Measures of Nanchang Municipality for the Administration of Construction Project Cost Valuation

Article 1 In order to strengthen the management of construction project cost valuation, standardize the behavior of construction project cost valuation, and safeguard the legitimate rights and interests of all parties in construction projects, these Measures are formulated in accordance with the provisions of People's Republic of China (PRC) Construction Law, Jiangxi Construction Management Regulations and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the valuation and management of construction project cost within the administrative area of this Municipality. The pricing and management of construction project cost of transportation, water conservancy and other specialties shall be implemented in accordance with the relevant provisions of the state and province. Article 3 The term "construction project cost" as mentioned in these Measures refers to all costs required for a construction project from the preparation stage to the completion and delivery stage, mainly including construction and installation project costs, equipment purchase costs, preparation costs and other related costs. Article 4 The municipal construction administrative department shall be responsible for the valuation management of the construction project cost in this Municipality, and its subordinate construction project cost management institutions shall be responsible for the specific work. County and district construction administrative departments are responsible for the management of construction project cost valuation in their respective jurisdictions. The relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in the management of construction project cost valuation. Article 5 The cost of a construction project shall be agreed by the employer and the contractor in the contract. The valuation of construction project cost should follow the principles of fairness, legality and good faith. Sixth construction project cost valuation basis includes the following contents:

(a) the project estimation index and budget estimate index;

(two) the project budget quota, budget quota and unit valuation table;

(3) cost quota and time limit for a project quota;

(four) the price of labor, materials, equipment and construction machinery;

(five) the project cost index;

(6) Specification for valuation with bill of quantities;

(seven) other valuation basis stipulated by the state and province. Seventh city construction project cost management institutions shall, in accordance with the relevant provisions of the state and the province, do a good job in the preparation of new materials, new processes and new technologies. Eighth city construction project cost management institutions shall establish a project cost information database, and regularly publish market price information such as building materials and equipment. Article 9 The investment estimate, design estimate, construction drawing budget and project settlement of a construction project shall be worked out at different stages of construction. If a construction project needs bidding, a pre-tender estimate and a tender offer shall also be prepared. Tenth investment estimation should be based on the construction scale, construction content, construction standards, main equipment selection, construction period, estimation indicators and relevant regulations. Eleventh design budget should be based on preliminary design, budget quota, cost quota and market price. Twelfth construction drawing budget should be based on construction design drawings, budget quota, cost quota and market price. Thirteenth tender base price should be based on the approved preliminary design, investment estimation, tender documents, budget quota, cost quota and market price. Fourteenth tender offer should be based on the tender documents, cost quota, market price, etc. , combined with technical equipment, management level, the construction unit's requirements for construction period and quality. Fifteenth project settlement should be based on the completion drawings, contracts, project cost valuation basis and relevant regulations. Sixteenth the preparation of construction drawing budget, tender base price and tender offer can adopt quota valuation method or bill of quantities valuation method. Seventeenth quota pricing method refers to the pricing method of calculating the direct cost, indirect cost, profit and tax of the project according to the unified base price table, cost quota and related documents and charging procedures. Article 18 The valuation method of bill of quantities refers to the valuation method of calculating all the costs required for the project according to the valuation standard of bill of quantities, including the partial project costs, measures project costs, other project costs, fees and taxes.

The bill of quantities shall be compiled according to the tender documents, construction design drawings, bill of quantities valuation specifications, relevant technical data, valuation regulations, construction site conditions and specific conditions of the project. Nineteenth all use of state-owned funds, or state-owned funds account for more than 50% of the total investment, or state-owned funds account for less than 50% of the total investment, but state-owned capital investors have a controlling stake in large and medium-sized construction projects, must adopt the bill of quantities valuation method; The project contract price and the project settlement book shall be informed in writing to the municipal construction project cost management institution within 1 month after the signing of both parties. Article 20 If the employer and the contractor have disputes over the project settlement of the construction project, they may apply to the construction administrative department for mediation; If mediation fails, it may apply for arbitration or bring a lawsuit to the people's court according to law; You can also directly apply for arbitration or bring a lawsuit to the people's court according to law. Twenty-first construction project investment estimation, design budget, construction drawing budget and project settlement, the unit has the ability to prepare, can be prepared by itself; If the unit does not have the ability to compile, it shall entrust a construction project cost consulting unit with corresponding qualifications to compile.

The pre-tender estimate of a construction project shall be prepared by a tenderer who has the ability to prepare tender documents or a construction project cost consulting unit or tendering agency with corresponding qualifications entrusted by the tenderer.

The bidding quotation of construction project shall be compiled by the bidder or the qualified construction project cost consulting unit entrusted by it. Twenty-second units engaged in construction project cost consulting business shall obtain qualification certificates according to law, and engage in construction project cost consulting business within the scope stipulated in the qualification certificate, and shall not issue false reports or data, and shall not transfer intermediary business.

It is forbidden to forge, alter, lease, transfer or sell qualification certificates.
