Legal basis: Article 39 of the Supreme People's Court's Interpretation on the Application of Marriage and Family in the Civil Code of People's Republic of China (PRC) (I). If the father or mother brings a lawsuit to the people's court to deny paternity, and provides necessary evidence to prove that the other party refuses to do paternity test without evidence to the contrary, the people's court may consider the claim of the party who denies paternity to be established. If one parent or adult child sues for confirmation of paternity and provides necessary evidence to prove it, and the other parent refuses to do paternity test without evidence to the contrary, the people's court may consider that the claim of the parent who confirmed paternity is established.
