living environment, facilitate people's lives, pay full attention to low-and middle-income people, help vulnerable groups, and maintain social stability and public safety.

Sixth city planning should adhere to the principles of government organization, expert leadership, departmental cooperation, public participation and scientific decision-making.

Article 7 Urban planning is divided into two stages: overall planning and detailed planning. According to the needs of large and medium-sized cities, they can organize the preparation of zoning plans on the basis of overall planning according to law.

Urban detailed planning is divided into regulatory detailed planning and constructive detailed planning.

Article 8 The overall urban planning shall be based on the national urban system planning organized by the competent construction department of the State Council and the provincial urban system planning organized by the people's governments of provinces and autonomous regions.

Article 9 The preparation of urban planning shall comply with the relevant national standards and technical specifications, and adopt basic data in line with the relevant provisions of the state.

Article 10 Units undertaking the preparation of urban planning shall obtain the qualification certificate of urban planning and engage in the preparation of urban planning within the scope permitted by the qualification grade. Eleventh city people's government is responsible for organizing the preparation of the overall urban planning and urban zoning planning. The specific work shall be undertaken by the competent department of construction of the city people's government (the competent department of urban and rural planning).

The people's government of a city shall, according to the overall urban planning, combine the national economic and social development planning and the overall land use planning, and organize the preparation of the recent construction planning.

Regulatory detailed planning shall be organized by the competent department of construction of the people's government of the city (the competent department of urban and rural planning) according to the approved overall urban planning or urban zoning planning.

Construction detailed planning can be entrusted to the city planning unit by the relevant units according to the planning conditions put forward by the regulatory detailed planning and construction department (urban and rural planning department).

Thirteenth overall urban planning shall be organized in accordance with the following procedures:

(a) in accordance with the provisions of article twelfth of these measures, organize the preliminary investigation, and on this basis, put forward the preparation work report according to the provisions, and organize the preparation after approval. Among them, the organization of the preparation of the overall urban planning of municipalities directly under the central government, provincial capital cities and cities designated by the State Council shall report to the competent construction department of the State Council; To organize the preparation of the overall urban planning of other cities, a report shall be submitted to the competent department of construction of the province or autonomous region.

Article 14 The preparation of a master plan for a city shall be organized by the people's government of the city and led by experts in related fields to study major topics such as resource and environmental protection, regional and urban-rural master plans, urban development goals and spatial layout, and urban historical and cultural heritage protection.

Fifteenth in the preparation of the overall urban planning, it should be organized by the people's government of the city, and fully absorb the opinions of the relevant government departments and military organs.

The results of the adoption of opinions by relevant government departments and military organs shall be used as a special part of the materials submitted for examination and approval of the overall urban planning.

To organize the preparation of detailed urban planning, we should fully listen to the opinions of relevant government departments and ensure the spatial implementation of relevant professional planning.

Article 16 Before the overall urban planning is submitted for examination and approval, the people's government of the city shall take effective measures according to law to fully solicit public opinions.

The detailed urban planning shall be made by publicity and consultation, and the opinions of the units and the public involved in the planning shall be fully listened to. The adoption results of relevant opinions shall be published.

Article 17 In the adjustment of the overall urban planning, an adjustment report shall be submitted to the planning examination and approval authority in accordance with the provisions, and after confirmation, the adjustment shall be organized in accordance with the law.

The adjustment of detailed urban planning shall be subject to the consent of the planning examination and approval authority. The planning adjustment plan shall be open to the public, listen to the opinions of relevant units and the public, and publish the adoption results of relevant opinions. Article 18 Urban planning should properly handle the relationship between urban and rural areas, guide the healthy development of urbanization, embody the principles of rational layout, resource conservation and environmental protection, protect natural and cultural resources, embody urban characteristics, and consider the needs of urban security and national defense construction.

Article 19 When drawing up a city plan, the contents related to the long-term guarantee of urban development, such as resource utilization and environmental protection, coordinated regional development, management of scenic resources, protection of natural and cultural heritage, public safety and public interests, should be determined as mandatory contents that must be strictly implemented.

Twentieth overall urban planning includes urban system planning and central city planning.

In the preparation of the overall urban planning, we should first organize the preparation of the outline of the overall planning, and study and determine the major issues in the overall planning as the basis for the preparation of the planning results.

