General rules for the administration of hazardous chemicals registration

Article 1 In order to strengthen the safety management of hazardous chemicals, standardize the registration of hazardous chemicals, and provide technical and information support for accident prevention and emergency rescue of hazardous chemicals, these Measures are formulated in accordance with the Regulations on the Safety Management of Hazardous Chemicals.

Article 2 These Measures shall apply to the registration administration of hazardous chemicals produced or imported by hazardous chemicals production enterprises and import enterprises (hereinafter referred to as registered enterprises).

Article 3 The State practices a registration system for dangerous chemicals. The registration of hazardous chemicals shall follow the principles of enterprise application, two-level audit, unified certification and hierarchical management.

Article 4 state administration of work safety is responsible for the supervision and administration of national registration of hazardous chemicals.

The safety production supervision and administration department of the local people's government at or above the county level shall be responsible for the supervision and administration of the registration of dangerous chemicals within their respective administrative areas. Article 5 The Chemical Registration Center of the State Administration of Work Safety (hereinafter referred to as the Registration Center) shall undertake the specific work and technical management of the national registration of hazardous chemicals.

The safety production supervision and management departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall set up hazardous chemicals registration offices or hazardous chemicals registration centers (hereinafter referred to as registration offices) to undertake the specific work and technical management of hazardous chemicals registration within their respective administrative areas.

Article 6 A registration center shall perform the following duties:

(1) Organizing, coordinating and guiding the national registration of hazardous chemicals;

(two) responsible for the examination of the contents of the national registration of hazardous chemicals, and the issuance and management of the registration certificate of hazardous chemicals;

(three) responsible for the management and maintenance of the national hazardous chemicals registration information management system (hereinafter referred to as the registration system) and the dynamic statistical analysis of hazardous chemicals registration information;

(four) responsible for the management and maintenance of the national emergency consultation telephone for dangerous chemical accidents, and provide 24-hour emergency consultation service;

(5) Organizing chemical risk assessment and uniformly classifying unclassified chemicals;

(six) to provide business guidance to the registration office and be responsible for the training of hazardous chemicals registration personnel in the national registration office;

(seven) regularly notify the relevant departments of the State Council of the registration of hazardous chemicals and make an announcement to the public.

Article 7 The registration office shall perform the following duties:

(1) Organizing the registration of hazardous chemicals within their respective administrative areas;

(two) to review the standardization and consistency of the application materials of registered enterprises;

(three) responsible for the statistical analysis of the registration information of dangerous chemicals within their respective administrative areas;

(4) Providing information support for accident prevention and emergency rescue of dangerous chemicals;

(five) to assist the safety production supervision and management departments within their respective administrative areas to carry out registration training, and to guide the registered enterprises to implement the registration of dangerous chemicals.

Article 8 The staff engaged in the registration of hazardous chemicals in registration centers and registration offices (hereinafter referred to as registration agencies) shall have a junior college degree or above in chemical engineering, chemistry, safety engineering and other related majors, and shall receive unified business training and obtain training certificates before taking up their posts.

Article 9 A registration office shall meet the following conditions:

(a) there are more than 3 registered personnel;

(2) Having strict responsibility system, confidentiality system, file management system and database maintenance system;

(three) equipped with necessary office equipment and facilities. Article 10 Newly-built production enterprises shall register hazardous chemicals before completion and acceptance.

Import enterprises shall register hazardous chemicals before the first import.

Article 11 Where the same enterprise produces or imports the same kind of dangerous chemicals, it shall make a registration according to the production enterprise, but it shall submit the relevant information about the imported dangerous chemicals.

Where an importing enterprise imports the same kind of hazardous chemicals from different manufacturers, it shall register the hazardous chemicals imported from that manufacturer for the first time, but it shall submit the relevant information of hazardous chemicals from other manufacturers.

If a production enterprise or an import enterprise imports the same variety of dangerous chemicals from the same production enterprise for many times, it will only be registered once.

Twelfth hazardous chemicals registration shall include the following contents:

(1) Classification and labeling information, including hazard categories, pictograms, warning words, hazard descriptions, prevention descriptions, etc. Hazardous chemicals;

(2) Physical and chemical properties, including physical properties such as appearance and properties, solubility, melting point and boiling point of hazardous chemicals, and chemical properties such as flash point, explosion limit, spontaneous combustion temperature and decomposition temperature;

(3) The main uses of products recommended by enterprises, including legal uses, prohibited or restricted uses;

(4) Hazard characteristics, including physical hazards, environmental hazards and toxicological characteristics of hazardous chemicals;

(5) Safety requirements for storage, use and transportation, in which the safety requirements for storage include requirements for building conditions, warehouse conditions, safety conditions, environmental sanitation conditions and temperature and humidity conditions, and the safety requirements for use include operating conditions during use, protective measures for operators and hazard control measures at the use site. The safety requirements of transportation include the requirements of transportation or transportation methods, the means of transmitting dangerous information to relevant transportation personnel, and the safety measures during loading, unloading and transportation.

(6) Emergency treatment measures in dangerous situations, including emergency treatment methods and emergency consultation service telephone numbers in case of chemical accidents such as fire, explosion, leakage, poisoning, suffocation and burns during the production, use, storage and transportation of dangerous chemicals.

Thirteenth hazardous chemicals registration shall be handled in accordance with the following procedures:

(1) The registered enterprise applies through the registration system;

(two) the registration office shall conduct a preliminary examination of the application submitted by the registered enterprise within 3 working days, and notify the registered enterprise to go through the registration procedures through the registration system if it meets the requirements;

(three) after receiving the notice from the registration office, the registered enterprise shall truthfully fill in the registration contents in the registration system according to the relevant requirements, and submit the relevant paper registration materials to the registration office;

(four) the registration office shall, within 20 working days from the date of receiving the registration materials of the registered enterprise, examine the registration materials and contents item by item, and conduct on-site verification when necessary. Meet the requirements, submit the registration materials to the registration center; Do not meet the requirements, through the registration system to inform the registered enterprises and explain the reasons;

(5) The registration center shall, within 15 working days from the date of receiving the registration materials submitted by the registration office, review the registration materials and contents, and if they meet the requirements, issue the registration certificate of hazardous chemicals to the registered enterprises through the registration office; Do not meet the requirements, through the registration system to inform the registration office, registered enterprises and explain the reasons.

The time required for a registered enterprise to modify its registration materials and rectify problems shall not be counted within the time limit specified in the preceding paragraph.

Article 14 When handling the registration of hazardous chemicals, a registered enterprise shall submit the following materials and be responsible for the authenticity of their contents:

(1) A registration form for hazardous chemicals in duplicate;

(2) The industrial and commercial business license of the production enterprise, the foreign trade operator registration form of the import enterprise, the qualification certificate of the import and export enterprise in People's Republic of China (PRC), the approval certificate of the foreign-invested enterprise in People's Republic of China (PRC) or the approval certificate of the overseas Chinese investment enterprise in Taiwan, Hong Kong and Macao, 1 copy;

(3) Chemical safety technical specifications and chemical safety labels 1 copy, which are consistent with the hazardous chemicals produced and imported by it and meet the national standards;

(4) A copy of the emergency consultation service telephone number or the power of attorney for emergency consultation service specified in Article 22 of these Measures, 1 copy;

(5) Registered product standards for hazardous chemicals (if national standards or industrial standards are adopted, the adopted standard number shall be provided).

Article 15 If a registered enterprise changes its name, registered address, registered varieties and emergency consultation service telephone number within the validity period of the hazardous chemicals registration certificate, or finds that the hazardous chemicals it produces or imports have new hazardous characteristics, it shall submit an application for change to the registration office within 15 working days, and go through the formalities for changing the registered contents according to the following procedures:

(1) Fill in the Application Form for Registration Change of Hazardous Chemicals through the registration system and submit 1 copies of certification materials related to the change to the registration office;

(2) The Registration Office conducts a preliminary examination of the application for registration change of registered enterprises, and if it meets the requirements, informs the registered enterprises to submit the changed registration materials, and reviews the registration materials, and if it meets the requirements, submits them to the registration center; Do not meet the requirements, through the registration system to inform the registered enterprises and explain the reasons;

(3) The registration center examines the registration materials submitted by the registration office, and if they meet the requirements and belong to the items specified in the Registration Certificate of Hazardous Chemicals, the registration center will issue the Registration Certificate of Hazardous Chemicals to the registered enterprises through the registration office, and recover the original certificate; If it meets the requirements but does not belong to the matters specified in the registration certificate of hazardous chemicals, it shall provide a written certificate to the registered enterprise through the registration office.

Sixteenth dangerous chemicals registration certificate is valid for 3 years. After the expiration of the registration certificate, if the registered enterprise continues to engage in the production or import of hazardous chemicals, it shall apply for a re-examination and renewal three months before the expiration of the registration certificate, and handle the re-examination and renewal in accordance with the following procedures:

(1) Fill in the application form for hazardous chemicals audit and replacement through the registration system;

(2) The registration office shall examine the application for renewal of the registered enterprise, and if it meets the requirements, inform the registered enterprise to submit the registration materials specified in Article 14 of these Provisions through the registration system; Do not meet the conditions, through the registration system to inform the registered enterprises and explain the reasons;

(three) in accordance with the provisions of the third, fourth and fifth paragraphs of article thirteenth of these measures.

Seventeenth dangerous chemicals registration certificate is divided into original and copy, the original is hanging and the copy is folding. The original and the copy have the same legal effect.

The original and duplicate of the registration certificate of hazardous chemicals shall specify the certificate number, enterprise name, registered address, enterprise nature, registered varieties, validity period, issuing authority, issuing date, etc. Among them, the nature of the enterprise should indicate the hazardous chemicals production enterprise, hazardous chemicals import enterprise or hazardous chemicals production enterprise (which can also be imported). Eighteenth registered enterprises shall conduct a general survey of all kinds of dangerous chemicals in their own enterprises, and establish archives for the management of dangerous chemicals.