Article 21 The overall urban planning should be based on the national urban system planning, provincial urban system planning and other statutory plans at higher levels, study the urban positioning and development strategy from the perspective of regional economic and social development, control the population size and improve the population quality according to the requirements of the coordinated development of population, industry and employment. According to the requirements of effective allocation of public resources and improvement of living environment, give full play to the regional radiation and driving role of central cities, rationally determine the spatial layout of urban and rural areas, and promote regional economic development.

Article 22 When drawing up a short-term urban construction plan, we should make clear the implementation focus and development sequence of the short-term overall urban planning, determine the short-term development direction, scale, spatial layout, layout of important infrastructure and public service facilities, and put forward measures for the protection of natural heritage and historical and cultural heritage, and the construction and management of urban ecological environment.

Article 23 In the preparation of a zoning plan for a city, the allocation of urban land use, population distribution, public service facilities and infrastructure should be further arranged according to the overall urban plan approved according to law, and guiding requirements should be put forward for the preparation of regulatory detailed plans.

Article 24 In the preparation of detailed urban regulatory planning, control indicators should be put forward for the land use and construction of specific plots according to the overall urban planning or zoning planning approved according to law, taking into account the requirements of relevant special planning, as the basis for the competent department of construction (the competent department of urban and rural planning) to make planning permission for construction projects.

The detailed planning of urban construction should be based on the regulatory detailed planning approved according to law, and put forward specific arrangements and designs for the construction of the land where it is located.

Article 25 The overall planning of a famous historical and cultural city shall include the special planning for the protection of famous historical and cultural cities.

Historical and cultural blocks shall prepare special protective detailed planning.

Twenty-sixth the expression of urban planning achievements should be clear and standardized, and it should be different from the expression of documents, maps and accessories, special research, analysis drawings and other achievements.

Urban planning documents should be expressed in both written and electronic forms.

(five) to determine the regional transportation development strategy; In principle, determine the layout of urban transportation, communication, energy, water supply, drainage, flood control, garbage disposal and other major infrastructure, important social service facilities and dangerous goods production and storage facilities.

Article 34 The overall urban planning shall specify the principles of special planning such as comprehensive transportation, environmental protection, commercial outlets, medical and health care, green space system, protection of rivers and lakes, historical and cultural cities, underground space, infrastructure and comprehensive disaster prevention.

All kinds of special planning should be based on the overall urban planning.

Section 2 Recent Urban Construction Planning

Article 35 In principle, the term of the recent construction plan shall be consistent with the term of the urban national economic and social development plan, and shall not violate the mandatory content of the overall urban planning.

Upon the expiration of the recent construction plan, a new recent construction plan shall be organized according to the overall urban planning.

Article 36 The contents of the recent construction plan shall include:

(a) to determine the recent population and construction land scale, determine the scope and layout of construction land in the near future.

(two) determine the recent traffic development strategy, determine the layout of major foreign traffic facilities and major road traffic facilities;

(three) to determine the construction scale and site selection of various infrastructure, public services and public facilities.

(four) to determine the recent residential land arrangement and layout;

(five) to determine the protection measures of historical and cultural cities, historical and cultural blocks, scenic spots, etc., as well as the protection, renovation and construction measures of urban rivers and lakes, greening and environment.

Section III Urban Zoning Planning

Article 38 When drawing up zoning plans, we should comprehensively consider the urban layout, regional characteristics, natural and artificial boundaries such as rivers and roads determined in the overall urban planning, and delimit zoning boundaries in combination with urban administrative divisions.

Article 39 The zoning plan shall include the following contents:

(two) to determine the protection scope of green space system, rivers and lakes, high-voltage power supply lines and corridors, external transportation facilities and scenic spots, cultural relics and historical and cultural blocks, and put forward the protection requirements of spatial form.

(four) to determine the location and control range of the main municipal public facilities and the line location and diameter of the main project, and to carry out pipeline synthesis.

(5) Determine the position, section, coordinates and elevation of control points of urban main roads, the direction and width of branch roads, the position and scale of traffic facilities such as major intersections, squares, bus stops and transportation hubs, the direction and control scope of rail transit lines, and the scale and layout of major parking lots.

Section IV Detailed Planning

Article 42 The main uses, building density, building height, floor area ratio, green space ratio, infrastructure and supporting facilities of public service facilities determined in regulatory detailed planning shall be taken as compulsory contents.

Forty-third construction detailed planning shall include the following contents:

(1) Construction condition analysis and comprehensive technical and economic demonstration.

(two) the spatial layout and landscape planning and design of buildings, roads and green spaces, as well as the general plan.

(3) Sunshine analysis of buildings such as houses, hospitals, schools and kindergartens.

(6) Vertical planning and design.