Hazardous chemicals management archives shall include the name, quantity, identification information, risk classification, chemical safety technical specifications and chemical safety labels of hazardous chemicals.

Nineteenth registered enterprises shall, in accordance with the provisions, register hazardous chemicals with the registration authority, truthfully fill in the registration contents and submit relevant materials, and accept the supervision and inspection carried out by the safety production supervision and management departments according to law.

Article 20 A registered enterprise shall designate personnel to be responsible for the registration of hazardous chemicals, and when necessary, cooperate with the registered personnel to check the contents of hazardous chemicals registered in the enterprise.

Personnel engaged in the registration of hazardous chemicals in registered enterprises shall have the knowledge and ability related to the registration of hazardous chemicals.

Article 21 For chemicals whose hazardous characteristics have not been determined, the registered enterprise shall, in accordance with the provisions of the state on chemical hazard identification, entrust an institution with the qualifications prescribed by the state to carry out hazard identification; If it belongs to dangerous chemicals, it shall be registered in accordance with the provisions of these measures.

Article 22 A hazardous chemicals production enterprise shall set up a domestic fixed service telephone with 24-hour full-time personnel on duty to provide users with emergency consultation services for hazardous chemicals accidents and provide technical guidance and necessary assistance for emergency rescue of hazardous chemicals accidents. Full-time personnel on duty should be familiar with the dangerous characteristics and emergency disposal technology of dangerous chemicals in this enterprise and answer relevant consulting questions accurately.

Where a hazardous chemicals production enterprise is unable to provide the emergency consultation service as specified in the preceding paragraph, it shall entrust a registration agency to act as an agent for emergency consultation service.

An enterprise that imports hazardous chemicals shall provide emergency consultation services in accordance with the provisions of the first paragraph of this article by itself or by entrusting an import agent or registration agency, and indicate the emergency consultation service telephone number on the safety label of hazardous chemicals it imports.

Registration agencies engaged in agency emergency consulting services shall set up domestic fixed service telephones, be equipped with full-time personnel to be on duty 24 hours a day, establish a perfect chemical emergency rescue database, and accurately provide relevant information and suggestions on emergency treatment of chemical leakage, fire, explosion, poisoning and other accidents.

Article 23 A registered enterprise shall not transfer, falsely use or use a forged registration certificate for dangerous chemicals. Twenty-fourth production safety supervision and management departments should incorporate the registration of hazardous chemicals into the contents of law enforcement inspection of hazardous chemicals safety, and deal with registered enterprises that fail to register in accordance with the regulations.

Article 25 The registration office shall timely collect, count and analyze the registration data of hazardous chemicals within its administrative area, and report to the safety production supervision and management departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

Article 26 The registration center shall regularly provide relevant information and materials for the registration of hazardous chemicals to the departments of industry and informatization, environmental protection, public security, health, transportation, railways, quality supervision, inspection and quarantine in the State Council, and make an announcement to the public.

Article 27 The registration office shall, before June 65438+1October 3 1 every year, submit a written report on the registration of hazardous chemicals in the administrative area of the previous year to the safety production supervision and management departments and registration centers of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

The registration center shall submit a written report on the national registration of hazardous chemicals in the previous year to the State Administration of Work Safety before February 15 every year. Article 28. If the registrant of the registration institution violates the rules, practices fraud or issues certificates in disorder, refuses to register without a clear answer within the prescribed time limit, or discloses the business secrets of the registered enterprise, it shall be ordered to make corrections, and the responsibility of the responsible person shall be investigated.

Article 29 If a registered enterprise fails to register hazardous chemicals, its registered varieties change or it finds that the hazardous chemicals it produces or imports have new hazardous characteristics, it shall be ordered to make corrections and may be fined up to 50,000 yuan; Refuses to correct, a fine of 50 thousand yuan and 6.5438+10 thousand yuan; If the circumstances are serious, it shall be ordered to suspend production and business for rectification.

Thirtieth registered enterprises have one of the following acts, shall be ordered to make corrections, and may be fined up to 30 thousand yuan:

(1) Failing to provide emergency consultation services to users or failing to meet the requirements of Article 22 of these Measures;

(2) During the period of validity of the hazardous chemicals registration certificate, the name, registered address and emergency consultation telephone number of the enterprise have changed, and the procedures for changing the registration of hazardous chemicals have not been completed on time as required;

(three) after the expiration of the registration certificate of dangerous chemicals, it fails to apply for review and replacement according to the regulations, and continues to produce or import;

(4) Transferring, fraudulently using or using a forged registration certificate for hazardous chemicals, or failing to fill in the registration contents and submit relevant materials truthfully.

(5) Refusing or obstructing the registration agency to conduct on-site verification of the registration of hazardous chemicals in the enterprise.
